About this file

This document is a Maryland Living Wage Requirements Affidavit of Agreement, specifically Appendix 6 with an effective date of July 2024. The form is designed for bidders/offerors to affirm their compliance with Maryland's Living Wage Law under Title 18, State Finance and Procurement Article. The document provides options for contractors to declare either exemption from the Living Wage Law or commitment to paying covered employees a living wage rate for hours spent on state contract activities.

The affidavit outlines specific exemption criteria, such as being a nonprofit organization, a public service company, or having fewer than 10 employees with a contract value under $500,000. For contracts subject to the Living Wage Law, contractors must agree to pay covered employees at least the current living wage rate, submit payroll reports to the Commissioner of Labor and Industry, and ensure subcontractors also comply. The form includes provisions for contractors with no covered employees, such as employees working less than half-time on the contract, being 17 or younger, or working less than 13 consecutive weeks on the state contract.
