STATEMENT OF WORK (SOW)
FOR
ASPHALT DELVIERY
AND
LAKEBED OIL STIRPING
EDWARDS AFB, CA
15 NOVEMBER 2021
l. DESCRIPTION OF SERVICES: The contractor shall provide all tools, supplies, equipment and qualified personnel necessary to mix and apply Oil Striping and Number Marking of the Lakebed Runways at Edwards Air Force Base, California. The contractor shall provide all the equipment necessary to mix and apply the product. The contractor shall operate the required vehicles and equipment necessary to perform the Oil Striping and Marking in accordance with the contract and the appropriate product manufacturer's recommendations. The contractor shall ensure the applied product meets or exceeds the appropriate federal, state, local and Environmental Protection Agency (EPA) standards. The contractor shall perform any corrective maintenance due to unscheduled equipment breakdowns and deficiencies during the application process. The contractor shall be responsible for the cleanup of any amount of spillage of the product during delivery, mixing and application. The contractor shall coordinate with the 412/CES Heavy Repair Section in establishing a point of contact and equipment staging area. All hazardous waste materials shall be removed from the work site, transported and disposed of at an authorized off-base location, all hazardous waste services will be performed in a manner that complies with all current Federal, State of California, Kern County, EPA, local laws and regulations and guidance.
1.2. BASIC SERVICES: The contactor shall be required to spread the CSS-1 and SS-1H Oil mixture in accordance with the best business practices in the industry. Asphaltic concrete paving, hot mix, hot laid, graded and aggregate type asphalt. The asphalt shall be homogenous petroleum product and shall not foam when heated to 347 degrees in accordance with Federal Specifications SS-A0706D. A minimum of at least 10 tons of undiluted product per order is required. Marking required shall include straight lines up to 16 feet wide, circles, (within the turning radius capability of the spreading vehicle), large numerals, and other Special markings. The exact location of these markings will be given to the contractor at the spreading site. Some of the special marking may require the use of a hand held spraying device for accuracy. The government representative will determine the distribution rate depending upon the condition of the areas to be marked.
1.2.1. MIXING AND SPREADING: The contractor shall be required to mix the CSS- 1 or SS- 1H Oil to a 60/40 Oil to Water ratio. , .
l.2.2. TIME OF DELVERY: The contractor shall be given a minimum of 72 hours telephonic notice prior to the required delivery time.
1.2.3. DELIVERY DAYS AND HOURS: CSS-1 or SS-lH Oil shall be delivered between the hours of 7:00 a.m. and 5:00 p.m. Sunday through Saturday, excluding Federal holidays.
2. CONTRACT MANAGER: The Contractor shall provide a contract manager who shall be responsible for the overall management and coordination of the work required under this contract. The name of this person and alternate(s) shall be designated in writing to the PM and CO at contract start date. The contract manager or alternate(s) shall be available by phone and provide a 24 hours phone number in order to respond to the requirements of this contract.
The project manager or alternate(s) shall respond to government requirements, questions, concerns, within 1 hour from notification. The contract and project manager along with any alternate(s) must be able to read, write, speak and understand the English language.
2.1. CONTRACT EMPLOYEES: Contractor employees shall be U.S. citizens or have the legal right to be in, and work in, the U.S.A. Foreign born employees will be required to show proof of citizenship, or proof of right to be in, and work in, the U.S.A. The contractor shall not employ any persons who are identified to the contractor by the CO as a potential threat to the health, safety, security, general well-being or operational mission of the installation and its population. The contractor shall not employ any person who is an employee of the U.S.
Government if it presents a conflict of interest per DoD Directive 5500.7; applies to both military and civilians. The on-site contract employees must be able to read, write, speak, and understand the English language.
2.1.1. CONTRACT PERSONNEL: Contractor personnel shall present a neat appearance.
Contractor personnel shall be easily recognizable while on the installations in conjunction with this contract and shall be accomplished through the wearing of distinctive clothing bearing the company name or logo ensuring that it identifies Contractor personnel easily and quickly for reasons of security, safety and personal protection.
2.1.2. VEHICLES: The Contractor shall provide and maintain all equipment and vehicles necessary to perform the requirements of this BPA. Contractor vehicles shall have the company name prominently displayed on both sides of the vehicle and be maintained to present a neat, professional appearance. All Contractor vehicles shall be properly registered, licensed and insured. The CO or PM may inspect the contractor’s vehicles at any time and direct the use solely for the intended purpose of performing services in accordance with this contract. Vehicle failure shall not alleviate the contractor from performing any requirement contained in this contract.
