This is a COMBINED SYNOPSIS/SOLICITATION for commercial items prepared in accordance with the information in FAR Subpart 12.6, using Simplified Acquisition Procedures under FAR Part 13, as supplemented with the additional information included in this notice.
This announcement constitutes the only solicitation; a written solicitation will not be issued. PAPER COPIES OF THIS SOLICITATION WILL NOT BE AVAILABLE. This combined synopsis/solicitation SHALL be posted on SAM.gov.
The RFQ number is N0060423Q4058. This solicitation documents and incorporates provisions and clauses in effect through FAC 2023-02/Effective Date 03-16-2023 and DFARS Publication Notice, 01 March 2023.
It is the responsibility of the contractor to be familiar with the applicable clauses and provisions. The clauses may be accessed in full text at these addresses: https://www.acquisition.gov/far/ and http://www.acq.osd.mil/dpap/dars/dfarspgi/current/index.html.
The NAICS code is 721110 (Hotels (except Casino Hotels) and Motels) and the Small Business Standard is $40.0 million. This requirement is unrestricted and will result in a Firm-Fixed-Price (FFP) purchase order (PO).
The Small Business Office concurs with the full and open acquisition strategy.
The NAVSUP Fleet Logistics Center, Pearl Harbor (FLCPH) Regional Contracting Office requests responses from qualified sources capable of providing:

Lodging Services in support of USINDOPACOM, Center of Excellence in Disaster Management and Humanitarian Assistance (CFE- DM). Services shall be provided in accordance with Performance Work Statement (PWS) contained herein.
Period of performance is 03 June 2023 -17 June 2023.

Submission Requirements:
At a minimum, the Quoter shall:
i. Submit the unit price and total extended price of contract line item number (CLIN) 0001.
ii. Include any additional discounts available to the Government.
Responsibility Determination: Quoters shall provide a completed copy of FAR 52.212-3 & Alt I (MAY 2022).
If your annual representations and certifications are current in the System for Award Management (SAM), complete only paragraph (b) by filling out “N/A”.
Quoters shall provide a completed copy of FAR 52.204-24 (NOV 2021). Complete the highlighted section in paragraph (d).
Quoters must be registered in the SAM database to be considered for award. Registration is free and can be completed on-line at http://www.sam.gov.
By submission of a quote, the contractor is affirmatively stating they take no exceptions to the PWS or any of the terms of the solicitation.
Basis of Award: The Government will award a purchase order resulting from this solicitation to the responsible Quoter whose quote conforming to the solicitation will be most advantageous to the Government. Quotes will be evaluated to determine technical acceptability and price fair and reasonableness.
To be deemed technically acceptable, the Quoter shall meet the solicitation requirements and demonstrate good probability of success in meeting the performance objectives as stated within the Performance Work Statement (PWS). A quotation is technically unacceptable if it fails to address the solicitation requirements or demonstrates a low probability of success in meeting the performance objectives as stated within the PWS.
Quoters are advised that the quotation meeting the solicitation requirements with the lowest price may not be selected for award if award to a higher priced Quoter is determined to be more advantageous to the Government.
However, the perceived benefits of the higher priced quotation must merit the additional price.

52.204-24 REPRESENTATION REGARDING CERTAIN TELECOMMUNICATIONS AND VIDEO
SURVEILLANCE SERVICES OR EQUIPMENT (NOV 2021)
The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services--Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications-Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
L. 115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub.
L. 115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
It [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services. The Offeror shall provide the additional disclosure information required at paragraph (e)(2) of this section if the Offeror responds "does" in paragraph (d)(2) of this section.
(e) Disclosures.
(1) Disclosure for the representation in paragraph (d)(1) of this provision. If the Offeror has responded "will" in the representation in paragraph (d)(1) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--
(A) The entity that produced the covered telecommunications equipment (include entity name, unique entity identifier, CAGE code, and whether the entity was the original equipment manufacturer (OEM) or a distributor, if known);
(B) A description of all covered telecommunications equipment offered (include brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); and
(C) Explanation of the proposed use of covered telecommunications equipment and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(ii) For covered services--
(A) If the service is related to item maintenance: A description of all covered telecommunications services offered (include on the item being maintained: Brand; model number, such as OEM number, manufacturer part number, or wholesaler number; and item description, as applicable); or
(B) If not associated with maintenance, the Product Service Code (PSC) of the service being provided; and explanation of the proposed use of covered telecommunications services and any factors relevant to determining if such use would be permissible under the prohibition in paragraph (b)(1) of this provision.
(2) Disclosure for the representation in paragraph (d)(2) of this provision. If the Offeror has responded "does" in the representation in paragraph (d)(2) of this provision, the Offeror shall provide the following information as part of the offer:
(i) For covered equipment--

