About this file
This is an Annual Required Affidavit for Bidders, Offerors and Contractors issued by the Commonwealth of Kentucky, effective July 2022, with a maximum affidavit length of one year. The affidavit applies to all bidders, offerors, and contractors seeking state contracts in Kentucky. All bidders and offerors must swear under penalty of perjury that they have not violated Kentucky campaign finance laws under KRS 45A.110 and 45A.115, that they are compliant with subcontractor disclosure requirements under KRS 45A.485, that they are registered with the Kentucky Department of Revenue for sales and use tax collection, that they are not delinquent on state taxes or fees, that they are not engaged in boycotts of entities in jurisdictions with which Kentucky maintains open trade, and that they have not violated prohibitions in KRS 11A.236 during the previous ten years. Additionally, bidders and offerors must affirm that they have not procured a contract while employing an executive agency lobbyist convicted of a crime related to that contract within five years of conviction.
For non-bid contracts including sole-source, not practical or feasible to bid, and emergency contracts, contractors must make additional affirmations regarding campaign contributions. Specifically, neither the contractor nor members of their immediate family with a 10% or greater business interest may have contributed more than the amount specified in KRS 121.150 to the gubernatorial slate campaign. Officers, employees, affiliates, and their spouses may not have contributed more than $5,000 in aggregate to any elected candidate with jurisdiction over the contract award. Additionally, contractors and affiliated entities may not have directly solicited contributions exceeding $30,000 in aggregate for such campaigns. The affidavit requires notarization and must be signed by a duly authorized representative. The Commonwealth retains the right to request updated affidavits at any time and may terminate contracts and pursue additional remedies if non-compliance is discovered.