2.1.3. EQUIPMENT: The Contractor shall provide and maintain all equipment necessary to perform the requirements of this contract. All equipment used in the performance of this contract shall be in good operable condition and carry a U/L (Underwriters Laboratory) listing.
Equipment found to be unsafe or unable to function as designed, shall not be used in performance of this contract. The CO or PM may inspect the contractor’s equipment and vehicles at any time and direct the removal of any unsafe or unusable equipment or vehicle from the installation. The contractor shall provide adequate numbers of equipment items to effectively fulfill the scope of this contract. Equipment failure shall not alleviate the contractor from performing any requirement contained in this contract.
2.2. SECURITY REQUIREMENTS: The contractor shall comply with all base security regulations and actions dictated by force protection condition changes/measures. These regulations are available for review from the CO. All contractor employees will be subject to a criminal history background check IAW AFMAN 31-113, Installation Perimeter Access Control.
Contractor employees will be required to obtain and display identification badges at all times.
Anticipate delays in getting commercial vehicles on base and allow time for commercial vehicles to reach their destination by driving designated routes at posted speed limits throughout the base.
Procedures for commercial vehicle access to the base are subject to change without prior notice.
The contractor manager shall ensure each employee obtains all applicable pass and identification items for contractor personnel and non-government owned vehicles. Failure to obtain necessary items could result in denial of employee entry to the base.
2.2.1. The Contractor must, within five days after contract award or the hiring of new employees, comply with the requirements in paragraph (d) of the Contractor Access to Air Force Installations clause. All contractor employees shall abide by all installation security regulations.
2.2.2. The contractor shall maintain a current listing of all employees and shall provide it to the PM and CO on contract start date. An updated listing shall be provided upon change of any employees or upon the request of the PM and CO. Upon employment termination or contract end, the contractor shall retrieve all government issued identification badges and passes and return them to the PM.
2.2.3. The Civil Engineer security manager will require of each employee a photo state identification card or driver’s license, social security number, date of birth and birth location in order to process employee approval for base access. The government reserves the right to request additional information if necessary.
2.2.4. Contractor will be offered Level I –Antiterrorism Awareness Training by the government.
This training provides contractor employees with the requisite knowledge necessary to remain vigilant for possible terrorist threats. Coordination for training should be done by the requiring unit after contract award.
2.3. REGULATIONS AND STANDARDS: The contractor shall comply with all Edwards Air Force Base safety standards and all OSHA standards. Resolution of citations for violations of Occupational Safety, Health Act Safety, and Health Standards is the contractor’s responsibility.
2.4. QUALITY CONTROL: Contractor shall develop and maintain a quality control program to ensure restoration services are performed IAW commonly accepted commercial practices and services identified in this Statement Of Work (SOW). A contractor quality control plan (QCP) shall be developed and submitted to the CO and PM/COR within five days of contract award for acceptance. Once accepted the contractors performance will be evaluated using the Contractors QCP and Government quality assurance procedures.
2.4.1. Quality Assurance: The Government will evaluate contractor’s performance through on-site inspections of contractor’s performance and/or receipt of complaints from base personnel.
Any unsatisfactory inspection (defect) result shall be recorded, and the Contractor shall re-perform the service within two hours after notification.
2.4.2. Customer Complaints: The PM will receive and investigate complaint(s). The PM shall be responsible for initially validating customer complaints. The CO shall make final determination of the validity of customer complaint(s) in cases of disagreement with the PM and the Contractor. Validated customer complaints shall be re-performed by the contractor within two hours of notification.
3. GOVERNMENT FURNISHED SERVICES: The Government will furnish electricity;
water and sewage service as necessary for accomplishment or work IAW this contract. The Contractor shall furnish all Contractor shall furnish all transportation, equipment, material and labor necessary to obtain the utilities from the existing systems/outlets.
3.1. Utility Conservation: The Contractor shall adhere to all base level utility conservation practices or requirements. The Contractor shall be responsible for operating under conditions that prevent waste of utilities.
4. HAZARDOUS MATERIAL HANDLING: SDSs are required as specified in the latest version of Federal Standard No. 313 (including revisions adopted during the term of the contract) for any other material designated by a government technical representative as potentially hazardous and requiring safety controls. Current SDSs must be submitted by the Contractor upon contract award. In addition, the Contractor will provide new and revised SDSs to the CO when applicable. Failure to provide SDSs or certificate when required or requested could result in the Contractor being considered non-responsive and result in termination of the contract.