(d) Comptroller General Examination of Record. The Contractor shall comply with the provisions of this paragraph (d) if this contract was awarded using other than sealed bid, is in excess of the simplified acquisition threshold, as defined in FAR 2.101, on the date of award of this contract, and does not contain the clause at 52.215-2, Audit and Records--Negotiation.
(1) The Comptroller General of the United States, or an authorized representative of the Comptroller General, shall have access to and right to examine any of the Contractor's directly pertinent records involving transactions related to this contract.
(2) The Contractor shall make available at its offices at all reasonable times the records, materials, and other evidence for examination, audit, or reproduction, until 3 years after final payment under this contract or for any shorter period specified in FAR Subpart 4.7, Contractor Records Retention, of the other clauses of this contract.
If this contract is completely or partially terminated, the records relating to the work terminated shall be made available for 3 years after any resulting final termination settlement. Records relating to appeals under the disputes clause or to litigation or the settlement of claims arising under or relating to this contract shall be made available until such appeals, litigation, or claims are finally resolved.
(3) As used in this clause, records include books, documents, accounting procedures and practices, and other data, regardless of type and regardless of form. This does not require the Contractor to create or maintain any record that the Contractor does not maintain in the ordinary course of business or pursuant to a provision of law.

(a) Definitions. As used in this clause—
“Department of Defense Activity Address Code (DoDAAC)” is a six position code that uniquely identifies a unit, activity, or organization.
“Document type” means the type of payment request or receiving report available for creation in Wide Area WorkFlow (WAWF).
“Local processing office (LPO)” is the office responsible for payment certification when payment certification is done external to the entitlement system.
“Payment request” and “receiving report” are defined in the clause at 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(b) Electronic invoicing. The WAWF system provides the method to electronically process vendor payment requests and receiving reports, as authorized by Defense Federal Acquisition Regulation Supplement (DFARS) 252.232-7003, Electronic Submission of Payment Requests and Receiving Reports.
(c) WAWF access. To access WAWF, the Contractor shall—
(1) Have a designated electronic business point of contact in the System for Award Management at https://www.sam.gov; and

