About this file
This document is a Limited Source Justification for a brand name requirement for the purchase of 350 new, unlocked Apple iPhone 15 Pro model mobile devices in black titanium or natural titanium color, with no wireless service required. The anticipated award date is 15 August 2024, with delivery within 45 business days. This requirement is being solicited under FAR Part 12 and Part 13 procedures, and is set aside 100% for small businesses. The Army Contracting Command - New Jersey is the contracting activity, and the requirement is in support of the Department of the Army Criminal Investigation Division (DACID). Market research indicates that competition is limited to brand name iOS devices, with at least two sources expected to submit proposals through the SAM.gov portal. The justification cites the specialized law enforcement applications and secure environment required by DACID as the basis for the brand name restriction.

The anticipated award date is 15 August 2024 utilizing Fiscal Year (FY) 2024 Operations & Maintenance, Army (OMA) funds. The anticipated delivery date is 45 business days after the effective date of award. This requirement shall be solicited under a brand name restriction.
3. Description of Supplies/Services:
The DACID requires unlocked mobile devices, 350 each, Apple iPhone operating system (iOS) 15 Pro model, new, black titanium and/or natural titanium color. The requirement is hardware only; service is not required or requested. Unlocked mobile devices are required for the Department of the Army Criminal Investigation Division (DACID) units in the European Theater where different countries have different wireless providers. Service is not required as DACID provides SIM cards for the various European countries/regions/zones. The Spiral Three contract does not extend to OCONUS locations and does not cover hardware only procurements. The DACID special agent utilizes law enforcement related applications designed for use specifically with Apple iOS products. For example, the AT&T Enhanced Push-to-Talk (EPTT) app was specifically developed and optimized for iOS. The EPTT function is a walkie-talkie type service which allows agents to instantly reach law enforcement or emergency support personnel by eliminating the dialing and ringing steps in a regular cellular call.
Per AT&T, the iOS provides a secure environment that ensures communication remains protected and private. Additionally, the use of iOS results in faster performance, better battery life, and a more responsive user experience.
