1.0 BACKGROUND
1.1. Contractor support is needed to operate, maintain, test and provide p e r m i t - required reports for the waste water treatment plant at the Big Bend U.S. Army Reserve Center, RR1, Box 174, Big Bend, WV 26136- 9724.
1.2. The State of West Virginia has a National Pollutant Discharge Elimination System Water Pollution Control “Discharge of Sewage” Permit No. WV0103110, administered by the West Viriginia Department of Environmental Protection (WVDEP) effective November 1, 2015 to September 30, 2020 (Attachment 0002- Discharge of Sewage Permit).
1.3. The Big Bend USARC is registered with the WVDEP under this General Permit, and has been issued a siste-specific registration number, WVG550810. This permit regulates the operation and maintenance of a sewage disposal system or part thereof, for the direct discharge of treated sewage into the water of the State.
1.4. A contractor with at least a Class-S certificate for Wastewater Treatment Plant Operators issued by the State of West Virginia is needed for the operations and maintenance of the wastewater treatment plant to remain in compliance with this permit.
2.0 GENERAL REQUIREMENTS
2.1 Contractor shall furnish all labor, equipment, materials, supervision, transportation and technical guidance to operate, maintain, test and provide required reports for the waste water treatment plant at the Big Bend U.S. Army Reserve Center, RR1, Box 174, Big Bend, WV 26136-9724.
2.2 The Contractor is obligated to verify all specification requirements at his on-site visit before starting the project. No extra compensation shall be allowed for the contractor who does not attend the on-site visit and who does not appreciate the difficulty of the contract specifications. Any discrepancies or changes must be verified and confirmed in writing with the Regional Facilites Operations Specialist (RFOS).
2.3 The RFOS may inspect the work at any time during the contract period, and reserves the right to stop or terminate the contract if all work does not comply with the specifications provided. The presence or absence of the RFOS shall not relieve the Contractor from strict compliance with these plans and specifications.
2.4 The period of performance shall be for one 12-month base year and four twelve-month option years.
2.5 Unless otherwise specified, the Contractor shall perform the work between the working hours of 0730 and 1600 (7:30 AM - 4:00 PM), Monday through Friday, excluding legal holidays. NO EXCEPTIONS. Work on military training holidays only with prior coordination with Center Coordinator.
2.6 The Contractor shall be responsible for any damages caused by him or the subcontractors during the performance of this contract, and shall be required to reimburse the United States Government for the cost of any repairs resulting from those damages, or the Contractor/ Subcontractor shall make the necessary repairs to the satisfaction of the United States Government.
2.7 The Contractor shall be required to leave the job site in a safe and secure condition at the end of each workday.
2.8 The Contractor shall ensure compliance with all applicable Federal, State, and Local Municipal environmental regulations concerning the protection of land and water resources. The types and quantities of all hazardous materials brought to the job site shall be reported to the 99th RD DPW Regional Environmental Protection Specialist, Ms. Andrea Hannah, at andrea.l.hannah.ctr@mail.mil or (304) 545-6398.
2.9 Unless otherwise specified, all materials and/or equipment used in the performance of this contract shall be new and unused, and shall be in the original manufacturer's carton. All materials stored on the job site must be protected from the elements.
2.10 The government, at no cost to the Contractor, will provide electrical power and water required in the performance of this contract.
2.11 Prior to commencing any work, the Contractor shall submit a schedule of operations to the R F O S .
The schedule shall be subject to change in order that the Contractor's operations do not conflict or otherwise disrupt normal operations of the government in the facility involved.
2.12 The Contractor shall notify the RFOS a minimum of 72 hours prior to commencing work and prior to completing work on this contract.
2.13 All work shall be completed in the negotiated time frame.
2.14 Compliance with the provisions of this contract by subcontractors shall be the sole responsibility of the Contractor.
2.15 The Contractor must possess at least a Class S certificate for Wastewater Treatment Plant Operators issued by the State of West Virginia.
3.0 INSPECTION OF WORK
Technical surveillance of workmanship and inspection of materials for work being performed under this contract shall be the responsibility of the RFOS. This provision in no way authorizes anyone other than the Contracting Officer to commit the Government to changes in the terms of the contract.
3.1 The government reserves the right to undertake performance by Government forces or other Contractors, the same type of similar work as contracted for herein, as the Government deems necessary or desirable, and to do so will not breach or otherwise violate this contract.
