About this file
This document is a Justification for Other Than Full and Open Competition (J&A) issued by the United States Marine Corps Systems Command for specialized parachute procurement. The Marine Corps conducted market research through a Request for Information (RFI) posted on SAM.gov on 3 September 2024, seeking potential sources for Container Delivery System (CDS) and Joint Precision Airdrop System (JPADS) parachutes. After extensive market research, Airborne Systems (CAGE Code 57172) was identified as the only viable contractor capable of manufacturing these parachutes. The justification argues that soliciting from only Airborne Systems is in the best interest of the government due to the extreme risks inherent in parachute deployment, noting that relying on new vendors could delay acquisition, impose high risks to personnel, and negatively impact the mission. The document is dated 7 August 2025 and seeks to procure the parachutes under the simplified acquisition threshold using other than full and open competition.

Subj: USE OF OTHER THAN FULL AND OPEN COMPETITION FOR AN
ACQUISITION UNDER THE SIMPLIFIED ACQUISITION THRESHOLD
I. BACKGROUND:
1. FAR 13.106-1(b)(1)(i) states for purchases not exceeding the simplified acquisition threshold, Contracting Officers may solicit from one source if the Contracting Officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization).
2. As required by FAR 13.106-3(b)(3)(i), this memorandum explains the absence of competition for this acquisition, as only one source will be solicited for this requirement (or for a portion of the requirement) and the requirement is not expected to exceed the simplified acquisition threshold.
II. DESCRIPTION OF ITEM OR SERVICE:
Program Manager Infantry Weapons (PdM IW), Marine Corps Systems Command (MCSC), conducted market research to seek industry input to identify potential sources for specialized parachutes, specifically the Container Delivery System (CDS) parachute and the Joint Precision Airdrop System (JPADS) parachute. The primary source of market research for this procurement includes the responses to a Request for Information (RFI) posted on 3 September 2024, to SAM.gov, with an updated RFI amendment posted on 15 October 2024 which extended the RFI response date out until 29 October 2024.
Upon closure of the RFI, Airborne Systems (CAGE Code 57172), was the only responding contractor with the ability to manufacture the parachutes in reference. Airborne Systems response indicated that these parachutes are of a type that are offered and sold competitively in substantial quantities to the general public and/or nongovernmental entities for other than governmental purposes with minor modifications. The project office conducted additional market research by contacting known industry partners to identify any additional viable solutions for the listed requirements. Despite the extensive search, Airborne Systems emerged as the only viable contractor. Airborne Systems has held numerous parachute manufacturing contracts with the Federal Government and has repeatedly shown the ability to meet specific requirements and demonstrate success within the DoD.
III. THE DETERMINATION FOR USE OF OTHER THAN FULL AND OPEN
COMPETITION IS BASED ON THE FOLLOWING (select all that apply):
A. _X__ ONLY ONE RESPONSIBLE SOURCE (select all that apply):
1. ___ RESTRICTIVE RIGHTS. The source has established proprietary rights, limited rights in data, patent rights, copyrights or secret processes in the item or service required.
2. ___ EXCLUSIVE LICENSING AGREEMENTS. The item or service is only available from the Original Equipment Manufacturer (OEM), or there is only one authorized distributor or technical representative for the OEM.
OR
3. __X_ OTHER REASONS.
Airborne Systems was identified as the only known vendor able to meet the requirements to manufacture and produce the CDS and JPADS parachutes. Due to the extreme risks inherent to the utilization and deployment of parachutes, it is in the best interest of the Government to only solicit this requirement from one source, Airborne Systems, as relying on vendors new to the industry would delay the acquisition requirements, impose a high risk to Government personnel using the parachutes and negatively impact the mission.
B. ___ BRAND NAME. Item required must be a brand name product, or feature of a product, particular to one manufacturer.
C. ___UNUSUAL AND COMPELLING URGENCY. The supplies or services are of such unusual and compelling urgency that the Government would be seriously injured unless the agency is permitted to limit the number of sources from which it solicits bids or proposals.
Urgent requirements are supplies or services that will result in a work stoppage, or are mission critical and the routine processing time would result in injury to the Government. The determination that the procurement for the above item/service is an urgent and compelling requirement is based on the following:
1. Date on which the requirement was first identified:
2. Required delivery date/period of performance:
3. Explanation of why delivery/commencement of services by the date mentioned above is required:
4. If appropriate, include any additional pertinent information.
IV. CERTIFICATIONS/APPROVALS:
A. Technical / Requirements Certification: I certify that the facts and representation under my cognizance which are included in this justification are complete and accurate to the best of my knowledge and belief.
