About this file
This is a Justification and Approval (J&A) document for a sole source contract award for repairs and maintenance services on FBI-owned X-Ray inspection systems.
The Federal Bureau of Investigation, through its Finance and Facilities Division Procurement Section, is justifying the award to Astrophysics, Inc. under the sole source authority of 41 U.S.C. 3304(a)(1) for an estimated contract value of $142,045.00. The requirement covers repairs and maintenance services on XIS X-Ray inspection systems deployed at FBI Headquarters and Field Offices throughout the United States under a new firm fixed-price contract. The services mandate 24/7 maintenance availability with on-site response within 36 hours of reporting, along with monthly preventive maintenance evaluations covering technical, generator, image performance, computer, video, environmental, electrical, and health and safety assessments. The justification establishes that Astrophysics is the sole developer and manufacturer of the XIS line of inspection systems and the only authorized vendor capable of providing factory-authorized repairs and maintenance. Use of non-authorized service providers could void manufacturer warranties, impair system performance, invalidate technical support, compromise detection accuracy, and create operational and safety risks. Market research confirmed that while Astrophysics partners with authorized resellers for procurement, all service-related functions are performed exclusively by Astrophysics. The FBI intends to post a Notice of Intent on SAM.gov to allow other vendors an opportunity to submit capability statements for consideration. Pricing was determined fair and reasonable based on comparison to prior purchases, historical pricing trends, published commercial pricing, and evaluation against an Independent Government Cost Estimate. The document was prepared on May 28, 2026, and approved by the Contracting Officer on June 3, 2026.

FEDERAL BUREAU OF INVESTIGATION
FINANCE AND FACILITIES DIVISION I PROCUREMENT SECrION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN
FULL AND OPEN COMPrrITION
JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION IN ACCORDANCE WITH 41 U.S.C. (a) (1)
Requisition Number: SHOP-PR-24-OY-000868-OY2
Date: May 28, 2026
Estimated Dollar Value: $142,045.00
1. Identification of the agency and contracting activity.
The U.S. Department of Justice, Federal Bureau of Investigation (FBI), National Acquisitions Programs Unit, has prepared this justification for other than full and open competition for repairs and maintenance on FBI-owned X-Ray inspection systems on behalf of the Finance and Facilities, Division.
2. The nature and/or description of the action being approved, i.e., sole source, limited competition, establishment of a new source, etc.
The Federal Bureau of Investigation’s description of the contract action proposed for approval is detailed below.
Repairs and Maintenance on XIS X-Ray inspection systems
Services will be performed at FBI Headquarters and Field Offices throughout the United States
Contract Type
New contract/agreement; Firm Fixed Price
3. A description of the supplies or services required to meet the agency’s needs.
FINANCE AND FACILITIES DIVISION I PROCUREMENTSEaION
JUSTIFICATION AND APPROVAL (J&A) FOR OTHER THAN
FULL AND OPEN COMPETITION
The requirement is for repairs and maintenance on FBI-owned X-Ray inspection systems. The maintenance and upkeep of these systems is crucial, requiring the FBI to have access to 24 hours, 365 days of maintenance service with on-site response within 36 hours after reporting.
Preventive maintenance is to be completed on a monthly schedule to ensure equipment is operational. This monthly maintenance evaluation shall include tests on technical, generator, image performance, computer, video, environmental, electrical, and health and safety considerations.
4. The statutory authority permitting other than full and open competition.
The statutory authority permitting other than full and open competition is 41 U.S.C. 3304(a)(1), as implemented by FAR 6.103-1, 'Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements.’ Astrophysics is the developer and manufacturer of the XIS line of inspection systems owned by the FBI.
5. Demonstrate the unique qualifications of the proposed contractor or the nature of the action requiring the use of the authority.
The X-Ray inspection systems are comprised of assemblies, subassemblies, and parts that are designed, developed and propriety to Astrophysics. Astrophysics is the sole manufacturer of the referenced equipment and is the only vendor capable of providing proper support for the referenced equipment to ensure optimal performance throughout the life of the product. Only Astrophysics is authorized to perform repairs, maintenance, and service on the XIS line of X-Ray inspection systems.
Use of non-authorized service providers could void applicable manufacturer warranties, impair system performance, invalidate manufacturer technical support, compromise detection accuracy, and create unacceptable operational and safety risks to FBI personnel and facilities.
No third-party vendors were identified that possess authorized access to proprietary diagnostics, firmware, software, replacement components and technical data necessary to perform factory-authorized maintenance and repair services on the XIS systems.
This requirement is not the lack of advance planning. These maintenance services are recurring operational requirements to maintain continuity of FBI screening operations.

FULL AND OPEN COMPETITION
6. A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies.
The Federal Bureau of Investigation’s efforts made to solicit offers among as many sources as practicable are described below.
Request for Information via SAM.gov (or otherwise)
A Notice of Intent to sole source shall be posted on SAM.gov for this requirement, which will publicize the FBI’s intent to issue an award to Astrophysics, Inc. This announcement will also give an opportunity for other vendors to demonstrate their ability to meet the FBI’s specific needs through submission of their technical capabilities and cost information for consideration prior to an award being issued.
7. The anticipated dollar value of the proposed acquisition, including options if applicable, and a determination by the Contracting Officer that the anticipated cost to the Government will be fair and reasonable.
The anticipated price is determined fair and reasonable based on comparison to prior purchases of the same services, review of historical pricing trends, comparison to published commercial pricing, and evaluation against the Independent Government Cost Estimate.
8. A description of the market research conducted and the results.
Market research was conducted through review of the original system procurement documentation, review of Astrophysics technical literature, internet research, SAM.gov searches, and review of commercially available distributors. Research confirmed that Astrophysics does partner with authorized resellers to support customer procurement however, all service-related functions are exclusively performed by Astrophysics.
9. Any other facts supporting the use of other than full and open competition.
Astrophysics is the only authorized vendor to conduct repairs and maintenance on the equipment. They have also submitted a sole source letter that references this claim. Risks of using another vendor would void warranty service and would risk non-compliance with quality standards and could compromise the integrity of the X-Ray inspection systems.

10. A listing of any sources that expressed a written interest in the acquisition.
As of the date of this justification, no sources have expressed written interest. The FBI intends to post a Notice of Intent on SAM.gov to provide interested vendors with an opportunity to submit capability statements for consideration.
11. A statement of any actions the agency may take to remove or overcome any barriers to competition, if subsequent acquisitions are anticipated.
The FBI will continue to assess commercially available technologies during future acquisition planning cycles to determine whether alternative inspection systems can meet operational requirements are available. Future acquisitions involving replacement or modernization of the detection system may provide expanded competition opportunities.
