PERFORMANCE WORK STATEMENT

Rough Mowing Willamette Valley Project FY21

GENERAL

This contract is for rough mowing on United States Army Corps of Engineers (USACE) lands in the Willamette Valley of Oregon. Rough mow areas are managed as open grassland for the benefit of wildlife and plants. These areas are typically mowed once per year in the fall to maintain open vegetation and prevent encroachment by trees, shrubs, and blackberry canes. This is a Firm Fixed Price Contract with one base year and up to four option years.

The Contractor shall provide all labor, equipment, and supplies necessary to perform all mowing in the Willamette Valley Project (WVP) areas shown on the location maps, Attachments 1-33. All work performed shall be in strict accordance with these specifications. Acreage figures and mowing boundary lines are approximate. Physical barriers, existing mow line, and the attached specifications will determine the limit of mowing.

The Contracting Officer Representative (COR) will determine the approximate schedule of mowing sites, and mowing shall be completed within that window, weather permitting. The Contractor shall complete the mowing of all units between 15 August and 15 November of each year during appropriate conditions. An extension may be granted through November 30th, weather permitting. The contractor shall notify the COR of planned work schedule and any delays as soon as they are realized. The COR may direct to contractor to adjust the mow schedule or to leave a unit un-mowed due to prescribed fire at the site, management conflicts, or other natural or human caused events. We expect that only 1-2 units (5-50 acres) would be left un-mowed each year.

The contract covers approximately 203 acres. There are 29 mowing units spread across 5 reservoirs in the Willamette Valley. The contract also includes 4 separate rough mowing options that can be executed, or not, in any or all years and any combination at USACE’ discretion. All 4 options are located around Fern Ridge Lake, adding up to 39 more units covering approximately 263 acres.

For an overview, reference the attached location maps. Some of the units are adjacent and may be mowed continuously without hauling equipment by road. Payment will be per unit for completed units. Any units left un-mowed after November 30th will not be billable.

DEFINITIONS

Rough Mowing Areas – These areas are shown on the attached location maps. Rough mow areas are mowed in the fall (September through mid-November) as this has the least impact to wildlife. Vegetation height immediately following mowing shall be between 8 and 12 inches. The Tufti North Unit (Map: 18) is mowed in June. This unit has blackberry and scotch broom that was mowed in 2017 and may need brush cutting equipment for efficient vegetation clearing. Mowing in June is intended to allow for fall re-green and spray of blackberries in the Tufti North unit.

Contracting Officer (KO) - A person appointed in accordance with prescribed regulations, who is vested with the authority to enter into and administer contracts and make determinations and findings with respect thereto, or with any part of such authority.

Contracting Officer Representative (COR) – An individual designated by the Contracting Officer, who shall be responsible for regular and daily administration of this contract, and inspection and acceptance of services performed under it.

Quality Assurance Evaluator (QAE) –The Government employees responsible for checking Contractor performance.

Invasive/Noxious Weeds – A species that is non-native to the ecosystem under consideration and whose introduction causes or is likely to cause economic or environmental harm or harm to human health. Common

7 May 2021 noxious weeds include, but are not limited to, Scotch Broom (Cytisus scoparius), false brome (Brachypodium sylvaticum), meadow knapweed (Centaurea jacea x nigra), shining geranium (Geranium lucidum), sulfur cinquefoil (Potentilla recta), Canada thistle (Cirsium arvense).

Native species – A plant or animal that is part of the natural, historical environment. Common native species of Oregon include, but are not limited to, Douglas fir (Pseudotsuga menziesii) and Oregon white oak (Quercus garryana) trees, Poison Oak (Toxicodendron diversilobum), and tall Oregon grape (Mahonia aqufolium).

Quality Assurance Surveillance Plan (QASP) – A document that describes the disciplined process the government will use in evaluating the Contractor's actual performance to determine conformity with the contract.

Contract Discrepancy Report (CDR) – A written record of unsatisfactory performance by the Contractor as observed by the QAE. http://www.dtic.mil/whs/directives/forms/eforms/dd2772.pdf

SERVICE REQUIREMENTS

Mowing. Contractor shall perform mowing according to the following specifications unless otherwise specified in the “Specific Location Requirements” section. Rough mowing shall take place during daylight hours. The contractor shall abide by all fire restrictions in place at the time of mowing.

Vegetation shall be mowed to a height not shorter than eight (8) inches and not longer than twelve (12) inches. If mowing over rocky ground an allowance shall be made for a height of six (6) to fourteen (14) inches.

