Any information (classified or unclassified) pertaining to this contract shall not be released for public dissemination except as provided by the National Industrial Security Program Operating Manual (NISPOM) or unless it has been approved for public release by appropriate U.S. Government authority. Proposed public releases shall be submitted for review and approval prior to release to the appropriate government approval authority identified here with at least office and phone contact information and if available, an e-mail address. 13. SECURITY GUIDANCE
The security classification guidance for classified information needed for this effort is identified below. If any difficulty is encountered in applying this guidance or if any other contributing factor indicates a need for changes in this guidance, the contractor is authorized and encouraged to provide recommended changes; to challenge the guidance or the classification assigned to any information or material furnished or generated under this contract; and to submit any questions for interpretation of this guidance to the official identified below. Pending final decision, the information involved shall be handled and protected at the highest level of classification assigned or recommended.

Ref 10j: Controlled Unclassified Information (CUI) generated and/or provided under this contract shall be safeguarded and marked as specified in 32 CFR Part 2002, Controlled Unclassified Information and DoD 5200.48. DFARS Clause 252.204-7012 requires that contractors implement NIST SP 800-171 to protect systems and networks that process, store, or transmit “covered defense information” (as defined in the clause).
Ref 11a: Government agency or Contractor activity will provide security classification guidance for performance of this contract. Submit visit request to the KO and/or Security Management Office for need-to-know verification. Immediately report all incidents of derogatory information received which affect personnel security clearances, security compromises, security violations, classified spillage and any incident/situation should be report to Shanell M. Ringgold, 410.417.3474, shanell.m.ringgold.civ@mail.mil. Personnel working at the JPM Protection or any other government site shall have, prior to beginning on-site work, a clearance of SECRET or higher and will be subject to National Industrial Security Program Operating Procedures (NISPOM) security requirements.
Ref 11e. Contract is for Analyst, Engineering Technical, Logistical Support and Program Management service support with a need to access classified information. Actual knowledge of, generation, or production of classified information is required for performance of the contract. Cleared personnel are required to perform this service because access to classified information can not be precluded by escorting personnel. Any classification guidance needed will be provided to the contractor.”
Ref 11f. Contractor authorized to access classified information outside the U.S., Puerto Rico, U.S. Possessions and Trust Territories. Must follow local Government agency or cleared contractor facility requirements.
Ref 11g. Contractor is to be authorized use of DTIC services. DD Form 1540 and DD Form 2345 must be completed for registration with DTIC. (1) The sponsoring KO must submit DD Form 1540 “Registration for Scientific and Technical Information Services” to DTIC on behalf of the contractor. For subcontractors, the prime contractor submits the DD Form 1540 with the KO verifying the need-to-know. (2) The contractor may also submit DD Form 2345 “Militarily Critical Technical Data Agreement” (after registration with DTIC) to the Defense Logistics Services Center for access to unclassified, militarily critical technical data from other DoD sources. The KO must certify the need-to-know to DTIC.
Ref 11j: The contractor will follow the guidance for Controlled Unclassified Information, DoDI 5200.48 and Instructions for Developing Security Classification Guides, DoDM 5200.45 to implement policy, assign responsibilities, and provide procedures for the designation, marking, protection, and dissemination of controlled unclassified information (CUI). CUI mandatory training can be found at website: https://securityawareness.usalearning.gov/cui/index.html. Training is required within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee to the COR or to the contracting officer, if a COR is not assigned, within 30 calendar days after completion of training by all employees and subcontractor personnel. The Contractor shall submit certificates of completion for each affected Contractor and Sub- Contractor employee as an appendix to the monthly status report IAW ELIN A005 of the Contract Data Requirements List (CDRL), DD Form 1423. The contractor may disseminate CUI information to their employees and subcontractors that have a need-to-know. The contractor shall report the unauthorized disclosure of CUI to the COR.
Ref 11i: All contractors or prospective contractors must be properly vetted to verify their eligibility to receive contract technical data packages containing Controlled Unclassified Information (CUI), Controlled Technical Information (CTI), Critical Program Information (CPI), International Trade Arms Regulation (ITAR) and or Export Administration Regulation (EAR) information. Failure or inability to verify contractor eligibility for receipt of CUI,CTI, CPI, ITAR and or EAR information may be justification to deny access to contract technical data packages unless the following has been met:
1. The contractor must be organized and existing under the laws of any of the fifty States, the District of Columbia, or Puerto Rico, and be located in the U.S. or its territories.
2. The contractor must be registered in the System for Award Management (SAM) database.
3. The contractor must have a reputation for integrity and lawful conduct in its business dealings. The company and its Key Management Personnel must not be barred from participation in Government contracts.
4. The contractor must not be under FOCI or must have FOCI mitigated with appropriate State Department documentation.
Ref 11m: Mandatory Cyber Reporting: The contractor shall comply with the security requirements of the National Institute of Standards and Technology (NIST) SP 800-171, “Protecting Controlled Unclassified Information in Non-federal Information Systems and Organizations” and the Defense Federal Acquisition Regulation Supplement (DFARS) 252.204-7012, “Safeguarding Covered Defense Information and Cyber Reporting”. Cyber Reporting. Upon the detection or discovery of any unauthorized access, denial of service, or compromise of a contractor's classified or unclassified network, information system or data contained thereon, the contractor shall report in writing within 24 hours to the CBRN Information Resource Center (24 hour hotline): Commercial (309) 782-7349, Toll Free: 1 (800) 831-4408, Email: CBRN.IRC@mail.mil, SIPRNet Email: USARMY.CBRN.IRC@mail.smil.mil.
