AGENCY: Department of Justice - Bureau of Prisons

CONTRACTING ACTIVITY: United States Penitentiary, Waymart PA

ACTION TO BE APPROVED: This action is for the acquisition of outside comprehensive medical services for the month of April 2022 for USP Canaan at an estimated cost of $22,000.00. The procurement of medical services is urgent in nature in order to provide continuity of care to the inmate population. The contractor is Integrated Medical Solutions (IMS).

DESCRIPTION OF SUPPLIES REQUIRED TO MEET THE AGENCY'S

NEEDS: As part of the mission of USP Canaan, comprehensive medical services are provided to the inmate population. When a medical need arises that cannot be provided by onsite medical staff then inmates are sent out into the local community for service.

AN IDENTIFICATION OF THE STATUTORY AUTHORITY PERMITTING OTHER

THAN FULL AND OPEN COMPETITION: FAR 6.302-2,(a) Authority. (1) Citation 10 U.S.C. 2304 @ (2) or 41 U.S.C. 253(c)(2). Application

(2) when the agency’s need for supplies or services is of such an unusual or compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals (b) Application This authority applies in those situations where (1) an unusual and compelling urgency precludes full and open competition.

DEMONSTRATION THAT THE NATURE OF THE ACQUISITION REQUIRES

USE OF THE AUTHORITY CITED: A Request for Contract Action packet for comprehensive medical services was provided to the Field Acquisition Office(FAO) on 8/8/2017. The anticipated date of award is still undetermined. USP Canaan continues to offer medical services to the inmate population. IMS has been the incumbent for approximately 6 years and has an established network of medical providers and facilities available locally to continue to treat USP Canaan inmates. In an effort to maintain continuity of medical care, it is in the best interest of USP Canaan to continue to utilize IMS to ensure the overall mission of basic and emergency health care if offered.

It is also in the best interest of the Government to procure these services from a vendor who can provide the services immediately. Any delay in medical services to USP Canaan would severely disrupt the orderly operations.

DETERMINATION BY THE CONTRACTING OFFICER THAT THE ANTICIPATED

COST TO THE GOVERNMENT WILL BE FAIR AND REASONABLE: The cost is anticipated to be fair and reasonable. IMS has stated they will continue with the same rates that were under option year four for all outside medical services. The Contracting Office will monitor pricing to ensure that it continues to satisfy this determination.

A DESCRIPTION OF THE MARKET SURVEY CONDUCTED AND THE

RESULTS OF A STATEMENT OF THE REASONS A MARKET SURVEY WAS

NOT CONDUCTED: Extensive market research was conducted for the ongoing competitive acquisition that is currently being processed by FAO. The market research will result in a competitively awarded acquisition. Market research for this temporary action was not conducted based on the urgent and compelling need to maintain the existing medical services to support the operations of USP Canaan pending the award of a contract.

ANY OTHER FACTS SUPPORTING THE USE OF OTHER THAN FULL AND

OPEN COMPETITION: The action is for the acquisition of outside comprehensive medical services for the month of December 2021.

The prior contract, DJBP021500000026, included FAR clause 52.217- 8, Option to Extend Services and was extended for six months.

The extension ended on 4/2/19.

A LISTING OF THE SOURCES THAT EXPRESSED AN INTEREST IN THE

ACQUISITION: N/A

A STATEMENT OF THE ACTIONS, IF ANY, THE AGENCY MAY TAKE TO REMOVE

OR OVERCOME ANY BARRIER TO COMPETITION BEFORE ANY SUBSEQUENT

ACQUISITION FOR THE SUPPLIES OR SERVICES REQUIRED: The acquisition of these services is necessary pending the award of a comprehensive medical services contract from the Grand Prairie Field Office. The requirement was competed and pending award from the Field Office. The Field Office has also has advised USP Canaan to continue service with IMS as continuity of services pending their award. As supported in this document, our experience indicates that a single source provider for comprehensive medical services is beneficial to the agency and the inmate population we service. Once the new contract is competitively awarded, further justification for other than full and open competition will not be necessary.

CONTRACTING OFFICER CERTIFICATION: I hereby certify that this justification is accurate and complete to the best of my knowledge and belief, based on information researched by myself and that which was provided by other persons.
