INSTRUCTIONS CONDITIONS AND NOTICES TO INTERESTED PARTIES AND RESPONDENTS

This solicitation for commercial services was written in accordance with Federal Acquisition Regulations (FAR) Part 12 Commercial Acquisitions, FAR Part 13 Simplified Acquisition Procedures, under the format in Subpart 12.3 as supplemented with additional information included in this notice. The solicitation number is 12639522Q0230 and is issued as a request for quote (RFQ), In order to have a complete package, as a minimum, the return package must contain the following items. Offers submitted without completion of items listed here shall be considered nonresponsive and ineligible for award.

8. Evaluation:

Evaluation will be in accordance with Federal Acquisition Regulation sub part FAR 13.106-2 (b) Evaluation—Commercial Items. In accordance with Federal Acquisition ( FAR) 13.106-1 (2); The Government will award a contract resulting from this solicitation to the responsible Quoter whose Quote conforming to the solicitation will be the “Best Value” and most advantageous to the Government.

Price, and past performance (preferably government contract experience) are the factors to be considered.

Past performance may also be based on government info in the Governmentwide Federal Awardee Performance and Integrity Information System (FAPIIS). In the case of a quoter with no past performance, this factor will not be evaluated favorably or unfavorably. The contracting officer’s or USDA/PPQ/PDC Program’s knowledge of, and previous experience with the services being acquired may also be considered

9. Site Visits In accordance with FAR Clause 52.237-1 (pages 43 – 44)

Quoters are urged and expected to inspect the site where services are to be performed and to satisfy themselves regarding all general and local conditions that may affect the cost of contract performance, to the extent that the information is reasonably obtainable. In no event shall failure to inspect the site constitute grounds for a claim after contract award.

JANITORIAL SEMI-ANNUAL CLEANING STATEMENT OF WORK

(1) Description of agreement.

The United States Department of Agriculture (USDA), Animal and Plant health Inspection Service (APHIS), Plant Protection and Quarantine (PPQ), Professional Development Center (PDC), located at 69 Thomas Johnson Drive, Suite 100, (Building 1), Frederick, MD 21702, with 25,782 square feet of usable space and 67 Thomas Johnson Drive, Suite A2, (Building 2) with 12,084 square feet of usable space.

The Period of Performance is for approximately twelve months and one possible twelve month option period. Per FAR 13-303-6. The Contracting Officer and individuals and/or organization component authorized to place BPA calls will ensure the BPA is reviewed at least annually and updated at that time to make new arrangements or modify existing arrangements, and to validate the need for this BPA.

The janitorial services will meet with all standards of cleanliness, which will reflect good housekeeping, as determined by the on-site Contracting Officer’s Representative (COR). The Statement of Work will be incorporated into the contract.

The Contractor will furnish all necessary equipment and cleaning supplies ; (disinfectant solutions for surfaces, cleanser, floor wax, floor stripping solution, furniture polish, floor cleaner, glass cleaner, cleaning towels, disposal bags and urinal cakes, mops, brooms, dusters and duster cloths. For equipment; contractors must have (floor buffers, buffer heads, wax striping heads, carpet cleaning machines and supplies as well have floor sanitizer machines for bathrooms), to perform services stated in the statement of work for cleanliness of the building.

The hours of cleaning services will be from 8:00 until 4:00 pm over a period of two days. Special schedules are made for these semi annual maintenance operations. Contractor will be notified by the local Contract Representative of dates when services are to be performed.

(2) Semi Annual Services:

o All edges and corners of tile areas along rubber floor moldings will be thoroughly cleaned o All dirt and wax build up will be removed.

o All rubber molding will be washed and vacuumed along carpet areas.

o Trash containers located in the lounge areas will be washed inside and out or steam cleaned to remove food debris from the containers.

o All the tile area are to be: (Notice is to be given to the COR when cleaning is to occur).

