About this file
This is a Performance Work Statement (PWS) for refuse collection and disposal services supporting government personnel participating in exercise operations on the island of Saipan, Commonwealth of the Northern Mariana Islands (CNMI), from June 1st to July 16th.
The Contractor must provide all personnel, supervision, transportation, operating costs, containers, and necessary supplies to perform municipal solid waste (MSW) collection and disposal services at the Cowtown Site, which requires a minimum total on-site dumpster capacity of 40 cubic yards. The Contractor has complete flexibility to determine individual container sizes and quantities to meet this requirement. Services must maintain a minimum collection frequency of once per week, with dynamic servicing requirements mandating that no container exceed 80% of its volumetric capacity at any time, necessitating increased frequency up to daily pickups as needed. All dumpsters must be maintained in clean, sanitary, odor-controlled, and fully functional condition with securely closing lids. The Contractor must ensure zero spillage during collection, loading, and hauling processes, with immediate cleanup and sanitization of any spilled waste. All waste must be transported and disposed of off-site at a legally approved, licensed waste management facility in compliance with CNMI laws and environmental policies. Hazardous materials, toxic waste, medical waste, lithium batteries, and electronics are excluded from this contract.
The Contractor must designate a Contract Manager available during the entire period of performance who responds to government contacts within two hours. A 24-hour emergency contact number is required, with contractor response and corrective action initiation within two hours of notification. All contractor personnel must obtain necessary identification and vehicle passes for military exercise footprints, coordinate site access with the USAF designated point of contact, and adhere to Installation/Exercise Commander standards. Performance standards include 100% on-time delivery by May 29th, 100% compliance with the 80% capacity rule, zero spillage with closed lids, and emergency response within specified timeframes. The U.S. Government is not responsible for damage from acts of God, normal wear and tear, or damage claims must be submitted in accordance with FAR Part 33.2.

PERFORMANCE WORK STATEMENT (PWS)
REFUSE COLLECTION AND DISPOSAL SERVICES (SAIPAN EXERCISE)
1.0 INTRODUCTION & PROJECT DESCRIPTION
This Performance Work Statement (PWS) defines the requirements for non-hazardous Municipal Solid Waste (MSW) refuse collection and disposal services. These services will support government personnel participating in exercise operations on the island of Saipan (Commonwealth of the Northern Mariana Islands - CNMI). Because operations are conducted in field environments with high operational tempos, reliable and sanitary waste management is essential for sustaining force health, safety, and readiness.
2.0 PLACE & PERIOD OF PERFORMANCE
2.1 Place of Performance
Services shall be performed at one distinct location on the island of Saipan:
1. Cowtown Site (Saipan)
Note: Specific delivery and placement coordinates within Cowtown will be provided to the Contractor by the Contracting Officer’s Representative (COR) at the time of award.
2.2 Period of Performance (PoP)
The Period of Performance shall be from June 1st to July 16th.
3.0 PERFORMANCE REQUIREMENTS & SPECIFIC TASKS
The Contractor shall provide all qualified personnel, supervision, transportation, operating costs, containers, and any other necessary supply or service to accomplish the complete performance of the refuse collection services requested herein.
3.1 Dumpster Volumetric Capacities
The Contractor shall provide and place refuse containers (dumpsters) meeting the following total volumetric capacities at each designated site:
• Cowtown Site: Minimum total on-site capacity of 40 Cubic Yards.
The Contractor has complete commercial flexibility to determine the individual sizes and quantities of the containers deployed to meet these minimum volumetric requirements (e.g., four 10-yard dumpsters or two 20-yard dumpsters at Cowtown). This is intended to maximize competition and utilize available on-island inventory.
3.2 Collection Frequency and Capacity Threshold (The "80% Rule")
• Minimum Frequency: The Contractor shall empty all containers at a minimum of once per week.