4.0 SAFETY AND ACCIDENT PREVENTION
4.1 In performing work under this contract, the contractor shall

5.0 FIRE AND SAFETY REQUIREMENTS
5.1 The Contractor shall comply with all Federal, state, local and installation safety regulations, Engineer Manual, EM 385-1-1 (http://www.usace.army.mil/inet/usace-docs/eng-manuals/em385-1-1/toc.htm ) and all applicable OSHA Standards. Contact the 99th RRD Safety Office.
6.0 WORK PERFORMANCE
6.1 All work performed under this contract shall conform to the best practices of the trade or class of work involved and shall be executed in a careful and orderly manner by workmen skilled in their respective trades.
7.0 OCCUPANCY
7.1 The areas in which the work is to be done may be occupied during the performance of work under this contract. Other maintenance and repair may also be concurrently performed in the building. The Contractor shall not receive any additional compensation due to the conditions brought about by this occupancy and usage by the Government. It shall be the Contractor's responsibility to coordinate with the RFOS, and to schedule and perform his work in such a manner as to create the least possible interference with the conduct of normal activities within the areas. The Contractor shall not block more-than one access of the building at any time, nor shall he disrupt the existing parking arrangement at any of the building parking areas without prior coordination with the RFOS.
8.0 SUBMITTALS
8.1 The following shall be submitted by the Contractor to the Contracting Officer and 99th RD DPW:
a. INSPECITON LOGS: The contractor shall provide logs for all O&M and inspections onsite
9.0 SANITARY CONVENIENCES
9.1 The Contractor's personnel shall be permitted to use a toilet room at the building, subject to the regulations and control of the RFOS. The responsible contractor shall ensure that the toilet premises are maintained in a clean and sanitary condition on a daily basis.
10.0 DAMAGE
10.1 The Contractor shall be responsible to repair and/or replace any damage caused by the Contractor at the site, at no additional cost to the Government, and at the discretion of the Contracting Officer.
11.0 CONTRACTOR QUALITY CONTROL
11.1 In the event the Contractor utilizes the service of a commercial testing laboratory, the Contracting Officer reserves the right to check laboratory for West Virgiina Laboratory Accreditaton for compliance with the standards set forth in the contract specifications.
11.2 The contractor shall make sure that all precautions are taken to prevent contamination of laboratory samples taken as part of the work of this contract. The contractor shall identify these precautions in their Work Plan.
12.0 DEFINITIONS
12.1 Where the words "Special Contract Clauses" or "Special Clauses" appear in test provisions, the technical specifications, or on contract drawings, it shall be taken to mean "Special Contract Requirements".
12.2 Throughout this contract, the word "indicated'', "shown", or "specified" shall mean indicated, shown, or specified in the drawings and/or specified in the specifications.
12.3 Throughout this contract, the words "as directed" "inspected'', "selected", or "accepted" shall mean as directed, inspected, selected or accepted by the RFOS. The words, "approved" or "authorized" shall mean approved or authorized by the Contracting Officer. These definitions are provided as guidance for the contractor, and shall service as the governing interpretation when this language appears within the body of this contract and apparently conflicts with the above.
13.0 CONDUCT OF EMPLOYEES
13.1 The contractor is fully responsible for the performance and conduct of his employees at all times while on post performing under the contract. The Contractor shall not allow any employee to perform work under the contract while under the influence of alcohol, drugs or any other incapacitating agent. Military police and other law enforcement personnel on post have the right to deny entry to post or remove from post any contractor employee for misconduct, which endangers the health or safety of people or property or for reasons of security.
In addition, the Post Commander may bar an individual from entering the post under the authority of 18 U.S.C.
1382. Removal from post of a contractor employee in accordance with above shall not relieve the Contractor from the requirement to meet all of the terms and conditions of the contract.
14.0 SMOKING POLICY
14.1 Contractor employees will abide by the DOD Smoking Policy.
15.0 HOLD HARMLESS
15.1 The Government, it’s Officers and Agents will be free from liability for any negligence occasioned by the Contractor's operations, employees or equipment. In addition, the Contractor will reimburse the Government for any damage and/or loss that occurs as a result of the Contractor's negligent operations, employees or equipment.
15.2 The contractor shall hold the Government harmless against any liability imposed by a Federal, State, or Local regulatory agency, resulting from the negligent acts or willful misconduct of the contractor to include assessment of a civil or administrative penalty or fine.
16.0 APPLICABLE DOCUMENTS
16.1 West Virginia National Pollutant Discharge Elimination System Water Pollution Control General Permit # WV0103110, administered by the West Viriginia Department of Environmental Protection (WVDEP) effective November 1, 2015 to September 30, 2020 (Attachment 0002- Discharge of Sewage Permit). The site where work is to be performed has been issued WV/NPDES General Permit Registration Number WVG550810-Calhoun Co.

