STATEMENT OF WORK (SOW) FOR
OFFICE TRAILER JTFN (EL PASO, TX)
PART 1 GENERAL INFORMATION
1. GENERAL: This is a non-personal service contract under which the personnel rendering the services are not subject, either by the contract’s terms or by the manner of its administration, to the supervision and control usually prevailing in relationships between the Government and its employees. The United States (U.S.) Government shall not exercise supervision or control over the Contractor’s employees performing the tasks herein. Such contract employees shall be accountable solely to the Contractor who, in turn shall be responsible to the U.S. Government.
1.1 Description of Services: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to provide an office trailer to include utility hook up as defined in this SOW. The Contractor shall perform to the standards in this contract.
1.2 Objectives: The Contractor shall provide an office trailer to include hook up to water, sewer, electrical, and furnished with 35 workstations (desks) and 35 chairs, as defined in Part 5 of this SOW. The trailer shall have one male and female latrine. The Contractor shall install the trailer and remove it at the end of the period of performance.
1.3 General Information:
1.3.1 Recognized Holidays: Contractor is not required to perform services on holidays.

1.3.2 Hours of Operation: The Contractor is responsible for conducting business between the hours of 7:30 AM to 4:30 PM Monday through Friday, except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings. The Contractor must, at all times, maintain an adequate workforce for the uninterrupted performance of all tasks defined within this SOW when the Government facility is not closed for the above reasons.
1.3.3 Place of Performance: The work to be performed under this contract will be performed at Fort Bliss in El Paso TX. Attachment 1.1 – Site Map contains location specifics.
1.3.4 Type of Contract: The Government anticipates the award of a firm-fixed price contract.
1.3.5 Access and General Protection Policy and Procedures:
1.3.5.1 FPCON: The current Force Protection Condition (FPCON) is Bravo. FPCON’s are subject to change.
1.3.5.2 HPCON: The current Health Protection Condition (HPCON) is Alpha. HPCON’s are subject to change.
1.3.5.3 Physical Security: N/A
1.3.5.4 Escorts: A Government representative from JTFN will escort the Contractor to the site.
1.3.5.5 Personnel Security Clearance Requirements: Contractor employees shall have a valid government ID present when entering Fort Bliss. Contractor vehicles/trailers are subject to inspection prior to entering the installation.
1.3.5.6 Background Checks: Contractor shall send the Contracting Officer and Contract Specialist the Names, Driver’s License #, State of Issue, Company Name, Company Address, and dates needing installation access. A memo shall be provided to each individual requiring access. Individuals shall take this memo to the Chaffee Visitor’s Center (2527 Chaffee Rd, Fort Bliss, TX 79916). At the Visitor’s Center, individuals will be ran through the NCIC (National Crime Information Center) and TLETS (Texas Law Enforcement Telecommunications System) databases for criminal history checks. Once completed an installation access pass will be issued.

1.3.7 Key Personnel: The following personnel are considered key personnel by the Government: Callie Spencer, Contracting Officer (KO) and Erik Montgomery, Contract Specialist. The Contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate, who shall act for the Contractor when the manager is absent, shall be designated in writing to the KO, Contract Manager, and alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract.

1.3.10 Non-Disclosure Requirements: Performance under this contract may require the Contractor to access data and information proprietary to a Government agency, another Government Contractor, or of such nature that its dissemination or use other than as specified in this work statement would be adverse to the interests of the Government or others. Neither the Contractor, nor Contractor personnel, shall divulge, nor release data or information developed, or obtained under performance of this work statement, except to authorize Government personnel or upon written approval of the KO. The Contractor shall not use, disclose, or reproduce proprietary data, which bears a restrictive legend, other than as specified in this SOW. All documentation showing individual names or other personal information shall apply and shall be controlled and protected under the provisions of the Privacy Act of 1974, Public Law 93-579, 5 United States Code (U.S.C.) Section 552ad.
1.3.10.1 Non-Disclosure Statements: Reserved
1.3.10.2 Advertisement and Social Media: The Contractor shall NOT post information to public website or social media locations, personal or professional, that in any way disclose names, locations, hotel data, participants, discussions, pictures, etc. before, during or after the contract period of performance without the express consent of the Government. The use of propaganda violates DOD Commercial Use of Imagery Guidelines stated at (http://www.defenseimagery.mil/products/DODimagery/commercialuse.html). The Contractor shall not cite any information (e.g., contract information, pictures, locations, etc.) obtained through this contract on any marketing tools to include its company website.
1.3.10.3 Information Assurance: At no time will the Contractor or associated sub-contractor employees transmit government documents or information over using methods that do not meet the security requirements specified in the National Institute of Standards and Technology (NIST) Special Publication (SP) 800-171, "Protecting Controlled Unclassified Information in Nonfederal Information Systems and Organizations" such as personal electronic mail accounts, public digital data storage sites (cloud storage), social media platforms or instant messaging. Approved government sites such as U.S. Army Aviation and Missile Research Development and Engineering Center (ARMDEC) Safe Exchange at https://safe.amrdec.army.mil/SAFE/About.aspx, or All Partners Access Network (APAN) at https://community.apan.org/, or other transmission means determined by the Government must be used.
1.3.10.4 Organizational Conflict of Interest (OCI): Contractor and subcontractor personnel performing work under this contract may receive, have access to, or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the KO immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the KO to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the KO and in the event the KO unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the KO may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

