1. NOTICE DETAILS:

2. Maximizing Small Business Opportunities.
a. General Policy, FAR Subpart 19.201, “(a) It is the policy of the Government to provide maximum practicable opportunities in its acquisitions to small business, veteran-owned small business, service-disabled veteran-owned small business, HUBZone small business, small disadvantaged business, and women-owned small business concerns. Such concerns must also have the maximum practicable opportunity to participate as subcontractors in the contracts awarded by any executive agency, consistent with efficient contract performance.”
b. Class Deviation 2023-O0001 Verification of Eligibility of Small Business Joint Ventures

“A small business joint venture offeror must submit, with its offer, the representation required in paragraph (c) of FAR solicitation provision 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services, and paragraph (c) of FAR solicitation provision 52.219-1, Small Business Program Representations, in accordance with 52.204-8(d) and 52.212-3(b) for the following categories:
(A) Small business;
(B) (Service-disabled veteran-owned small business;
(C) Women-owned small business (WOSB) under the WOSB Program;
(D) Economically disadvantaged women-owned small business under the WOSB Program; or
(E) Historically underutilized business zone small business.
These procedures implement the final rule for FAR case 2017-019, Policy on Joint Ventures, published on September 23, 2022, at 87 FR 58219, and effective on October 28, 2022, which added new representations to paragraph (c) of FAR solicitation provisions 52.212-3 and 52.219-1 for small business joint ventures for the socioeconomic categories listed above.”
c. Teaming Arrangements with Small Business. In your response, please provide any teaming arrangements through the DoD Pilot Mentor -Protégé Program (DFARS Appendix I and FAR 19.301-1). Any responses involving teaming arrangements must delineate between the work that will be accomplished by the prime small business/ protege and the teaming partner/ mentor and a plan of action to not default if the mentor dissolves the agreement. The response must demonstrate that the small business will perform at least 40% of the manufacturing/ the work. Please submit the response and a copy of the Mentor-Protégé agreement with the quote if there is a teaming arrangement.
3. Contract Pricing Type: Firm-Fixed-Price (FFP) IAW FAR 16.202-1 Description.
A firm-fixed-price contract provides for a price that is not subject to any adjustment on the basis of the contractor’s cost experience in performing the contract. This contract type places upon the contractor maximum risk and full responsibility for all costs and resulting profit or loss. It provides maximum incentive for the contractor to control costs and perform effectively and imposes a minimum administrative burden upon the contracting parties.
Firm-Fixed Price terms does not allow for economic price adjustment after contract award.
4. Manufacturer shall build and test IAW the current TDP and AS9100. The DoD manufacturer shall build, test, and deliver serviceable quality F-16 spare parts by the required delivery times IAW the TDP attached to this requirement and higher level contract quality requirement AS9100. To meet the requirement, the DoD manufacturer is fully responsible for reviewing the entire TDP thoroughly before bidding on the requirement and identifying any discrepancies in a reasonable time to resolve the discrepancy in-order to bid on-time. The solicitation will not be extended due to late responses. No Economic Price Adjustment (EPA) is authorized for this requirement. By bidding on the requirement, the offeror certifies as a responsible DoD manufacturer that they are technical capable, have the financial resources, and have a complete TDP to deliver serviceable assets No Later Than (NLT) the required delivery times in SECTION B. **PLEASE NOTE: Any deviations to the TDP shall be approved only by the Design Authority (USAF)**
5. TDP Access: The Procurement Contracting Officer (PCO) is the point of contact for TDP access. The current and complete TDP is attached to SECTION J of the solicitation and the notice in SAM.gov as export controlled.
Only the data custodian on the active DD Form 2345, Military Critical Technical Data Agreement, is authorized to request access to the TDP and therefore, must be registered in SAM.gov for contracting opportunities. To find the TDP in SAM.gov, go to the bottom of the notice to “Attachments/Links”, and select the request access button. After requesting access, please e-mail the PCO at leslie.evans.1@us.af.mil and the Contract Specialist Brandon Moses at brandon.moses.1@us.af.mil to approve access to the TDP. 3 | 3 P a g e s can verify that the firm has an active DD Form 2345, Military Critical Technical Data Agreement, and that the data custodian is the one requesting access to the TDP. Contracting can only approve access to the TDP to the data custodian on the active DD Form 2345. The request must be for official business only - the interested party intends to submit a bid.
