(End of addendum)
52.212-2 Evaluation - Commercial Items.
a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is determined to be the lowest price technically acceptable (LPTA) quotation with acceptable past performance.
Evaluation Factors:
1) FACTOR 1 – TECHNICAL CAPABILITY:
Sub-factor 1: Certifications
Sub-factor 2: Past Experience
2) FACTOR 2 – PRICE
3) FACTOR 3 – PAST PERFORMANCE
(b) Offerors will be evaluated on written documentation provided in accordance with paragraph (b)(2) of the Addendum to FAR 52.212-1, Instructions to Offerors - Commercial Items.
Technical acceptability is based on successfully meeting these requirements. The ratings applied to Technical
Capability will be "Acceptable" or "Unacceptable" as defined below:
RATING:
- Acceptable: DEFINITION: Quotation meets the minimum requirements of the solicitation.
- Unacceptable: DEFINITION: Quotation does not meet the minimum requirements of the solicitation.
***Offerors must have an "Acceptable" rating for TECHNICAL CAPABILITY - Past Experience to be considered for award.***
(1) Factor 1 - Technical Capability
Sub-factor 1: Certifications – Offerors shall submit with the quote a copy of:
a.) Disposal Certification (Entsorgungsfachbetrieb IAW KrQ-AbfG) certified according to Germany’s water law specialized certified company (Fachbetrieb) IAW WHG paragraph 62 and SwSV paragraph 62.
Offerors who fail to submit the above listed certificate are not eligible for award, regardless of price, technical and past experience and evaluations IAW FAR 52.212-1, Instructions to Offerors – Commercial Items.
***Failure to submit certifications will eliminate your quote from further evaluation and make your quote ineligible for contract award***
Sub-factor 2: Past Experience. This factor is met when the offeror provides proof of at least one (1) continuous year of contract performance entirely within the previous five (5) years from the issuance date of this solicitation, where the offeror is/was responsible for the performance of relevant Emergency Spill Cleanup of Hazardous Substances as defined in the PWS and IAW (b)(2)(i)(2) FAR 52.212-1, Instructions to Offerors - Commercial Items.
(2) Factor 2 - Price. The offer will be evaluated on the total price of all CLINs. Award will be made on an "ALL OR- NONE" basis. Failure to include a unit price and extended amount for each CLIN within the CLIN schedule of the solicitation may exclude the offeror from further consideration for award. Price is determined by multiplying the unit price by the estimated quantity of each CLIN. The Estimated Amounts of all CLINs for all Option Periods represent the total proposed price.
For the evaluation of the option price pursuant to FAR Clause 52.217-8, Option to Extend Services, 50% of the prices proposed for the last option period will be included in the Total Evaluated Price (TEP). The offeror's TEP will be calculated by adding the base period and all options, to include the option available under 52.217-8. Only EURO currency offers will be accepted. The TEP will be evaluated for fair and reasonableness IAW FAR 15.404-1. The Government reserves the right to obtain other than cost or pricing data if deemed necessary by the Contracting Officer.
The Government will rely on the unit price, as proposed by the offeror, multiplied by the estimated quantity to correct any apparent arithmetic discrepancies in the Estimate Amount for each CLIN. The totals calculated by resolution of the arithmetic discrepancies listed above will represent the Total Evaluated Price. These procedures will not be used if the Total Evaluated Price displaces the low offeror. Discussions may then be conducted.
(3) Factor 3 - Past Performance. Offerors must receive an "Acceptable" rating to receive an award. This rating is based on recent and relevant present and past performance information. The following ratings will be applied:
RATING:
- Acceptable: DEFINITION: Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown. (See note below.)
- Unacceptable: DEFINITION: Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or "neutral") past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered "Acceptable."
Past Performance information may be obtained, but not limited to, the following sources:
a. Past Performance Questionnaires (PPQs)
b. Past Performance Information available from other sources such as, but not limited to, the Contractor Performance Assessment Reporting System (CPARS) rating. When a completed PPQ is inconsistent with the CPARS rating, the CPARS will take precedence.
The standard for an "Acceptable" past performance rating is met when recent and relevant past performance information as defined in the Addendum to FAR 52.212-1, submitted by the offeror and/or the information found by the Government is evaluated indicating successful performance history.
Exceptional, Good, and Satisfactory performance as indicated on the PPQ, CPARs or obtained from any other source deemed necessary by the Government will receive an "Acceptable" rating.
(4) Award Process. The Government intends to award to the responsible offeror submitting the Lowest Price Technically Acceptable (LPTA) offer in accordance with the Federal Acquisition Regulation (FAR) Parts 12 and 13.5 that satisfies all terms and conditions of the solicitation. Offers will be evaluated for acceptability, but not ranked using the non-cost factors/subfactors. All non-cost factors and subfactors will be rated as either acceptable or unacceptable. In order to be considered for award, there must be an acceptable rating in every non-price factor/subfactor. In other words, a rating of unacceptable for any factor or subfactor will result in the entire offer being rated unacceptable. The evaluation process is as follows:
1. The Government will rank the offerors from lowest to highest total evaluated price.
2. Next, a technical and past performance evaluation will be performed beginning with the lowest priced offerors. Evaluations will stop when two technically acceptable quotes receive an acceptable past performance rating for price comparison purposes. Only those offerors determined to be technically acceptable with an acceptable past performance rating, either initially or as a result of discussions, will be considered for award.
3. A fair and reasonable determination will be made for the lowest-priced, technically acceptable Quotation with acceptable past performance.
(5) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s). NOTE: Pricing for the option periods will be evaluated for use under Federal Acquisition Regulation clauses 52.217-8 and 52.217-9. For the evaluation of the option price pursuant to FAR Clause 52.217-8, Option to Extend Services, 50% of the prices proposed for the last option period will be included in the Total Evaluated Price (TEP).
(6) Notice of Award. A written notice of award or acceptance of a quote will mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the quote. IAW FAR 13.005 acceptance can be in writing or upon start of performance.

Have, have not, within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,500 for which the liability remains unsatisfied.
(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples. (A) The taxpayer has received a statutory notice of deficiency, under I.R.C. ?6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. ?6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(C) The taxpayer has entered into an installment agreement pursuant to I.R.C. ?6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(D) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. ?362 (the Bankruptcy Code).