4.1. HAZARDOUS MATERIAL DETERMINATION AND AUTHORIZATION
PROCESS: Edwards AFB contractors shall participate in the Installation Hazardous Material Program IAW their applicable contract terms and conditions. There are several levels of participation that may be achieved based on the contractor's resources. The government Hazardous Material Distribution and Support Center or Environmental Management Division (412 CEG/ CEV or "CEV") personnel will inventory all chemicals that the Contractor brings on to Edwards AFB or any property under the control of Edwards AFB. The inventory will be performed prior to commencement of work. Any products that meet the criteria of " Hazardous Material" must be bar coded and tracked until permanently removed from government property or the Contractor may track Hazardous Material using alternative methods specified in the Edwards AFB Instruction 32-119, Installation Hazardous Material Management Program (15 September 2010), Section 2.5.5.
4.2. SPILL RESPONSE: The Contractor will be briefed on Edwards AFB spill response procedures at the pre-performance conference. The Contractor is responsible to report to CEV and promptly cleanup all spills in a manner consistent with current environmental regulations, at no cost to the government. In the event that it is necessary to utilize government material, equipment or personnel to clean up a Contractor caused spill, the Contractor shall be required to reimburse the government for all associated costs.
4.3. HAZARDOUS MATERIAL/WASTE MANAGEMENT: The Contractor will be briefed on Edwards AFB Hazardous Material / Waste Management Plan at the pre-performance conference. The Contractor will meet all applicable hazardous material and hazardous waste management requirements.
4.4. HAZARDOUS WASTE DETERMINATION AND HANDLING: All Hazardous and Universal Waste generated as a result of Contractor activity will be managed on-site and removed from the installation JAW federal, state, and local laws, and the Edwards AFB Hazardous Waste Management Plan (April 2015). The Contractor shall properly identify and characterize waste, in order to employ suitable management methods. Criteria for identifying hazardous waste, is contained in Title 22 California Code of Regulations, Section 66261 and the Edwards AFB Hazardous Waste Management Plan.
4.4.1. The Contractor shall be responsible for removing all Hazardous Waste generated throughout the performance of contract activities from all worksites at the completion of each requirement.
4.5. HAZARDOUS MATERIAL HANDLING: The Contractor shall have approval from the base Bio-Environmental (BEE) and CEV prior to purchasing, handling, using, and storing any chemicals, solvents, lubricants, and other products that require DSs. The Contractor shall identify these materials and products on Air Force Form 3952 Chemical/Hazardous Material Authorization Request Form. The Contractor shall provide one copy of the SDSs for each item to the PM for routing through the CO, BEE and CEV for review prior to any chemicals being brought onto Edwards AFB. The Contractor shall maintain one copy of the SDSs for each hazardous material line item used within the work center. The Contractor will not store Hazardous Materials that have not been inventoried, are damaged or inherently waste like or, will not be used to perform designated contract activities. The Contractor will be responsible for removing excess Hazardous Material from Edwards AFB after contract completion.
4.6.1. The Contractor shall not use products that are or contain Toxic 17 chemicals, Extremely Hazardous Substances, Ozone Depleting Substances and/or Persistent Bio accumulative and Toxic chemicals. Any Hazardous Material containing one of these banned substances will not be allowed on base.
4.6.2. TRAINING: The Contractor shall ensure all employees complete required Hazardous Communication, Hazardous Material, and Hazardous Waste training. The Contractor shall appoint a primary and alternate Hazardous Material and Hazardous Waste monitor. Monitors arc responsible for training all other Contract and subcontract personnel regarding hazardous material/waste containers maintained within Edwards AFB.
4.7. HAZARDOUS WASTE MINIMUM TRAINING REQUIREMENTS:
1) 29 CFR/8 CCR Hazardous Communications Training (must be comprised of or include documented OJT)
2) All environmental/health & safety training required by the contract necessary to perform work assigned in compliance with federal, state, and local regulations
3) Edwards AFB Hazardous Materials Management System (HMMS) HM User Training (only if Contractor will be utilizing the HMMS to track Hazardous Waste managed on-site)
4) Edwards AFB: Hazardous Waste Managers Training (initial) (only if Contractor will be managing Hazardous Waste on-site)
5) Edwards AFB Hazardous Waste Managers Training (annual refresher) (only if Contractor is required to take the initial training)
ENVIRONMENTAL MANAGEMENT SYSTEM (EMS)
5. The 412th Test Wing maintains a conforming EMS. The services provided by this contract/agreement are within the scope of the EMS. Control of environmental pollution requires consideration of air, water and land uses, involves the management of noise, solid waste, thermal energy and radioactive materials, as well as other pollutants. Environmental protection shall be provided during the life of the contract. Contracts shall ensure compliance with Pollution Prevention and Right-to Know Information and all contracts shall conform with all operational controls identified in the applicable facility EMS and shall provide monitoring and measurement information necessary for the Government to address environmental performance relative to the goals of the EMS. Protective measures shall be incorporated to control pollution and/or correct environmentally impacting conditions that may develop as a result of this contract. Coordinate the Scope of Work (SOW) for review through the Environmental Management Division.