17.0 SECURITY
17.1 At all times during the performance of work within this facility, the Contractor and his or her employees shall remain cognizant of the security restrictions existing within the facility. The Contractor's employees shall ensure that any doors, windows or access panels which may have been opened for them during the course of the work period are secured at the end of the day.
18.0 INSPECTOR GENERAL'S (IG) AUTHORITY TO INSPECT CONTRACTORS
18.1 The Inspector General shall have access to the Contractor's facilities, employees, operations, and records at the site where work is being performed at all times to conduct inspections or for other purposes.
Where feasible, advance notification of an IG inspection or investigation will be provided to the Contractor by the Contracting Officer.
19.0 UTILITIES
19.1 The Contractor shall be permitted to use existing utilities at each building location when available, to the extent needed to accomplish work on a "no charge" basis.

21.0 TASKS
21.1 Schedule of Operations: The contractor shall provide a brief letter plan describing the proposed work schedule. The schedule shall be submitted to the 99th RD DPW RFOS for review, comment, and approval before beginning any activities. The schedule shall include:
21.1.1 A schedule of operations.
21.1.2 Identificaton any materials and/or equipment need to be stored onsite as well as where they will be stored. All materials and/or equipment shall be new and unused, and shall be in the original manufacturer's carton as well as protected from the elements.
21.1.3 Observations and decisions made about the sampling procedures during the site visit including who the Point of Contacts (POCs) are and what the site access procedure will be.
21.1.4 Filter cleaning procedures
21.1.5 Backwash and recirculation procedures
21.1.6 The criteria and methods for obtaining and analyzing the samples (i.e. laboratory analysis and holding times) and completing the required documents as per the state permit requirements.
21.1.7 Sampling methods and descriptions of techniques the contractor will use to prevent cross contamination.
21.1.8 The certified laboratory to be utilized for sampling.
21.1.9 Operation and maintenance techniques.
21.1.10 Inspection log management and storage.
21.1.11 Inspection forms.
21.2 Contractor shall provide all required operations, preventative maintenance, and testing for the waste water treatment plant at the U.S. Army Reserve Center, Big Bend, WV.
21.3 Weekly Inpsections
21.3.1 Contractor shall provide a weekly visual inspection of the system.
21.3.2 Contractor shall maintain a log, recording the date and time of each inspection of the system.
21.3.3 The contractor shall notify the Regional Facility Operations Specialist with 8 hours of the discovery of a system problem so necessary repairs can be made.
21.4 Monthly inspections
21.4.1 Contractor shall inspect the waste water treatment plant monthly.
21.4.2 Contractor shall maintain a log, recording the date and time of each inspection of the system.
21.4.3 Verify operation of recirculation pump,
21.4.4 Adjust recirculation cycle, as required,
21.4.5 Observe filter draining efficiency,
21.4.6 Check operation of recirculation valve,
21.4.7 Check chlorinator tablet supply and refill, if required,
21.4.8 Check effluent chlorine residual,
21.4.9 Check effluent pH,
21.4.10 Check de-chlorination tablet supply and refill, if required,
21.4.11 Check effluent dissolved oxygen,
21.4.12 Record all meter readings for cycle count elapsed time meter, and over ride counter,
21.4.13 Check re-circulating tank dissolved oxygen, pH, and
alkalinity,
21.4.14 Check and clean sand filters, as required.
21.5 Quarterly Inspections
21.5.1 Contractor shall inspect the waste water treatment plant quarterly.
21.5.2 Contractor shall maintain a log, recording the date and time of each inspection of the system.
21.5.3 Check the effluent filters in the septic tank,
21.5.4 Check the operation of the recirculating tank ball valve,
21.5.5 Flush the laterals in the system to ensure the orifices are clear.
21.6 Sludge Removal
21.6.1 Contractor shall maintain a log, recording the date and time of each inspection of the sludge.
21.6.2 Contractor shall check quantity of sludge annually in recirculation tank to determine if removal of sludge from the recirculation tank is necessary (depth of more than 12 inches).
21.6.3 Contractor shall check sludge volume in septic tank annually to determine if removal of the contents of the septic tanks is necessary (depth more than 12 inches).
21.6.4 If required, contractor shall remove the sludge from the recirculation tank and/or septic tank and record amount of sludge removed.
21.6.5 Contractor shall provide a copy of the record of the total amount of sludge removed and a record of the method of disposal to the Regional Facility Operations Specialist (RFOS) no later than November 15th, to allow timely submittal of the Sludge Management Report to WVDEP.
