PERFORMANCE WORK STATEMENT (PWS)
International Waste Disposal
1 December 2024
1. GENERAL This is a non-personal services contract to provide regulated non-hazardous waste disposal services to the 43rd Air Mobility Squadron (AMS), Fort Liberty, Pope Army Airfield, NC.
1.1. Description of Services/Introduction: The Contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items necessary to perform regulated non-hazardous waste disposal services as defined in this Performance Work Statement (PWS), except for those items specified as government furnished property and services. The Contractor shall perform in accordance with (IAW) the terms and conditions of the contract and consistently with the established standards in this PWS. The goal of this contract requirement is to provide disposal of all international airplane waste arriving to Pope Army Airfield, NC IAW all existing Local, State, and Federal (specifically United States Department of Agriculture) regulations and guidelines.
1.2. Background: Non-Hazardous international waste (not including human waste) is currently being accumulated and stored by 43 AMS Fleet Services, located at Pope Army Airfield, NC. 43 AMS does not have the required equipment or facilities to properly dispose of regulated international waste.
1.3. Objectives: The basic service objective includes the following:
1.3.1. The Contractor shall provide scheduled pick-up services of the accumulated regulated non-hazardous waste IAW PWS Part 2.
1.3.2. The Contractor shall provide Non-Hazardous waste disposal and incineration services in accordance with all existing Local, State and Federal (specifically United States Department of Agriculture) regulations and guidelines IAW PWS Part 2.
1.3.3. Contractor shall provide Proof of Incineration to the Customer that the Picked-Up Waste has been disposed properly at the Contractor’s facility IAW PWS Part 2.
1.4. Scope: The Contractor shall provide all required supplies and services necessary for the pickup and disposal of regulated non-hazardous waste accumulated by 43 AMS located at Fort Liberty, Pope Army Airfield, NC.
1.5. Quality Control/Assurance:
1.5.1. Quality Control: Quality Control is the responsibility of the Contractor. The Contractor is responsible for the delivery of quality services/supplies to the Government IAW the requirements of this
PWS.
1.5.2. Quality Assurance: The COR will evaluate the Contractor’s performance under this contract in accordance with FAR Clause 52.212-4 ‘Contract Terms and Conditions – Commercial Items’, paragraph
(a) Inspection and Acceptance.
1.6 Schedule and Holidays
1.6.1. Recognized Federal Holidays: The Contractor shall not be required to perform services on recognized federal holidays. The recognized federal holidays include:

1.6.2. When a holiday occurs on a Saturday, Federal employees are normally granted the previous Friday as the holiday observance. When a holiday occurs on a Sunday, Federal employees are normally granted the following Monday as the holiday. The Contractor shall work on the days the Government is scheduled to work.
1.6.3. When an unforeseen installation closure occurs on a regularly scheduled day of work, the Contractor will have the following options: Reschedule the work so it is performed the following day unless the following day falls on a weekend or reschedule the work on any day that is mutually satisfactory.
1.6.4. Hours of Operation: The Contractor shall be responsible for providing services, between the hours of 8:00 AM to 5:00 PM Monday, Wednesday, and Friday, except federal holidays or when the government facility is closed due to local or national emergencies, administrative closings or similar government directed facility closings. The Contractor shall at all times maintain an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the government facility is not closed for the above reasons.
1.7. Place of Performance: Contractor shall have routine access to Building #W1551 on Pope Army Airfield, NC. Incineration will be conducted at a capable facility available to the Contractor.
1.8. General / Special Qualifications.
1.8.1. The Contractor shall have and maintain current compliance agreement issued by the Department of Homeland Security (DHS) and Customs and Border Protection (CBH) throughout the entire duration of the Contract’s anticipated Period of Performance.
1.8.2. Contractor personnel performing work under this contract shall be able to read, write, speak, and understand the English language to effectively carry out all contract requirements. They shall have a command of both the written and spoken English language to properly, clearly, and effectively communicate in person or via electronic devices (telephone or e-mail) with Government personnel.
1.8.3. Contractor personnel performing work under this contract shall be U.S. citizens unless the provisions of Army Regulation 25-2, Information Assurance, have been fully completed and approval has been granted by the Government for the non-U.S. citizen to perform the required support.
