About this file

This document is a Memorandum for Record regarding a brand name only determination for an Immunohistochemistry (IHC) slide staining platform, antibody stains, reagents, and supplies for the Madigan Army Medical Center (MAMC) in Tacoma, WA.

The Medical Health Contracting Office - Pacific (MHCO-P) Joint Base Lewis-McChord Health Contracting Branch is issuing a new firm fixed-price requirement for these IHC products and services, with an estimated ordering period from October 1, 2024 to June 30, 2025. The total value is $216,810. Due to budgetary and operational constraints, MAMC can only use the Roche/Ventana Benchmark Ultra IHC platform, and all other reagents and supplies must be compatible with this brand. Market research indicates these are commercial items with adequate competition. The justification cites FAR 13.106-1(b) for the brand name only requirement, which will be redacted and posted with the solicitation since it exceeds $25,000. A follow-on multiple year contract will allow for any IHC platform that meets the requirements.

4. Authority:

FAR 13.106-1(b): For purchases not exceeding the simplified acquisition threshold (SAT), only one source reasonably available due to brand name requirements specified below.

5. Reasons for Authority Cited:

The leased Immunohistochemistry (IHC) and In-situ Hybridization (ISH) automated platforms needed for this requirement are two Roche/Ventana Benchmark Ultra units.

MAMC technicians and end users are currently only trained on the operation of this platform. Due to budgetary and operational constraints, MAMC is unable to support the re-training of the required users for an entirely new platform until fiscal year 2025.

Based on these constraints; only the specific brand name Roche/Ventana Benchmark Ultra units are able to support this requirement. In accordance with FAR 13.106-1(b)(ii), this brand name requirement only applies to the leased platform units. All other reagents, consumables, and associated testing supplies required can be fulfilled by any supplies that meet or exceed the minimum criteria of the solicitation and are compatible with the Roche/Ventana Benchmark Ultra platforms.