21.7 Clean Filter
21.7.1 Contractor shall clean the filter surfaces, as required. The contractcor shall expect to do this monthly at a minimum.
21.8 Supplies
21.8.1 Contractor shall provide all required supplies, i.e., chlorinator and de-chlorinator tablets and field testing equipment for the periodic maintenance of the waste water treatment plant.
21.9 Quartelry Compliance Testing
21.9.1 The contractor shall only utilize a laboratory certified for testing by the WVDEP. If the contractor changes certified laboratories at any time, the contractor shall notify the 99th RD within 3 calendar days, and the contractor shall provide notification to WVDEP, as required.
21.9.2 Contractor shall sample the system effluent from the waste water treatment plant, in accordance with the monitoring requirements identified in the current wastewater permit (see WV016 NPDES Permit Category III for testing requirements).
21.9.3 Collection of samples taken shall be recorded on a Chain of Custody Record, with the date and time of collection and date and time of each transfer of custody of the samples.
21.9.4 Results of field testing of samples shall be recorded and provided to the lab.
21.9.5 The contractor shall notify the 99th RD and RFOS within 24 hours when sample results come back with a non-compliance.
21.9.6 Results from monitoring shall be reported electronically each quarter on the WVDEP eDMR website.
21.9.7 The contractor shall ensure that all sampling is completed early in the monitoring period to ensure that DMR submission are completed on time.
21.9.8 The contractor shall complete the submission to the WVDEP eDMR website no later than the 25th of the following month.
21.9.9 The contractor shall notify the 99th RD upon completion of the submission.
21.9.10 The contractor shall send an electronic copy of the DMRs submission to the 99th RD
RFOS and REPS within 3 days of submission.
22.0 ANTITERRORISM (AT) AND OPERATIONS SECURITY (OPSEC)
23.1. AT LEVEL 1 TRAINING. This standard language is for contractor employees with an area of performance within an Army controlled installation, facility or area. All contractor employees, to include subcontractor employees, requiring access Army installations, facilities and controlled access areas shall complete AT Level I awareness training within 30 calendar days after contract start date or effective date of incorporation of this requirement into the contract, whichever is applicable. The contractor shall submit certificates of completion for each affected contractor employee and subcontractor employee, to the RFOS or to the contracting officer, if a RFOS is not assigned, within 5 calendar days after completion of training by all employees and subcontractor personnel.

23.2. ACCESS, GENERAL PROTECTION, AND SECURITY POLICY AND
PROCEDURES. Contractor and all associated sub-contractors employees shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements (FAR clause 52.204-9, Personal Identity Verification of Contractor Personnel) as directed by DOD, HQDA and/or local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in contractor security matters or processes.
23.2.1 For contractors that do not require CAC, but require access to a DoD facility or installation. Contractor and all associated sub-contractors employees shall comply with adjudication standards and procedures using the National Crime Information Center Interstate Identification Index (NCIC-III) and Terrorist Screening Database (TSDB) (Army Directive 2014- 05/AR 190-13), applicable installation, facility and area commander installation/facility access and local security policies and procedures (provided by government representative), or, at OCONUS locations, in accordance with status of forces agreements and other theater regulations.
23.3 iWATCH TRAINING. The contractor and all associated subcontractor employees shall brief all employees on the local iWATCH program (training standards are provided by RFOS. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the RFOS. This training shall be completed within 30 calendar days of contract award and with 30 calendar days of new employees commencing performance with the results reported to the RFOS not later than 5 calendar days after contract award.
23.4 OPSEC TRAINING. Per Army Regulation 530-1, Operations Security, new contractor employees must complete Level I OPSEC training within 30 calendar days of reporting for duty and annually thereafter.
23.5 Threat Awareness Reporting Program. For all contractors with security clearances. Per AR 381-12 Threat Awareness and Reporting Program (TARP), contractor employees must receive annual TARP training by a CI agent or other trainer as specified in 2-4b.
23.0 CONTRACTOR MANPOWER REPORTING (CMR)
The contractor shall report all contractor labor hours (including subcontractor labor hours) required for performance of services provided under this contract for the 99th RD via secure data collection site. The contractor is required to completely fill in all required data fields using the following address:

Reporting inputs will be for the labor executed during the period of performance during each Government fiscal year (FY), which runs October 1 through September 30. While inputs may be reported any time during the FY, all data shall be reported no later than October 31 of each calendar year, beginning with 2020.
