Market research was conducted, and an 8(a) set-aside solicitation was issued in February 2024, which received adequate competition. The anticipated cost for the contract modification is deemed fair and reasonable based on historical pricing, the proposals received, and the Independent Government Cost Estimate.

2. Nature and/or Description of Action being Approved:

modification to an existing contract Individual

Approval is being requested under an individual justification to modify the current Firm-fixed price bridge contract, HT001123C0089, by adding three, one-month option periods in support of the Department of Defense HIV/AIDS Prevention Program (DHAPP) Project Management. The current bridge contract was awarded for a six month base under JA-23-0271B and modified to add three one-month option periods (JA-24-0063B) which is due to expire 22 May 2024. The incumbent is Seneca Telecommunications, LLC and currently performing exceptionally. This bridge action will support the existing level of effort and prevent a lapse in services until the recompete effort is awarded, estimated during 4th quarter FY24. If not executed, this requirement will result in a lapse in services. The program office projects catastrophic outcomes of significant morbidity and mortality among program beneficiaries if a lapse occurs.

3. Description of Supplies/ Services:

The proposed acquisition is to acquire support to international HIV/AIDS programming across 50 countries to provide program management and program integration services to assist in the development and performance of tasks needed to meet the objectives and strategies of the DHAPP mission. This contract will provision staff support to DHAPP located at Naval Health Research Center at Point Loma Naval Base San Diego, to include multiple overseas locations. Activities within DHAPP to be supported by the contract include assisting foreign militaries in establishing HIV testing, treatment, and prevention programming, establishing HIV/AIDS-specific policies for their personnel, adapting and providing evidence-based HIV/AIDS programming and assisting foreign military partners to develop culturally appropriate interventions to affect high risk HIV/AIDS attitudes and behaviors. 5. Rationale Justifying Use of the Statutory Authority Cited:

The DHAPP program requires personnel with established relationships in foreign countries, government programs such as the Department of State Bureau of Global Health Security and Diplomacy, U.S. government allies, and the United Nations. Personnel are required to work alongside local and foreign militaries to establish HIV/AIDS-specific policies, assist with prevention programs, train military personnel in foreign countries and develop culturally appropriate interventions to affect high-risk HIV/AIDS attitudes and behaviors on a global scale. The incumbent, Senaca Telecommunications, LLC, has served as the primary contractor for the past four years and permitting the services on HT001123C0089 to lapse would curtail the agency's and DHAPP's ability to support foreign military public health and provide AIDS prevention services on a global scale. These military relationships and functional understanding of the daily requirements are integral to the ongoing training, intervention and development of c are for people living with HIV. Seneca possesses the operational infrastructure required for successful performance during the short period.

Adding three additional one-month option periods is the most efficient way to prevent a lapse in service until the recompete completes source selection. This action will provide continuity in services and flexibility until contract award. The time taken for another contractor to transition-in, understand the nature of operations, processes and procedures would result in unacceptable delays in continuing DHAPP support crucial to the mission. Seneca Telecommunications will continue to provide the support required during the option periods without a loss of efficiency and negative impact to DHAPP mission.

6. Efforts to Obtain Competition:

DHA PS-CD has made every effort to ensure services were solicited from as many potential sources as praticable through various means of market research, a soures sought issued June 2023 and pre-solicitation notice issued November 2023. Multiple sources provided a reponse to both inquiries, consisting of large and small businesses with majority being 8(a) firms. On February 7, 2024 DHA PS-CD issued Request for Proposals (RFP) HT001123R0109 as an 8(a) set-aside via SAM.gov. RFI Waiver approved by the HCA on May 3, 2024.

Adding three additional one-month option periods is the most efficient way to prevent a lapse in service until the recompete completes source selection. 7. Determination that Anticipated Cost to the Government will be Fair and Reasonable:

The contracting officer will determine that the anticipated costs to the Government will be fair and reasonable through a comparison to historical pricing, pricing received in response to the RFP, and the Government's Independant Cost Estimate.

8. Market Research:

Market Research Conducted? Yes When was it conducted? 6/20/2023 to 11/2/2023 Description:

Market research was conducted via multiple Government sources such as Ability One and Federal Prison Industries, Inc, and was unable to find sources available. The pre-solicitation notice and sources sought revealed a large number of 8(a) vendors potentially capable of providing the services being requested. Interested parties whom responded to the notice and sources sought were a combination of large and small businesses consisting of 8(a), Women-Owned Small Business, Alaskian Native Corporation, Service-Disabled, and HUBZone. Market research revealed there were are least two or more responsible 8(a) small business available.

9. Other Facts:

HT001123C0089 was modified under JA-23-0271B to add three, one-month option periods in order to avoid a lapse in services and execute a competitive follow-on contract by 22 May 2024. The follow-on received adequate competition and is currently unde rgoing source selection. Due to extensive delays presented with the acquisition (proposal extensions, evaluations, legal reviews, edits and finalization/approval of documentation for each offeror), the exp ectation of meeting the 22 May award date is unrealistic. Adding three additional one-month option periods will allow PS-CD to thoroughly review each proposal in order to reach a successful source selection decision.

PS-CD used an 8(a) set-aside RFP in February 2024 and received adequate competition. Market research revealed multiple sources interes in providing DHAPP services in response to the sources sought and presolicitation notice. The following are a list of vendors who showed interest:
