The Government shall not be responsible for any damage that occurs to the First Article(s) during evaluation, such as (but not limited to) ISTA testing/evaluation.
Failure to successfully deliver (in a timely manner) an acceptable First Article within the terms of the executed De-livery Order can be used a basis for contract termination.
9. Quality Assurance Inspections
The Government shall, at their discretion, conduct Quality Control or “Pre-shipment” inspection of the End Item(s) supplied after First Article Acceptance in performance of this SOW. The Contractor shall coordinate with a desig-nated Government representative to conduct a “Pre-Shipment” Inspection before any shipments are made to the Government. Inspections will occur at the Contractor’s factory or integration facilities immediately prior to ship-ment. Contractor shall provide a completed DD Form 250 to the Government representative prior to this inspec-tion. The inspection usually consists of a sampling from the order ready for shipment. Sample size is at the discre-tion of the Government. Process normally entails visual inspection and may include brief operational testing. Ade-quate space and resources shall be made available by the Contractor to accomplish inspection(s).
In instances where on-site inspection is impractical or not possible, the Contractor shall provide required photo-graphic evidence of End Items and pallets ready for shipment.
Shipments shall not occur without the Government’s approval. Government representative will sign provided DD Form 250 and provide other important documents for shipment to occur.
Designated Representatives are:
Alison Piec, Alison.piec@us.af.mil David Roescher, david.roescher.ctr@us.af.mil
10. Delivery Schedule
Delivery of the full order shall begin upon official PCO notification of First Article Acceptance and delivered as soon as practicable, but no later than One-Hundred and Ninety (190) calendar days from notification.
If the Contractor is unable to complete the delivery of all quantities under the contract for any reason, the Govern-ment may, at its sole discretion, return any or all of the delivered quantities. No adjustments will be made to the negotiated unit cost for any quantities retained by the Government. The Contractor shall be responsible for all ship-ping, storage, and other costs associated with the return of unwanted items.
If the Contractor fails to initiate the return shipment of unwanted End Items within ten (10) business days from the Government's notification, the Government will assume it is the Contractor’s intent to abandon the equipment in place. In such cases, the Government will dispose of or transfer these items in accordance with Government proce-dures. Any disposal costs incurred will be the responsibility of the Contractor.