1.8.4. Access and General Protection/Security Policy and Procedures: All Contractor personnel performing work under this contract shall comply with applicable installation, facility and area commander installation/facility access, local security policies and security procedures provided by the
Security Manager Government representative. Contractor personnel shall provide all information required for background checks to meet installation access requirements to be accomplished by the installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor personnel shall comply with all personal identity verification requirements as directed by Department of Defense (DoD), HQ Department of Army (DA) or local policies. In addition to the changes otherwise authorized by this contract, should the Force Protection Condition (FPCON) at any individual facility or installation change, the Government may require changes in Contractor and subcontractor security matters or processes.
1.8.5. Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity. The Contracting Officer and/or COR may meet periodically with the Contractor to review the Contractor's performance. At these meetings the Contracting Officer and/or COR will apprise the Contractor of how the Government views the Contractor's performance and the Contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the Government.
1.9. Contracting Officer Representative (COR): The COR will be identified by separate letter of appointment. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: Assures that the Contractor performs the technical requirements of the contract; performs inspections necessary in connection with contract performance; maintains written and oral communications with the Contractor concerning technical aspects of the contract; issues written interpretations of technical requirements, including government drawings, designs, specifications; monitors Contractor's Performance and notifies both the Contracting Officer and Contractor of any deficiencies; coordinates availability of government furnished property, and provides site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting contract.
1.10. Key Personnel: The Contractor shall provide a Project Manager (PM) who shall be responsible for the performance of the work under this contract. The name of this person, and an Alternate PM (APM), who shall act for the Contractor when the PM is absent, shall be designated in writing to the Contracting Officer at the post award conference. The PM or APM shall have full authority to act for the Contractor on all contract matters relating to daily operation of this contract. The PM or APM shall be available between the hours of 8:00 AM to 5:00 PM, Monday through Friday, except federal holidays or when the government facility is closed for administrative reasons.
1.11. The Contractor shall develop, maintain and provide to the COR an updated roster which shall include names and positions of all Contractor personnel as well as indicating which employees were issued CAC or other forms of government identification cards. The Contractor shall submit initial roster to the COR within 10 calendar days after commencement of base period of performance.
1.12. Contractor Personnel Appearance and Performance: It is essential that all Contractor personnel meet the highest standards of professionalism and personal integrity. The Contractor shall ensure their personnel do not perform work under the influence of alcohol, illegal prescribed drugs or any other incapacitating agents.
PART 2
SPECIFIC TASKS
2. SPECIFIC TASKS: All requirements identified in this Part 2 are Mission Essential Contractor Services that support mission essential functions.
2.1. The Contractor shall provide scheduled pick-up services of the accumulated regulated non- hazardous waste.
2.1.1. Scheduled pick-up services shall be every Monday, Wednesday, and Friday. The Pick-up location shall be at: Building W1551, Pope Army Airfield, NC. Government will provide required escort to access Building W1551.
2.1.2. Contractor shall provide customer with receipt of pickup. The receipt shall include date, company information – receipt number, company name, phone number, name of company representative picking up waste, contract number, and number of trash bags collected.
2.1.3. Contractor shall provide at least twenty (20) 150-gallon tote containers to store international waste between pickups. Each tote shall be marked “Regulated Garbage Only”. The contractor shall call the Passenger and Fleet Services (TROP) dispatch office at 910-394-7739 prior to pick-up to determine how many full bins are on hand. This requirement enables the contractor to determine how many empty leak proof totes to bring for swap out to ensure the facility maintains twenty (20) empty totes.
2.2 The Contractor shall provide Non-Hazardous waste disposal and incineration services in accordance with all existing Local, State and Federal (specifically United States Department of Agriculture) regulations and guidelines
2.2.1. The Contractor must receive approval from the United States Department of Agriculture (USDA) and Animal and Plant Inspection Service (APHIS) to handle and haul regulated garbage.
2.2.2 The Contractor must also receive approval from the United States Customs and Border Protection (CBP) to handle and haul regulated garbage.
2.3. Contractor shall provide Proof of Incineration to the Customer that the Picked-Up waste has been disposed properly at the Contractor’s facility
2.3.1. Proof of Incineration. The Contractor shall provide the COR proof of incineration within 30- days of pick-up via e-mail or US Postal Service. The proof of incineration shall reference the pick-up receipt number and date, and quantity of bags incinerated.
2.3.2. Non-hazardous of regulated waste shall be incinerated at the Contractor’s facility.