The contractor shall ensure trees and shrubs greater than four (4) inches diameter at breast height (DBH) are not damaged. Trees and/or shrubs greater than 4 inches DBH that are damaged by the Contractor shall be removed and replaced with a native species of equivalent size and species by the Contractor at no expense to the Government.

The Contractor, with approval of the COR, may substitute other native species of tree and/or shrub of an equal value. The COR will inspect any damaged trees and determine the caliper, height, and species of tree, for which the Contractor shall purchase and install in a designated location chosen by the COR. Smaller trees and shrubs growing near larger (greater than 4 inches DBH) trees need not be mowed if mowing threatens damage to the larger tree or shrub.

If nursery stock is not available for suitable replacement the Contractor shall have the market value of the damaged trees (purchased and installed) deducted for each damaged and un-replaced tree or shrub from the invoice. The COR will provide a memorandum for record to document the reasoning for the deduction.

Some units contain areas planted with small shrubs and other vegetation as part of restoration projects. These areas are marked on the attached mowing maps (Attachments 1-31). Any restoration plantings damaged in these areas shall be replaced with equivalent size and species by the contractor and at no cost to the government. Restoration plantings may or may not be physically marked at the site, and must be avoided regardless.

Mowing equipment shall be operated in a manner that prevents tearing out turf. Strips of uncut vegetation shall not remain at the site upon completion of mowing. Mowing shall not be performed when the ground is so wet that mowing operations cause wheel ruts. Mowing operations shall not create visible rutting or damage to the ground surface.

The contractor shall ensure that all roads, sidewalks, buildings and parking lots are cleared of grass clippings prior to completing work in the area. Clippings shall not be sprayed from the mowers or trimmers onto personal property.

Grass clippings shall be spread evenly on mowed areas. The Contractor shall not leave grass clippings in rows or clumps as this can kill vegetation. The contractor shall not dispose of clippings in areas adjacent to those outlined in the contract.

The Contractor shall prevent the spread or transfer of invasive/noxious weeds from infested sites to non-infested sites by cleaning equipment. Equipment shall be clean prior to arrival on USACE land. When mowing equipment is transported by road from one site or mowing unit to another, equipment shall be cleaned on site before it is moved. Soil and seeds shall not remain on equipment that is transported from one site to another. It is permissible to move mowing equipment between adjacent units and nearby mowing units provided that invasive/noxious weed seed is not transported from infested to un-infested units. The COR may inspect equipment and cleaning processes.

The COR may require additional cleaning if equipment is found to harbor seeds and/or soil. If new patches of noxious weeds are discovered at any time, the COR may modify the mowing schedule or require additional equipment cleaning in order to prevent spread to un-infested sites.

All equipment used in areas infested with high priority invasive species including, but not limited to, false brome (Brachypodium sylvaticum), meadow knapweed (Centaurea jacea x nigra), shining geranium (Geranium lucidum), sulfur cinquefoil (Potentilla recta), and Canada thistle (Cirsium arvense) shall be cleaned within the infested area prior to vacating the site.

The contractor shall not discharge oil, gasoline, or any hazardous substance into the environment. Fueling of mowers and vehicles shall be done away from mow areas. The Contractor shall immediately report leaks or spills to the COR. Prior to starting work, the contractor shall provide a spill response plan for approval by USACE. The contractor shall carry boom, pads, and other approved spill response equipment at all times and shall immediately deploy this equipment in the event of a spill or leak. The contractor shall be financially responsible for any damage to government lands or property.

The contractor shall adhere to fire restrictions that may be implemented by local agencies. It is the responsibility of the contractor to be aware of and comply with restrictions. The contractor shall inform the COR of schedule adjustments related to fire restrictions.

Equipment. All equipment shall be of commercial grade and of appropriate size to meet the requirement of this contract and meet the requirements of the USACE Safety Manual EM 385-1-1.

All equipment shall be in good mechanical condition and shall be safety approved by the COR prior to being permitted on the job site. Prior to starting work, the Contractor shall provide the COR with documentation of safety inspection for all power equipment being used on the job site. Inspection shall be the responsibility of the Contractor.

Mowers shall be equipped with safety chains or other protective devices to prevent flying objects from striking persons or damaging property. Effective spark arresting exhaust mufflers shall be maintained on all power equipment used in performance of work under this contract. Equipment designed for brush mowing/cutting may improve success at the Tufti North unit.
