2. Description of the Action Being Approved

This action will award a sole source Cost Plus Fixed Fee (CPFF) contract to Energetics Technology Center, Inc. (ETC) ETC will deliver technology prototypes for MEMS (Micro- Electromechanical Systems) fuzes.

The contractor for this effort is:

Energetics Technology Center, Inc.

4185 Indian Head Highway Indian Head, MD 20640

3. Description of Supplies/Services

4. Statutory Authority Permitting Other Than Full and Open

Competition

10 U.S.C. 2304(c)(1), as implemented by FAR 6.302-1 - Only One Responsible Source and No Other Supplies or Services will Satisfy Agency Requirements.

5. Rationale Justifying Use of Cited Statutory Authority

Under historical contract N00174-18-C-0006, ETC has developed a variety of MEMS related processes. These processes have been utilized in the past and are currently being refined for on-going programs.

Processes included specialized assembly and inspection procedures and fabrication methods that are not commonly used. ETC has a running familiarity with the NSWC IHD cleanroom and the MEMS related equipment housed within.

This is a logical follow on effort in accordance with (IAW)FAR 6.302-1(a)(2)(C)(ii)where ETC performed the majority of the work in support of the previous effort. If NSWC IHD is required to hire a different contractor, undue burden is placed on the MEMS programs and will result in substantial risk to cost, schedule, and quality of program deliverables. The risk is due to the considerable amount of time and funding required to obtain and train new personnel and quality is affected by inexperience. This would be especially harmful to MEMS programs since the programs are developmental and rarely last more than two years.

IAW FAR 6.303-2(b)(9)(ii), it is currently estimated to take

1 IAW NMCARS 5206.304(a) If the dollar value of the contract is negotiated at a level that exceeds the dollar threshold of the original justification approval authority, a new justification approval shall be obtained from the appropriate approval authority prior to award.

a total of 360 hours of training to transfer the knowledge set from ETC to an NSWC IHD employee. That amount of hours is the estimated time to train a person to fabricate, assemble, inspect, and test MEMS devices. Training would include instruction on the equipment and chemical processes required to perform these tasks. At the current Band III labor rate of , total labor for training would cost

,with an additional estimated in material to practice on. To transfer the knowledge from the NSWC IHD employee to a new contractor will double the total cost and time to and hours, thus it benefits the Government to retain ETC as a logical follow on contractor.

6. Description of Efforts Made to Solicit Offers from as Many

Offerors as Practicable

A Sources Sought notice was posted on 28 April 2020 to the System for Award Management (SAM) website to satisfy the requirement of Defense Federal Acquisition Regulation Supplement 206.302-1(d). No responses were received.

The proposed contract was synopsized on the beta.sam.gov website on March 19, 2021. There were no expressions of interest.

7. Determination of Fair and Reasonable Costs

In accordance with Federal Acquisition Regulation (FAR) 6.303-2(a)(7), the Contracting Officer determines that the total anticipated cost to the Government will be fair and reasonable.

8. Actions to Remove Barriers to Competition

ETC has unique capabilities as detailed in paragraph 5. At this time, NSWC IHD has no plans to compete the types of service/supplies covered under this document. If another potential source emerges, NSWC IHD will assess whether competition of future requirements would be feasible.
