About this file
This is a Sole Source Justification (SSJ) document for a U.S. Customs and Border Protection (CBP) order under the General Services Administration Schedule (GSA Schedule) program. Dated March 9, 2026, with PR Number 20156281, the justification supports awarding a sole source order to Ben Fitzgerald Real Estates DBA Rosemark, located at 100 Independence Place, Suite 222, Tyler, TX 75703, for continued preventative maintenance and repair services in the Southern California region. The order is valued at $1,240,943.29 on a firm-fixed-price basis for the period of March 9, 2026 through July 26, 2026.
The justification is issued under GSAR 538.7104-3(b)(1)(iii) as a logical follow-on to the original competitive Federal Supply Schedule order GS06Q17BQDS204. CBP determined that sole source award to the incumbent contractor is warranted in the interest of economy and efficiency to ensure continuity of mission-critical equipment and system sustainment, maintenance, and repair services at government facilities while a competitive follow-on procurement is underway. The previous order expired February 28, 2026, and this bridge action is limited to the minimum duration necessary to complete the competitive acquisition process without additional bridge actions anticipated. The order encompasses all labor, supervision, tools, materials, parts, equipment, transportation, licenses, permits, certifications, and management required for service delivery. The justification was approved by Technical Representative Allison M Krueger, Contracting Officer Ronie M Namata, and Competition Advocate Judith A Simpson.

Attachment 4 U.S. Customs and Border Protection Sole Source Justification (SSJ) –
RFO Subpart 8.4 and GSAR 538.7104-3 For orders or BPAs exceeding the Simplified Acquisition Threshold (SAT)
Version 2.0 November 2020
Date: March 9, 2026 PR Number: 20156281
This acquisition is conducted under the authority of the Multiple-Award Schedule Program, 41 U.S.C.
152(3), Competitive Procedures, and 40 U.S.C. 501, Services for Executive Agencies.
1. Agency and Contracting Activity.
The Department of Homeland Security (DHS), Customs and Border Protection, Office of Acquisition, proposes to award an order pursuant to GSAR 538.7104-3, Sole Source Justifications.
2. Nature and/or description of the action being approved.
CBP intends to limit the number of sources solicited pursuant to GSAR 538.7104-3 for the procurement of continued preventative maintenance and repair services in the Southern California region to Ben Fitzgerald Real Estates DBA Rosemark, 100 Independence Place, Suite 222, Tyler, TX 75703.
3. Description of Supplies/Services.
The proposed order will be firm-fixed-price with a total estimated value of $1,240,943.29 for a period of performance of March 9, 2026 – July 26, 2026. The previous order expired on February 28, 2026, and a competitive follow-on acquisition is in progress. This bridge action is required to ensure continuation of mission-critical services while the competitive follow-on procurement is completed. The period of performance has been limited to the minimum duration necessary to complete the competitive acquisition process.
This order provides all labor, supervision, tools, materials, parts, equipment, transportation, licenses, permits, certifications and management necessary to provide for equipment and system sustainment, maintenance and repairs at the government facilities in the Southern California Region.
4. Authority and supporting rationale.
This justification is prepared in accordance with GSAR 538.7104-3(b)(1)(iii): The order should be issued on a sole source basis in the interest of economy and efficiency because it is a logical follow-on to an FFS order already issued on a competitive basis.
An award will be made in the interest of economy and efficiency as a logical follow-on to an original Federal Supply Schedule order GS06Q17BQDS204 pursuant to GSAR 538.7104-3(b)(1)(iii). The original award was competitively solicited and awarded using the ordering procedures at GSAR
538.7103. It is necessary to limit competition for new work described herein as a logical follow-on because continuing performance with Rosemark will ensure continuity of services and avoid unnecessary duplication of costs and delays that could result from transitioning to another contractor.

No other source can assume performance during the limited bridge period without substantial duplication of cost to the Government and unacceptable delays in fulfilling the agency’s requirements.
The period of performance for this bridge action is limited to the minimum duration necessary to complete the competitive acquisition. No additional bridge actions are anticipated.
5. CBP intends to make this justification publicly available in accordance with GSAR 538.7104-3(b)(3).
6. Technical/Requirements Personnel Certification:
I certify that this requirement meets the Government’s minimum need and that the supporting data, which form a basis for the Sole Source Justification, are accurate and complete.
Technical Representative/COR Date
7. Contracting Officer Certification and/or Approval: * Pursuant to HSAM 3008.401-71(b)(1), I certify that the Sole Source Justification is accurate and complete to the best of my knowledge and belief, and legal sufficiency was obtained if required.
Contracting Officer Date
*Note: In accordance with HSAM 3008.401-71(b)(1) for proposed BPAs or orders with an estimated value exceeding the simplified acquisition threshold, but not exceeding $900,000, the ordering activity contracting officer’s certification that the justification is accurate and complete to the best of the ordering activity contracting officer’s knowledge and belief will serve as approval.
