About this file
This is a Justification and Approval (J&A) document for a sole source contract award by the Naval Surface Warfare Center Indian Head Division. The contracting activity seeks to award a sole source contract to Peraton for post-production maintenance support of the Navy Counter Radio Controlled Improvised Explosive Device Electronic Warfare (CREW) Transmitting Set, Countermeasure (TCS) AN/PLT-4 systems and Navy CREW fixed installation Legacy Channel Systems. The estimated contract value is $1 million, funded through Operation & Maintenance Navy (O&MN). The acquisition is authorized under 10 U.S.C. 3204(a)(1) and FAR 6.103-1, which permits sole source procurement when only one responsible source exists.
The justification for sole source award centers on Peraton's 10-plus year history supporting Joint Service EOD forces with the AN/PLT-4 system and 14-plus year support of Legacy Channel systems. As a follow-on to previously awarded sole source contract N0017421D0018, the government lacks sufficient data rights to Peraton's proprietary technical data package to enable competitive procurement. Alternative sources would incur substantial, non-recovering duplication costs to replicate specialized testing environments and establish technical competency, creating unacceptable delays in system repairs critical to force protection. Peraton's experience enables rapid turnaround for repair and return of fielded systems worldwide. A Sources Sought notice posted April 14, 2026 and a SAM.gov synopsis dated May 12, 2026 each received zero responses. The Contracting Officer has determined anticipated costs are fair and reasonable. The J&A was approved by the Deputy Chief of the Contracting Office on July 6, 2026.

DEPARTMENT OF THE NAVY
NAVAL SURFACE WARFARE CENTER
INDIAN HEAD DIVISION
3767 STRAUSS AVENUE

J&A Number: N00174-26-RFPREQ- W32-0002 Code:023
JUSTIFICATION AND APPROVAL
FOR USE OF OTHER THAN FULL AND OPEN COMPETITION
JUSTIFICATION
1. Contracting Activity
The Naval Sea Systems Command, Naval Surface Warfare Center Indian Head Division (NSWC IHD), Contracts Office Code 023.
2. Description of the Action Being Approved
Award of a sole source contract for post-production maintenance support of current fielded Navy Counter Radio Controlled Improvised Explosive Device Electronic Warfare (CREW) Transmitting Set, Countermeasure (TCS) AN/PLT-4 systems (Classified II) and Navy CREW fixed installation Legacy Channel Systems to:
3. Description of Supplies/Services
This requirement is to provide post-production maintenance support for the JSEOD Counter Radio-Controlled Improvised Explosive Device (RCIED) Electronic Warfare (CREW) program.
The JSEOD CREW program provides all military EOD services with an electric warfare capability to counter the threat from Improvised Explosive Devices (IEDs). The JSEOD CREW systems protect EOD forces for all services. This action will provide post-production maintenance support as well as provide project management, engineering, configuration management and depot service for both the AN/PLT-4 and Legacy Channel systems.
J&A Number: N0017426-RFPREQ-
W32-0002 FY26-JUN02-22
The estimated dollar value of this requirement will be $1M. The estimated cost is shown below, using Operation & Maintenance Navy (O&MN).
The Governments minimum needs have been verified by the certifying technical and requirements personnel.
4. Statutory Authority Permitting Other Than Full and Open Competition
This acquisition is being conducted under the authority of 10 U.S.C. 3204(a)(1), FAR 6.103-1, Only One Responsible Source and no other supplies or services will satisfy agency requirements.
5. Rationale Justifying Use of Cited Statutory Authority
This is a follow-on acquisition from a previously awarded sole source contract, N0017421D0018 awarded on a sole source basis to Peraton under J&A FY20-APR08-33. Peraton currently repairs and maintains the AN/PLT-4 system. Peraton has been supporting Joint Service EOD forces systems fielded for over 10 years, and the fixed installation Legacy Channel systems, fielded over 14 years.
Pursuant to FAR 6.103-1(c)(2)(i) and (ii), services may be deemed to be available only from the original source in the case of follow-on contract for the continued development or production of a major system or highly specialized equipment and, for DoD, NASA, and the Coast Guard, for the continued provision of highly specialized services that would result in either substantial duplication of cost to the Government that is not expected to be covered through competition, and/or unacceptable delays in fulfilling the agencys requirements.
The Government does not have sufficient data rights to Peratons proprietary TDP and attempts to procure adequate rights for use in competition have been unsuccessful.
Both these CREW systems are close to the end of their life cycles, however, the Government requires post-production maintenance to sustain currently fielded assets until they are formally phased out. Any alternative source would incur significant, non-recovering duplication of costs to replicate specialized testing environments and establish technical competency. These duplicate start-up costs would would far exceed any nominal savings realized through competitive pricing, therefore even if the Government continued to pursue data rights with P raton, it is not in the Governments best interest to purchase the data rights for such a limited time.
Electronic warfare is a very specialized field with no non-military (commercial) use for the technology. Providing this specific capability to U.S forces is critical for force protection measures against multiple variants of Improvised Explosive Device (IED) threats. Changing to another contractor would insert significant delay in providing support to users in the form of repairing fielded systems and providing technical assistance. This delay would increase life-safety risks for the users.
Due to the criticality of the system and their worldwide deployment, it is imperative that the systems are repaired as quickly as possible and returned to the users. Peratons experience with these systems allows them to achieve a turnaround time that would not be feasible with another contractor. To allow for another contractor to perform this effort would severely impact support of these systems. The most cost-effective approach is to maintain support with the Original Equipment Manufacture (OEM) for the duration of life for the AN/PLT-4 system and for the Legacy Channel systems.
6. Description of Efforts Made to Solicit Offers from as Many Offerors as Practicable
A Sources Sought notice was posted on 14 April 2026 under notice ID N0017426-RFPREQ-W32-0002 to the SAM.gov website to satisfy requirements for Defense Acquisition Regulation Supplement 206.302-1(d) and zero (0) responses were received.
The proposed contract was synopsized on SAM.gov on 12 May 2026 under notice ID N0017426RFPREQW340002 with zero (0) expressions of interest.
7. Determination of Fair and Reasonable Costs
The Contracting Officer has determined that the anticipated cost to the Government for the services covered by the J&A will be fair and reasonable.
8. Actions to Remove Barriers to Competition
For the reasons set forth in Paragraph 5, NSWC IHD Contracts Department has no plans at this time to compete future contracts for the types of services covered by this document.
If another potential source emerges, NSWC IHD Contracts Department will assess whether competition for future requirements is feasible. As this is a follow-on for services previously awarded on a noncompetitive basis, in accordance with DFARS 206.104-71, the prior J&A was provided to the approval authority for review. Approval of this J&A signifies the approval authority has made the determination required by
DFARS 206.104-72.