Stripped Waxed Buffed using non-slip wax Bathrooms floor sanitized o Base boards are to be cleaned of wax buildup o All outside cigarette receptacles will be emptied. Cigarette receptacles are located behind each building and mounted to the brick wall.

o Windowsills in the conference rooms/lounges will be cleaned and sanitized (3 conference rooms – 2 in building 67 and 1 in building 69) o All ceiling light fixtures will be cleaned and accumulated insects removed o Carpet areas will be shampooed using a mild method to control wear and tear on the life of the carpet. (Notice is given to COR, when carpet cleaning is to occur).

o All rubber floor moldings to be cleaned with damp cloth o Dust all Venetian/Vertical blinds. (Notice is to be given to COR when cleaning is to occur) o The Janitor closets are to be kept in an orderly manner:

o Janitor closet mop sink cleaned in both buildings.

o Janitor closet floor cleaned.

Contractor will be responsible for moving and replacing furniture and equipment to the original setting after cleaning.

Notices and Rules o Do not clean the computer monitors. Cleaning the monitors can result in damage.

o No un-authorized personnel are permitted in the PDC buildings that includes:

Family members Children Friends Pets People who have not completed and passed the background check People who do not have an issued badge

(3) Safety And Security

• The USDA/APHIS/PPQ /PDC Facilities in Frederick, MD are secure facilities.

Contractors must be escorted at all times while on site. Contractors must provide photo ID and sign in/sign out when entering/leaving the facilities at all times.

• The entry of privately owned vehicles into USDA/APHIS/PPQ /PDC requires a valid

State Driver’s License.

• The vendor shall assure that applicants are prescreened for background, drug use, etc. and may be asked to provide documentation thereof.

• USDA/APHIS/PPQ /PDC facilities are a drug/weapons free workplace.

(4) Extent of obligation

• The Government is obligated only to the extent of authorized calls actually placed against this BPA.

• The aggregate dollar limitation is fifty thousand Dollars ($ 50,000.00).

(5) Purchase limitation.

• Calls placed by individuals authorized under this BPA shall not exceed the dollar limitation listed on the Individuals Authorized to Place Call Orders:

• Maximum Aggregate Dollar Limit: $ 50,000.00

Call Limit: $ 25,000

(6) Individuals authorized to purchase under the BPA.

The following individuals and/or organizational component are authorized to place BPA calls:

• Contract Specialists and Purchasing Agents, USDA/APHIS/MRPBS Minneapolis, MN BPA Calls NTE $10k. Individuals may not exceed their warrant authority

• USDA/APHIS/MRPBS will begin awarding Delivery Task Orders after award on an “as needed quarterly basis” They will be numbered with an the format: 126395YYFNNNN .

• Receipt of services shall be authorized by Contracting Officer’s Representative (COR).

Acceptance in accordance with FAR 52.212-4 (a)

• At any time the Contracting Officer may modify this BPA to change, add, or delete some of the terms or conditions. Whenever you receive a modification, always read it in its entirety. Modifications are in accordance with FAR 52.212-4 ( c) Contract Terms and Conditions-Commercial Items. Contracting office will ensure the modification is placed in the BPA file.

• The Program Contract Administrator should coordinate with the Contractor and Financial Management to make sure all payments are made before the close-out.

(7) Invoices shall contain the following information.

(i) Name of supplier.

(ii) BPA number.

(iii) Date of purchase.

(iv) Individual Delivery Task Order number.

(v) Itemized list of services furnished and pricing

(vi) Period of Performance of services (start date – end date )

(8) Invoicing

• Payment for services rendered will be Net 15 days ARO in accordance with 0MB Dated 06/07/2012 Accelerating Payments to Small Businesses for Goods and Services

(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR subpart 4.7, Contractor Records Retention, of the other clauses of this contract. If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.

(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(e)

(1) Notwithstanding the requirements of the clauses in paragraphs (a), (b), (c), and (d) of this clause, the Contractor is not required to flow down any FAR clause, other than those in this paragraph (e)(1) in a subcontract for commercial products or commercial services. Unless otherwise indicated below, the extent of the flow down shall be as required by the clause-
