About this file

This document is a federal contract clause template (FAR 52.209.3) establishing requirements for first article approval testing conducted by contractors.

The clause requires contractors to test unit(s) of specified lot/items and notify the Contracting Officer in writing at least 15 calendar days before testing begins to allow Government witness participation. Contractors must submit the first article test report within 90 calendar days from the contract date to RIA-JMTC, ATTN: TARA-PQI, Rock Island, IL 61299-6400. The Contracting Officer shall approve, conditionally approve, or disapprove the first article within 15 calendar days of receiving the report. If disapproved, the contractor must repeat tests at its own expense and make necessary modifications or select another first article. All costs related to testing, including additional tests following disapproval, are borne by the contractor. Failure to deliver the test report on time or disapproval of the first article constitutes a default under the contract. Before first article approval, contractors bear sole risk for acquiring materials or commencing production of the balance of the contract quantity; these costs are not allocable to progress payments or termination settlements if the contract is terminated for Government convenience. The Government may waive first article testing requirements for supplies identical or similar to those previously furnished and accepted. Two alternates are provided: Alternate I requires the contractor to produce both the first article and production quantity at the same facility; Alternate II permits the Contracting Officer to authorize pre-approval acquisition of specific materials or production to meet delivery schedules, with costs allocable only for the first article and authorized costs.
