SINGLE SOURCE DETERMINATION USING

SIMPLIFIED ACQUISITION PROCEDURES (SAP)

FOR AN ACTION NOT EXCEEDING THE SIMPLIFIED ACQUISITION THRESHOLD

(AUTHORITY: FAR 13.106-1(b)(1))

1. Agency and contracting activity. Department of Commerce, NOAA Acquisition and Grants Office (AGO), DPA Field Delegate

2. Description of supplies or services required to meet agency needs (including the estimated value). NOAA Fisheries National Appeals Office (NAO) requires ATS software (ATS) maintenance and support services to keep the ATS operational for continued use as NAO’s tool for tracking, reporting, and storing appeals and inquiries documents. The period of performance is from 2/23/2021 to 2/22/2022, with four option years. The contract type is firm-fixed price, and the total estimated contract value is , including all option years.

3. Identification of the single source or the brand name to be solicited.

4. Supporting rationale. Only one source or brand name is reasonably available as detailed below:

Exclusive Licensing Agreement/Restrictive Rights/Authorized Reseller –The source has one or more of the following: an established exclusive licensing agreement, proprietary data, limited rights in data, patent rights, OEM required certifications or OEM authorized reseller, copyrights or secret processes with regard to the supplies or services required.

The services covered under this request are a logical follow-on to an order issued under GS-35F-1092M, award number EA133F-16-NC-1058. However the Vendor will not renew it’s GSA contract therefore an Open Market firm-fixed price contract is being sought. The original order or BPA was placed in accordance with the applicable FSS ordering procedures.

The original order or BPA was not previously issued under sole-source or limited sources procedures.

In 2017, Fisheries cloned a module of the NOAA Chief Administrative Officer’s Audit Tracking System (ATS) to provide NOAA Fisheries with a Fisheries-specific tracking, reporting, and storage system for its appeals and inquiries case documents. ATS provides a modern, secure solution for tracking, reporting, and storing appeals and inquiries documents.

The NOAA Fisheries system is closed, and neither receives nor sends data to any other system.

NOAA systems run on a SureCode Application Server and employ the SureCode Application Framework (SAF) library, an exclusive application development library. PFS/Surecode ATS is proprietary and they do not have authorized resellers that can provide the required services to the NOAA ATS.

There are no other sources that can provide the services and the resulting contract will provide economy and efficiency.

5. Market Research Market research did not yield other viable vendors. Vendors either only provided maintenance and support to software they developed, or had no experience providing maintenance and support to ATS.

6. Technical/Requirements Representative Certification

I certify that this requirement constitutes the Government’s minimum needs and the supporting data provided herein is accurate and complete to the best of my knowledge and belief.

7. Determination I hereby determine that the circumstances of this action deem only one source is reasonably available.

This acquisition is conducted under the authority of the Multiple Award Schedule Program.

4. Authority and supporting rationale. The contracting officer has determined the following circumstance justifies limiting the source under FAR 8.405-6 and as supported below

Logical follow-on - FAR 8.405-6(a)(1)(i)(C) – In the interest of economy and efficiency, the new work is a logical follow-on to an original Federal Supply Schedule (FSS) order issued under GS-35F-1092M, award number EA133F-16-NC-1058. The original order or BPA was placed in accordance with the applicable FSS ordering procedures. The original order or BPA was not previously issued under sole-source or limited sources procedures.

The contract should be processed as a logical follow-on because it is for maintenance and support for the same software purchased from the same vendor in 2017. It is expected that limiting the source will provide economy and efficiency because 1) ATS is the vendor’s proprietary software, 2) the vendor developed and is experienced with ATS, 3) the vendor has previously provided ATS maintenance and support to NAO, and 4) market research did not indicate that there are other vendors experienced with ATS, or have experience providing ATS maintenance and support.

5. Market Research Market research did not yield other viable vendors. Vendors either only provided maintenance and support to software they developed, or had no experience providing maintenance and support to ATS.