• Dynamic Servicing: This is a performance-based service. The Contractor must actively monitor waste accumulation and increase collection frequency (up to and including daily pickups) to ensure that no dumpster container exceeds 80% of its volumetric capacity at any time.
• Overflow Prevention: Refuse shall not be allowed to overflow or accumulate outside the containers.
3.3 Environmental and Spillage Control
• Sanitary Condition: The Contractor shall maintain all dumpsters in a clean, sanitary, odor-controlled, and fully functional condition. Lids must close securely at all times to prevent pest intrusion, vector-borne diseases, and windblown litter.
• Zero Spillage: The Contractor shall ensure zero spillage of waste during the collection, loading, and hauling processes. Any waste spilled during servicing must be cleaned up and sanitized immediately by the Contractor prior to leaving the site.
• Lawful Disposal: All collected waste must be transported and disposed of off-site at a legally approved, licensed waste management facility in strict accordance with all local CNMI laws, environmental policies, and landfill regulations.
3.4 Excluded Waste
The Contractor shall only collect standard Municipal Solid Waste (MSW). Hazardous materials, toxic waste, medical waste, lithium batteries, and electronics are strictly excluded from this contract.
4.0 CONTRACT ADMINISTRATION, ROLES, & LIABILITIES
4.1 Contracting Officer (KO) Authority
The Contracting Officer is the only person authorized to approve any changes to the requirements of this contract. In the event the Contractor effects any change at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and no adjustment will be made in the contract price.
4.2 Contractor Management & Responsiveness
• Contract Manager: The Contractor shall designate a Contract Manager who is responsible for the overall contract operations and shall serve as the primary Point of Contact (POC) for the KO and COR. The Contractor shall provide in writing the name and contact information for the Contract Manager within five (5) days after contract award.
• Responsiveness: The Contract Manager must be available during all Period of Performance dates. When contacted by the KO or COR, the Contract Manager must respond within two (2) hour via phone or email correspondence.
• Emergency Contact: The Contractor shall provide a 24-hour emergency telephone number. In the event of an urgent requirement, container overflow risk, storm damage, or other service discrepancy, the Contractor shall respond and initiate corrective action within two (2) hours of being notified.
• Supervision: Contractor personnel shall, at all times, be under the supervision of the Contractor and not under the supervision of the U.S. Government or any of its officers or employees.
4.3 Government Liability & Damages Clause
• Acts of God: The U.S. Government (USG) shall not be responsible for acts of God that may result in damage to any refuse containers or equipment provided (e.g., typhoons, earthquakes, natural disasters).
• Wear and Tear: The USG shall not be responsible for normal wear and tear to the equipment provided.
• Negligence: The USG will only be responsible for damage in excess of normal wear that results from direct negligence, neglect, or similar acts of USG personnel.
• Claims: All Contractor claims for damage by the Government must be submitted to the Contracting Officer for consideration in accordance with FAR Part 33.2.
5.0 QUALITY ASSURANCE & QUALITY CONTROL
5.1 Quality Control Program
The Contractor shall maintain a Quality Control (QC) program to ensure services are performed in accordance with commonly accepted commercial practices and the standards outlined in this PWS.
5.2 Re-Performance of Non-Conforming Services
If any of the services provided do not conform to contract requirements (e.g., container allowed to exceed 80% capacity, spillage left on site, failure to clean/sanitize containers), the U.S. Government reserves the right to require the Contractor to re-perform the services in conformity with the contract requirements at no additional expense to the Government.
6.0 SECURITY, INSTALLATION ACCESS, & SAFETY
6.1 Base Access Requirements
The Contractor shall obtain all necessary identification passes for employees and vehicle passes for all vehicles requiring entry onto the military exercise footprints at Cowtown and the Saipan International Airport. Access to the sites to perform required work must be coordinated with the designated USAF POC at the time of award. Contractor personnel must adhere to all standards of conduct as established by the Installation/Exercise Commander.
6.2 Safety Compliance
