About this file
This is an Annual Affidavit for Bidders, Offerors and Contractors required by the Commonwealth of Kentucky under KRS 45A.110 and 45A.115. The affidavit is a mandatory document that must be submitted by any bidder, offeror, or contractor seeking to be awarded a contract or renew an existing contract with the state. An authorized representative of the contracting party must complete the attestation, obtain notarization, and submit the completed affidavit to the Commonwealth. The affidavit remains effective for one year from the date of execution. There are no specific products, services, quantities, response dates, or project timelines identified in this document, as it serves as a general compliance requirement applicable across all state contracts.
The affidavit requires the authorized representative to swear under penalty of perjury that the contractor has not knowingly violated Kentucky's campaign finance laws and that contract award will not violate any provision of such laws. "Knowingly" is defined as awareness or reasonable awareness of a violation's existence. The document requires the bidder or offeror to provide their legal name, address, and Commonwealth of Kentucky vendor code if available. The Commonwealth retains the right to request an updated affidavit at any time during the contract term. The affidavit must be notarized and include the notary's commission expiration date and the state and county where the notarization occurs.
