About this file
This document is a Justification and Approval (J&A) for Other Than Full and Open Competition for a firm-fixed-price supply contract to procure ArcGIS User Type Licenses and Enterprise Licenses for Geographic Information Systems (GIS) in support of a Foreign Military Sales (FMS) requirement for the countries of Jordan, Ghana, and Nigeria. The requirement is based on the need to maintain standardization and technological compatibility with the existing ArcGIS software currently used by the U.S. Government, allied nations, and the FMS customers. ArcGIS is identified as the only brand-name product that can meet the customers' specialized requirements for GIS analytics and data sharing capabilities. The J&A cites the authority under 10 U.S.C. 3204(a)(1) and FAR 6.302-1 for limiting competition to ArcGIS. The related federal contract opportunity is a Request for Quote (RFQ) for the procurement of the ArcGIS licenses, with a solicitation closing date of 29 AUG 2024.

FAR Part 6 Justification and Approval for Other than Full and Open Competition –
1. Contracting Activity:
Army Contracting Command - Aberdeen Proving Ground 6515 Integrity Court, Building 4310 Aberdeen Proving Ground, MD 21005
2. Description of Action: The Communications Electronics Command Security Assistance Management Directorate (CECOM-SAMD) requests a new commercial Firm-Fixed-Price (FFP) supply contract to procure ArcGIS User Type Licenses and Enterprise Licenses for Geographic Information Systems (GIS) for authoritative data maintenance in 2D, 3D, and 4D. ArcGIS supports data sharing across a suite of GIS products and enables users to work across the various ArcGIS platforms through Web, locally, enterprise wide, and GIS collaboration with Allied Nation Partners.
The word Government in this document refers to the United States Government. The word Country/Countries in this document refers to the BPC Customer(s)
This requirement is for ArcGIS Annual Licenses and must be able to be utilized under existing Letters of Offer and Acceptance (LOA) for ArcGIS products. ArcGIS is the only software capable of providing GIS analytics at the level of quality and integration required because the items are unique and highly specialized, for National Level Military Operations, National Training Exercises, Combat Missions, and Joint Cooperative Operations with partnered Allied Nations for the BPC Countries providing further justification for limiting competition to vendors that supply actual ArcGIS Professional Advanced User Type, ArcGIS Enterprise Type, ArcGIS Pro, ArcGIS Creator, and ArcGIS Desktop products as requested in the following BPC Cases:
CASE ARP COUNTRY DESCRIPTION
DT-B-WHM EX24027 JORDAN RJAF ISR ENHANCEMENT
DT-B-WQE EX24032 GHANA BORDER SECURITY
DT-B-WEQ EX24049 NIGERIA INTEL CORPS
BPC Countries advised the USG of the need to procure GIS licenses with brand product ArcGIS solutions under BPC cases. In order to maintain standardization and technological compatibility with current fielded applications with customers, allied nations, friendly forces and current authorized BPC Countries as well as the United States Government (USG), The BPC Countries have requested ArcGIS licenses for various Intelligence, Surveillance, and Reconnaissance (ISR) and Geographic Intelligence (GeoINT) programs.
This is a current requirement for various ArcGIS Enterprise GIS User Type Licenses and ArcGIS Enterprise Annual Licenses and requires expeditious processing and award prior to 30 September 2024. This is due to funding pressures contributing to procurement and pricing to account for Government Pricing, Supply Chain Issues, situations possibly affecting expeditious ARO dates, and accounting for possible increased pricing affecting award if not completed prior to 30 September 2024.
This software will be utilized by BPC customers. This is a BUILDING PARTNER CAPACITY (BPC) request to provide ArcGIS User and Enterprise Licenses using BPC Funds for items listed below.