5.1. INSTALLATION CONTRACTS
5.1.1. The Air Force (AF) has determined that for contracts that include Pollution Prevention and Right-to-Know Information, and involve contractor operations on an AF installation where the AF has implemented an EMS, the AF must ensure that alternative paragraph (c)(7) is included in that contract. Every contract that includes the aforementioned requirement must also provide, at a minimum, the following additional direction:
- The individual data elements required from the contractor
- The specific format and method by which the contractor should deliver data
- The interval (e.g., monthly, quarterly, annually, etc.) at which contractors must report data
- The installation office to which contractors must deliver the specified EMS support data
5.1.2. In addition, installations shall integrate contractor EMS data reporting with other mandatory contractor environmental reporting requirements.
5.1.3. Per guidance from AFTC/JA, the prescription is:
The contracting officer shall insert the Compliance with EMS, in all solicitations and contracts for contractor operation of Government-owned or-leased facilities or vehicles, located in the United States. For facilities located outside the United States, the agency head may detem1ine that use of the clause is in the best interest of the Government. Federal Acquisitions Regulation -
- Compliance with Environmental Management Systems. As prescribed in 23.903, insert the following clause: Compliance with EMS (May 2011) The Contractor's work under this contract shall conform with all operational controls identified in the applicable agency or facility EMS and provide monitoring and measurement information necessary for the Government to address environmental performance relative to the goals of the EMS.
5.1.4. Conformance with the EMS
The Contactor shall perform work under this contract with the policy and objectives identified in the installation’s EMS. The Contractor shall perform work in a manner that conforms to objectives and targets, environmental programs an operational controls identified by the EMS.
The Contractor will provide monitoring and measurement information as necessary to address environmental performance relative to environmental energy, and transportation management goals. In the event an EMS nonconformance or environmental noncompliance associated with the contracted services, tasks, or actions occurs the Contractor shall take corrective and/or preventative actions. In addition, the Contractor shall ensure that its employees are aware of their roles and responsibilities under the EMS and how these EMS roles and responsibilities affect work performed under the contract. The Contractor is responsible for ensuring that their employees receive applicable environmental and occupational health and safety training, and keeps up to date on regulatory required specific training for the type of work to be conducted onsite. All on-site Contractor personnel, and their subcontractor personnel, performing tasks that have the potential to cause a significant environmental impact shall be competent on the basis of appropriate education, training or experience. Upon contract award, the Contracting Officer's Representative will notify the installation’s EMS coordinator to arrange EMS training. Refer to the Installation's EMS Coordinator for additional site specific EMS requirements. The installation's EMS coordinator shall identify training needs associated with environmental aspects and the EMS, and arrange training or take other action to meet these needs. The Contractor shall provide training documentation to the Contracting Officer. The EMS coordinator shall retain associated records.

GENERAL INFORMATION
6.1. TRAFFIC LAWS: The Contractor and its employees shall comply with all base traffic regulations.
6.2. WEAPONS, FIREARMS AND AMMUNITION: Contractor employees are prohibited from possessing weapons, firearms or ammunition, on themselves or within Contractor-owned or privately owned vehicle while on Edwards AFB.
6.3. CONTROLLED UNCLASSIFIED INFORMATION (CUI): The contractor shall comply with DoD 5200.48 Controlled Unclassified Information and implementing Air Force Guidance for Controlled Unclassified Information (currently, Air Force Guidance Memorandum 2020-16-
01) and the CUI requirements in this contract. The CUI regulation cited in this paragraph sets policy and procedures for marking, handling, transmitting, safeguarding, decontrolling and authorizing for public release of CUI material.
6.4. REPORTING REQUIREMENTS: Contractor personnel shall report to the PM or an appropriate authority any suspicious activity, information or circumstances of which they are aware may pose a threat to the security of DoD personnel, Contractor personnel, resources and classified or unclassified defense information.
6.5. PHYSICAL SECURITY: The Contractor shall be responsible for safeguarding all controlled forms provided for Contractor use. The Contractor s all also conform to the provisions of AFI 31-101 - Integrated Defense for safeguarding all government property, facilities and materials therein provided for Contractor use. At the end of each work period, all government facilities, equipment, and materials shall be secured.
6.6. NO SMOKING POLICY: There is an Air Force Policy of NO SMOKING in any Government building IA W AFI 40-102 (3 Jun 1994).