2. DEFINITIONS AND ACRONYMS:
2.1. Definitions:
2.1.1. Contractor. The total contractor organization or a separate entity of it; such as an affiliate, division, or plant that performs its own purchasing.
2.1.2. Contracting Officer (KO). A person with the authority to enter into, administer, and/or terminate contracts and make related determinations and findings.
2.1.3. Key Personnel. Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the SOW. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.4. Physical Security. Protection of the perimeter area, government property, and assets that prevent the loss or damage of Government property.
2.1.5. Shall. An imperative command; has a duty to or is required to. Denotes that a regulation must be followed unless the contracting officer has obtained a deviation.
2.1.6. Subcontractor. Any supplier, distributor, vendor, or firm that furnishes supplies or services to or for a prime contractor or another subcontractor.

CONTRACTOR FURNISHED FACILITIES AND EQUIPMENT
3.1 Contractor Furnished Facilities and Equipment – General
3.1.1. The Contractor shall procure material, equipment, and supplies, which are incidental to the provision of services of this SOW. The Contractor shall ensure on-site maintenance personnel are equipped with proper individual / hand tools for the effort to be completed (i.e. general mechanics tools). The Government will not provide individual tools to be used by maintenance personnel under this effort. Each employee mechanic must have their own tools. The Government has revoked its assumption of risk regarding individual tools used under this effort. At no time will the Government be responsible for the replacement of lost, damaged, or broken individual tools.
3.1.2. The Contractor shall furnish everything needed to perform this contract according to all its terms and conditions.
3.1.3. Contractor-furnished equipment or items, inoperable or unserviceable for any reason, must be removed from the U.S. Government’s Installation within ten (10) business days after failure. The condition of contractor-furnished equipment shall not relieve the contractor of responsibility to provide services as required in this contract. The contractor shall immediately notify the KO, in writing, of circumstances regarding delay of work due to equipment or material problems.
3.1.4. The Contractor shall furnish additional telephone and peripheral equipment requirements not furnished by the U.S. Government, if required. All additional costs must be approved in writing by the KO prior to the items being placed in service.
3.1.5. All Contractor furnished vehicles shall be maintained in a neat, presentable, and operational condition and shall meet Government safety inspection standards. The Contractor’s vehicles not meeting standards shall not be operated or stored on U.S. Government installations. The Contractor shall provide a sign on the right and left side of contractor furnished vehicles with the Contractor's company name and telephone number.
3.2. Materials and Equipment
3.2.1. The Contractor shall use the equipment type and size suitable for the required operation and shall operate the equipment from existing Government-furnished electrical power sources. The Contractor shall affix a highly visible, permanent contractor’s nameplate on all contractor-owned equipment. The Contractor shall ensure that if commingling of U.S. Government and contractor-furnished equipment occurs, each set of equipment is easily identifiable and can be separated for inspection and inventory as required.
3.2.2. The Contractor shall maintain a sufficient quantity of on-hand materials and supplies to perform all work required under this Contract. Failure on the part of the Contractor to provide sufficient quantities and quality of supplies and materials within the specifications of the Contract shall not be cause for reduction in any service or performance. The Contractor shall maintain stocks to ensure continuous operation of critical systems as approved by the KO. Critical systems are those that are directly related to health care, safety, and mission accomplishment. The Contractor shall provide a system for rapid procurement of items whose usage levels do not require maintenance of on-hand stocks. This system shall include a list of vendors for each such mission-critical repair item, information on availability, and expected delivery times.
PART 4 SPECIFIC TASKS
4. Specific Tasks:
4.1. Basic Services. The Contractor shall provide an office trailer to include installation, electrical hookup, water hookup, and sewer hookups, as well as removal of the trailer at the end of performance.