4. Authority Cited: 10 U.S.C. 3204(a)(1), as implemented by FAR 6.302-1, Only one responsible source and no other supplies or services will satisfy agency requirements. This authority is supported by FAR 6.302-1(c) Citations: 10 U.S.C. 3204(a)(1) which describes (a) WHEN PROCEDURES OTHER THAN COMPETITIVE PROCEDURES MAY BE USED.—The head of an agency may use procedures other than competitive procedures only when— (1) the property or services needed by the agency are available from only one responsible source or only from a limited number of responsible sources and no other type of property or services will satisfy the needs of the agency;
5. Reason for Authority Cited: • As described at FAR 6.302-1(a)(2), when the supplies or services required by the agency are available only from one responsible source, or for DoD, NASA and the Coast Guard, from only one or a limited number of responsible sources, and no other types of supplies or services will satisfy agency requirements, full and open competition need not be provided for. As further described in FAR 6.302-1(c), an acquisition or portion of an acquisition that uses a brand-name description or other purchase description to specify a particular brand-name, product, or feature of a product, peculiar to one manufacturer does not provide for full and open competition, regardless of the number of sources solicited; and shall be justified and approved in accordance with FAR 6.303 and 6.304.
ArcGIS User Type and Enterprise Type Licenses was identified by CECOM-SAMD as the only Brand Product that can provide the ArcGIS User and Enterprise Licenses with the ability for requisite applications, add-ons, extensions, as well as integration and user expertise as the applications are required to be integrated with existing ArcGIS applications into the BPC Countries Geographic Information Systems (GIS) analysis infrastructure. Integration and installation should allow for the ability to upgrade, install, and integrate current and future ArcGIS software procured for the BPC customers analysis mission operations by the USG.
ArcGIS experienced customers also have requisite application experience for the installation and required integration functionalities ensuring standardization. ArcGIS will allow for: the continuity of the BPC Countries mission operations, command and control execution, and usage for operations and analytics personnel. Otherwise, the BPC Countries Government Forces will be exposed to financial, operational, and collaborative risks as a government and defense entity.
This would put assets at risk in the command infrastructure and could negatively impact the BPC Customer’s operational Military Command and Control (C&C).
In addition to the above, if the Government were to qualify another developer’s software, the risk is high of not meeting BPC Countries’ existing geographic information software exacting capabilities. This is integral because the applications, add-ons, and extensions are customized and integrated within the software applications. These requirements and specifications will need to be maintained in the current software qualified by the various Government BPC Customers.
Utilizing ArcGIS software platform will guarantee the required applications, add-on capabilities, extensions, and compatibilities remain intact and ensure standardization and technological compatibility with the USG, Allied Partners, and internal and external customer organizations.
Lastly, if the Government does not procure the ArcGIS software application licenses the BPC Countries would experience a duplication of efforts and an increase in integrations costs as no other software application is as robust, capable, integrated, compatible, while allowing for add-ons and extensions without massive efforts to integrate different software developers’ applications. This could increase cost in the amount of approximately 3x the current cost estimate.
This figure comprises the cost of migration to a different GIS application which would include engineering costs associated with installation, integration, training of a new software suite with established GIS applications as well as the loss of subject matter expertise from current users.
6. Efforts to Obtain Competition: Items are available from the Developer and resellers in various procurement approaches. Best pricing will most likely be from the developer. Also, direct purchase from the Developer has the added advantage of customer having direct access to involve developer in case of situations requiring assistance with the software, installation, integration, or add-on applications. Pricing may experience increases when using resellers to procure and may affect delivery schedules due to developmental issues, supply chain issues, labor costs of resellers, and simultaneously experiencing shortages due to the unavailability of labor or catastrophic computing outages.
a. Effective Competition: Because this is not a country-directed sole source requirement and market research has shown that there is more than one reseller of the ArcGIS software applications and licenses, it is advised to openly compete the requirement as a brand-name acquisition.
b. Subcontracting Competition: Subcontracting Competition: FAR 52.244-5 Competition in Subcontracting will be a requirement in the solicitation, which will ensure the prime contractor will select subcontractors on a competitive bases to the maximum practical extent.
7. Actions to Increase Competition: This requirement will be open competed among brand name.
If there are future requirements to provide these types of applications, CECOM-SAMD will explore all options available to award the next contract. The Government will continue to perform market research to determine whether any other vendor can provide a production ready exportable version of suitable Geographic Information System (GIS) applications.
8. Market Research: In accordance with accordance with FAR 10.002 (b)(1) Techniques:
• Contacted knowledgeable people (Government and Industry) in specific markets.
• Contacted contracting officers, contract specialists, and project officers in other federal agencies and private industry (other users).
• Contacted known sources of equipment and/or services.
• Conducted market surveys to obtain information from potential sources.
• Used Internet tools and perform Web searches.
• Reviewed results of recent market research on similar or identical requirements.
• Inquiries of various manufactures for replacement equipment with similar capabilities.
• Rough Order of Magnitude (ROM)
ArcGIS is the only software that could meet the BPC Countries’ stringent and unique requirements. The following narrative details CECOM-SAMD’s findings:
There is a definitive Form, Fit, Function requirement with the customer’s request. Any alternative vendors software may require massive efforts and expense for refitting, new installation of software, configuration of software, setup of user preferences, retraining of personnel, and may require retention of additional Brand Name applications, integration services, and training services to support a new software infrastructure. ArcGIS is the premiere and often said to be the most capable in terms of Geographic Information System (read: Geographic Intelligence Software). In terms of enhancing a customer’s Military posture, ArcGIS is the common platform for the US DoD, Federal Agencies, US Military, Allied Nations Militaries and Intelligence Services, and Law Enforcement Agencies, as well as Emergency Response Agencies at all levels. Additionally, ArcGIS has the most comprehensive functionality, integration with other tools, ability to add on outside extensions, compatibility of various file formats, and robust technical support of most, if not all, the listed GIS platforms.
the USG uses ArcGIS, from NSA to CIA to FEMA, State, Municipal as well as Military Organizations, and is installed in the analysts’ stations in government organizations such as NSA, Commercial entities such as OSINT Companies, as well as State and Municipal level Analyst programs. It is a comprehensive and highly integrated application and is able to easily move data and information between ArcGIS Suite Applications such as ArcGIS Online, ESRI, ArcGIS API for JavaScript, ESRI Location Analytics, ArcGIS Pro, ArcGIS Desktop, and ArcGIS Enterprise.
ArcGIS applications information and metadata is easy to share with other members of our BPC customers, government organizations, commercial vendors, and differing Organizations such as Armed Forces, NSA, CIA, USG, as well as US State Dept programs and processes.

Developer is not willing to share, license, or transfer any proprietary or intellectual property to any other developer to develop base Geographic Information Systems Software. However, Developer does allow third-party add-ons to boost and enhance capabilities of the base ArcGIS Software through Software Development Kits (SDK).
As a result of the above findings, it was ultimately determined that ArcGIS was the only Brand Name product whose comprehensive GIS software suite is the only software suitable to meet requirements and be integrated with existing ArcGIS software in the Customers current GeoINT, GeoSpatial, and Geographic OSINT analytical infrastructure.
