Attachment 1: Contractor Responsibility Determination Questionnaire (To be completed by offeror and submitted with bid) Mandatory Minimum Standards to Receive DoD Contracts (Version 2, 6JUN2022)

IAW FAR 9.104-1 General standards. To be determined responsible, a prospective contractor must-

(a) Have adequate financial resources to perform the contract, or the ability to obtain them (see 9.104-3(a));

How is the offeror in compliance?

(b) Be able to comply with the proposed delivery schedule taking into consideration the current market conditions and all the existing and future commitments.

On-time delivery is a major acquisition problem in supporting our warfighters with A-10 spares on-time. In order to be a responsible DoD contractor the offeror must comply with their delivery schedules. How will the offeror ensure compliance to their proposed delivery schedule(s)? At the minimum, the offeror shall provide as part of the bid the milestone schedule for each proposed delivery times that demonstrates compliance. The milestone schedules is part of the proposal schedule and thus, shall be attached to SECTION J of the contract.

Current performance record(s) from Govt source(s) (ie..DCMA office/ Contractor Supplier Risk Report from the Supplier Performance Risk System (SPRS) via Procurement Integrated Enterprise Environment (PIEE.eb.mil).

(c) Have a satisfactory performance record (see 9.104-3 (b) and subpart 42.15). A prospective contractor shall not be determined responsible or nonresponsible solely on the basis of a lack of relevant performance history, except as provided in 9.104-2;

In order to evaluate if the offeror has satisfactory performance record the offer shall submit current performance record(s) from Govt source(s) (ie..DCMA office/ Contractor Supplier Risk Report from the Supplier Performance Risk System (SPRS) via Procurement Integrated Enterprise Environment (PIEE.eb.mil). If the manufacturer disagrees with Govt’s record the offeror should submit their own record for consideration for similar requirements by listing the problems encountered on the identified contracts and the corrective actions that resulted in complying with the proposed delivery schedule(s).

(d) Have a satisfactory record of integrity and business ethics (for example, see subpart 42.15). The offeror shall provide information to support compliance to this standard.

(e) Have the necessary organization, experience, accounting and operational controls, and technical skills, or the ability to obtain them (including, as appropriate, such elements as production control procedures, property control systems, quality assurance measures, and safety programs applicable to materials to be produced or services to be performed by the prospective contractor and subcontractors). (See 9.104-3(a).)

The offeror shall provide information to support compliance to this standard.

(f) Have the necessary production, construction, and technical equipment and facilities, or the ability to obtain them (see 9.104-3(a)) to deliver serviceable assets; and The offeror shall provide information to support compliance to this standard.

(g) Be otherwise qualified and eligible to receive an award under applicable laws and regulations (see also inverted domestic corporation prohibition at 9.108).

If the acquisition is set-aside to small businesses this includes complying with the limits of subcontracting (see FAR 19.602-1(a)). Please note the NMR class waiver for NAICS code 336413 only applies to Drones and Aircraft Launching equipment.

I, _____________ certify that I have reviewed and attest to meeting all the above standards in order to receive a DoD contract.