4.2. Office Trailer Furniture: The trailer shall be furnished with 35 standard workstations (desks), 4 feet by 2 feet minimum, any color, composite wood, new or used, undamaged, and in good working condition. The trailer shall be furnished with 35 standard office chairs, black, mid-back, mesh or fabric, with wheels, new or used, undamaged, and in good working condition. No partitions are required for the 35 workstations. No individual offices, conference rooms, or waiting areas, required.
4.3. Office Trailer: The following minimum criteria shall be met at the time of the acceptance inspection:
4.3.1 Materials: The Contractor shall provide materials to support the installation.
4.3.2 Equipment: The Contractor shall provide equipment to support the requirements of this contract, to include, but not limited to: personal protective equipment, support trucks and equipment.
4.3.3 Spills: The Contractor is responsible for all spills and cleanup. The Contractor shall execute due diligence in the prevention of spills. Any and all spills, regardless of size, shall be reported to the applicable Environmental Division.
4.3.4 Upon notification, the Environmental Division will determine what, if any, further action needs to be taken. Cleanup of all spills caused by the Contractor will be done in accordance with (IAW) Federal, State and Local laws and Environmental Division guidance. Furthermore, this is the responsibility of the Contractor at no cost to the Government. The Contractor shall ensure all employees are knowledgeable on spill prevention procedures and capable of following required spill plans.
4.3.5 Dumps: The Contractor is responsible for dumping all sewer at their own expense IAW State laws.
4.3.6 Permits: The Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits and for complying with any Federal, State, and municipal laws, codes, and regulations applicable to the performance of the work.
4.3.7 Maintenance: The Contractor shall perform preventative maintenance on the trailer if required to ensure serviceability, such as AC filter changes, lightbulbs, etc. The contractor shall also repair any items or equipment that fail/break.
4.3.8 Fire Alarms: The contractor shall install fire alarms IAW UFC 3-600-01 (8 Aug 2016) NFPA 70-National Electrical Code, NFPA 72- National Fire Alarm Code and AR 420–1 Chapter 25. The fire alarm system shall be an Integrated Radio Transceiver and Fire Alarm Control Panel for narrowband D-21 capabilities (167.5250 MHz, serial number AR 182427) with BTX Interface BTX with Fire and Relay Cards. A heat detector shall be installed above the fire alarm panel instead of the standard smoke detector. Manual pull stations shall be of metal construction, dual action and key operable. The Fire Alarm System wiring shall be Class “A”, Style 6 for “DEVICES” and Class A, Style “Z” for “HORN/STROBES. Comply with NFPA 90- Installation of Air Conditioning and Ventilating Systems, ensure any unit with airflow greater than 2000 cfm is required to have duct smoke detection.
4.3.9 Emergency/Exit Fixtures: Emergency/Exit Fixtures shall meet NEPA 101 standards. Exit signs and battery-backed-up emergency light fixtures shall be LED. Locate exit signs and battery-backed-up emergency light fixtures per NFPA-101and NFPA 70 National Electrical Code. Exit Signs with a brown-out sensitive circuit to activate the battery when the input voltage falls below normal levels. Emergency run time must be a minimum of one and a half hours. Panic hardware push pad rim exit devices shall be installed at all facility egress doors.
4.3.10 Safety: The trailer shall be at least 1750 square feet in size to accommodate the 35 desks at 50 square feet per desk. The trailer shall be no less than 30 feet away from any covered structure for fire hazard safety and IAW Life Safety Code requirements.
4.4. Office Trailer Serviceable Unit Standards:
4.4.1 The trailer shall be in serviceable condition; roof, sides, and floors shall be free of leaks, cracks and holes.
4.4.2 The trailer shall have one male and one female latrine.
4.4.3 Trailer shall be able to withstand wind velocity in accordance with local wind code and may be anchored to ensure personnel safety and prevention of tipping over.
4.4.4 The Government is responsible for providing soap, paper towels, toilet paper. The Government is responsible for cleaning the latrines.
4.4.5 Emergency Services: The Contractor shall have twenty-four (24) hours to be on site for emergency repairs after notification is received.
4.4.6 Services outside normal duty hours are considered emergency services and are to be distinguished from routine services. Emergency services will be authorized by the KO prior to performance.