CENTER FOR EXCELLENCE IN DISASTER MANAGEMENT
AND HUMANITARIAN ASSISTANCE (CFE-DM)
LODGING SERVICES
1.0 BACKGROUND
The Center for Excellence in Disaster Management and Humanitarian Assistance (CFE-DM) was established under Title 10 USC 182 and is a direct reporting unit of U.S. Indo-Pacific Command. As the U.S. Department of Defense’ premier international humanitarian assistance and disaster management organization, the CFE-DM’s mission is to enhance civil-military preparedness and response through collaborative partnerships, applied research, training and engagements. The Health Emergencies in Large Populations (H.E.L.P.) course is a multicultural and multidisciplinary learning experience created to enhance professionalism in humanitarian assistance programs conducted in emergency situations. Over the past 25 years, CFE-DM has assisted over 760 humanitarian, civilian, and military participants graduate from the HELP course.
2.0 SCOPE/OBJECTIVE
2.1 The CFE-DM requires commercial lodging and associated support services to house attendees of the annual HELP course. The contractor shall provide lodging accommodations for 32 occupants as detailed in this PWS.
2.1.1 All occupants must be able to access their lodging accommodations no later than 4:00 PM on arrive (check-in) day.
2.1.2 All occupants will vacate their accommodations no later than 11:00 AM on departure (check-out) day.
2.1.3 The Contractor shall provide a local point-of-contact (POC) for coordination purposes.
2.2 NON-PERSONAL SERVICES AND INHERENTLY GOVERNMENTAL FUNCTIONS
2.2.1 Services rendered under this contract shall be non-personal in accordance with Federal
Acquisition Regulation (FAR) 37.104. Contracted personnel are not subject, either by the contract’s terms or by manner or its administration, to the supervision and control usually prevailing in relationships between the Government and its employees.
Contractor personnel rendering services under this contract shall be under the direct supervision and control of the contractor.
2.2.2 The contractor shall not perform inherently governmental functions as prescribed under
FAR Subpart 7.5. Any performance objectives or other terms and conditions under this contract shall not be interpreted or implemented in any manner that may result in contractor personnel creating or modifying Federal policies, obligating funds of the government, or overseeing work of government employees or other contractor personnel.
3.0 PERFORMANCE REQUIREMENTS
3.1 LODGING. The Contractor shall provide commercial lodging accommodations and associated support services for up to 32 occupants.
3.1.1 All charges shall be based on the amount of nights stayed by each occupant within the period of performance of 03 June 2023 through 17 June 2023. Lodging services under this PWS are not to exceed 11:00 AM, 17 June 2023.
3.1.2 The Contractor shall coordinate all PWS-related hotel operations with its vendors.
3.1.3 The Contractor shall at a minimum meet the following criteria:
3.1.3.1 Central location is in Honolulu, HI for convenience and expediency when transporting personnel to HELP Workshop, which will also be located in Honolulu, HI.

3.1.12 Rooms shall have private toilet and bathing/showering facilities.

3.1.14 Rooms shall have a working telephone for incoming and outgoing local area calls at no cost to the occupants.
3.1.15 Room charges shall include Internet services, as well as 24-hour operator(s).
3.1.16 Rooms shall comply with all City, State and Federal environmental, health, and safety standards.
3.2 INCIDENTAL CHARGES: Individual participants shall be responsible for payment of any costs incurred for the room outside of lodging costs, such as room service, laundry service, long-distance calls or other charges. The Contractor shall separately track and charge any incidental costs for the room directly to the individual participant occupying the room. The Government will not incur any financial liability for incidental charges to an individual’s room.
3.3 ROOM RATES: The Contractor shall ensure the required rooms as outlined within this PWS are available for reservation at or below the maximum Government lodging rate prescribed in the Joint Travel Regulations (JTR).
3.4 BUS PASSENGER LOADING ZONE: The Contractor shall provide a passenger loading zone area at the lodging facility, where buses can pick up and drop off participants during the morning (7:00 AM through 7:30 AM) and afternoon (4:30 PM through 5:00 PM), Monday through Friday, from 03 June through 17 June 2023.
4.0 PERFORMANCE REQUIREMENTS

5.0 QUALITY CONTROL
5.1 The Contractor is responsible for implementing and maintaining a Quality Control Plan (QCP) to ensure that the services performed meets or exceeds contract requirements and results in the correction of potential and actual problems. The QCP shall be implemented on the first day of contract performance. In addition to the Contractor’s QCP, the Government will provide the Contractor with a copy of the Government’s Quality Assurance Surveillance Program (QASP).
Notwithstanding the Government’s QASP, the Contractor is not relieved from having their own QCP program to address quality issues during the contract award period.
5.2 The Government’s QASP will address what deliverables are identified for surveillance and the method and surveillance periodicity to ensure the quality of deliverables as outlined in this PWS.
The QASP addresses what will be reviewed and will outline actions to be taken by the Contractor, should review(s) and/or inspections identify areas requiring remedial action. Of special interest to the Government are performance standards or metrics that address productivity, completion times, customer satisfaction, and handling/safeguarding Privacy Act data.
6.0 PERIOD OF PERFORMANCE: Saturday, 03 June 2023 – Saturday, 17 June 2023
