About this file

This document is an E-Verify compliance guide and affidavit forms issued by Union County Government in Georgia, establishing contractor requirements under Georgia law O.C.G.A. 13-10-91 (effective July 1, 2013). The guidance applies to all businesses contracting with Union County for labor or services exceeding $2,499.99, requiring contractors and their subcontractors to register with and actively use E-Verify, the federal work authorization program operated by U.S. Citizenship and Immigration Services, throughout the contract period. All subcontractors and sub-subcontractors performing work under the contract are subject to the same requirements. Union County requires contractors to provide verification of E-Verify compliance within five days of hiring any new subcontractor before that subcontractor begins work, and contractors must maintain all compliance records for inspection at any time.

Two exemptions exist from E-Verify requirements: contractors with no employees may instead present an approved state-issued identification card or driver's license from states on the Georgia Attorney General's approved list of states that verify immigration status prior to issuance, or individual licensed professionals in good standing under Title 26, Title 43, or the State Bar of Georgia performing their respective services. For no-employee contractors, Union County requires execution of an exemption affidavit accompanied by compliant state identification. Registration assistance for E-Verify is available through the Department of Homeland Security at 1-888-464-4218, E-Verify@dhs.gov, or www.dhs.gov/e-verify.

What your business needs to know about Georgia’s E-Verify Requirements

(Effective July 1, 2013)

E-Verify Contractor Requirements

Georgia law, O.C.G.A. 13-10-91, requires all businesses that contract with a public employer for labor or services by bid or by contract (formal or informal) in which the labor or services exceed $2,499.99 to sign an affidavit attesting that they are registered for and use E-Verify unless 1) the contractor has no employees (in which case they must present an approved state issued identification card/drivers’ license from an approved state as provided on the Attorney

General’s website) or, 2) the contract is with an individual licensed under Title 26, Tile 43, or the

State Bar of Georgia who is in good standing and that individual is performing that service.

Anyone your business subcontracts with for labor and services, as well as the subcontractors of your subcontractors, in furtherance of that contract is also subject to this requirement.
