Certificate of Compliance to Berry Amendment
As prescribed at DFARS 225.7002, “Restrictions on food, clothing, fabrics, specialty metals, and hand or measuring tools” and implemented via DFARS clauses 252.225-7012, 252.225-7014, and 252.225-7015, the undersigned understands and will comply with the Defense Federal Acquisition Regulation supplemental regulations.
Furthermore, the undersigned understands that in addition to the Buy America Act, the Berry Amendment applies to both end items AND components to assemble the end item, as well as any and all subcontracted components. These components (but not limited to) can include buttons, zippers, thread, clips, fasteners, and ties.

1. IDENTIFICATION OF SOURCES FOR CLOTH/TEXTILE COMPONENTS
a. The offeror shall identify the names and addresses of those suppliers from whom each cloth or textile component item will be obtained for use in the performance of any resultant contract. In addition, for each cloth or textile component item, the offeror shall also identify the item’s manufacturer and address of the manufacturing facility. Failure to furnish this information with the offer may result in rejection of the offer.
b. The offeror shall attach a worksheet to this certificate that lists each component, the name and address of the supplier, and the address of the supplier’s manufacturing facility. The components used in each uniform item is listed in each uniform’s specification. Examples of components include fabric, zippers, buttons, thread, fasteners, and packaging materials (identified in each Letter of Exception).
b. No change in the supplier(s) or manufacturer(s) listed below shall be permitted between the opening/closing date of the offer and the award, except where time permits and then only upon receipt of the contracting officer’s written approval.
c. Any change in the supplier(s) or manufacturer(s) listed by the offeror, and in any resultant contract, is prohibited unless it is specifically approved in advance by the contracting officer.
d. Offerors must list all components used for each uniform item. Offerors shall comply with the Berry Amendment. Noncompliance may disqualify the proposal from further consideration of an award. It is imperative this is completed correctly and all components are listed on the attached worksheet.
2. PLACE OF PERFORMANCE
(a) The offeror or respondent, in the performance of any contract resulting from this solicitation, ( ) intends, ( ) does not intend (check applicable block) to use one or more plants or facilities located at a different address from the address of the offeror or respondent as indicated in this proposal or response to request for information.
(b) If the offeror or respondent checks “intends” in paragraph (a) of this provision, it shall insert in the following spaces the required information:
Place of Performance (Street Address, City, State, County, Zip Code)
Name and Address of Owner and Operator of the Plant or Facility if Other Than Offeror or Respondent
