FAR 52.212-2, ADDENDUM to EVALUATION OF COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
1.1 The Basis of award
The Government anticipates issuing one Firm Fixed Price (FFP), Indefinite Delivery/Indefinite Quantity (IDIQ) contract to the offeror whose proposal provides the best value to the Government in accordance with Federal Acquisition Regulation (FAR) Part 15 (Contracting by Negotiations) To make the award decision, the government will consider three evaluation factors: (1) Technical Approach, (2) Past Performance, and (3) Price. Factor 1 (Technical Approach) is more important than Factor 2 - Past Performance. Non-price factors, when combined, are significantly more important than price.
Factor 1 consists of three subfactors: (1) Technical Capability, (2) Staffing Approach, and (3) Relevant Experience. All three subfactors are of equal importance and will be evaluated independently in accordance with the criteria set forth below.
This weighting reflects the complexity of the requirement and the degree to which offeror capability is expected to vary. Consistent with FAR 15.101-1, the Government may award to other than the lowest-priced offeror; however, award to a higher-priced offeror is appropriate only when the perceived benefits of that proposal are determined to merit the additional cost, with the rationale documented in the award decision. A contract will not be awarded to an Offeror with deficiencies as defined in the solicitation.
Only the evaluation factors identified in this solicitation will be considered in the source selection decision.
For purposes of the best-value tradeoff, the Government will evaluate and compare the total evaluated price of Task Order 1 and the technical merits of the Offeror's overall technical proposal, while also evaluating the proposed IDIQ labor rates for completeness, fairness, reasonableness, and incorporation into the resulting contract.
Note: Section 508 Acceptance
1. Prior to acceptance, the government reserves the right to perform testing on required ICT items to validate the proposal's Section 508 conformance claims. If the government determines that Section 508 conformance claims provided by the offeror represent a higher level of conformance what is actually provided to the agency, the government shall at its option, require the offeror to remediate the item to align with the offeror's original Section 508 conformance claims prior to acceptance.
2. Offerors may be ineligible for contract award if proposed ICT products or services are not compliant with Section 508 standards. Section 508 Acceptance is not an evaluation factor and will not be assigned adjectival ratings or comparatively evaluated among offerors. However, offerors must submit information that is acceptable and compliant with the solicitation requirements. Failure to demonstrate compliance with applicable Section 508 requirements may render a proposal ineligible for award.
Acce ptabl e
Meets the requirements
A proposal will be rated Acceptable when all required Section 508 documentation is submitted and demonstrates compliance with applicable Section 508 requirements, or provides an acceptable remediation approach for identified areas of nonconformance.
Unac cepta ble
Does not meet the requirements
A proposal will be rated Unacceptable when required Section 508 documentation is not submitted or fails to demonstrate compliance with applicable Section 508 requirements.
EVALUATION FACTORS
Proposals will be evaluated based on the following three (3) factors:
Factor 1 - (Technical Approach) -
Factor 1 (Technical Approach) consists of three subfactors. The three Subfactors are of equal importance and will be evaluated independently. The Government will consider the combined results of all three subfactors in assigning the overall Factor 1 rating. The three subfactors are as follows:
Subfactor 1- Technical Capability
The Government will evaluate the Offeror's demonstrated ability to meet the requirements identified in Sections 2.1 through 2.7 of the Performance Work Statement (PWS), including all associated objectives.
Subfactor 2 - Staffing Approach
The Government will evaluate the Offeror's staffing approach, including the proposed methods for recruiting, hiring, onboarding, retaining, and managing personnel;
maintaining continuity of operations; addressing staffing vacancies and transitions; and scaling workforce capacity to meet surge requirements and changing workload demands. The Government will assess whether the approach is clear, realistic, and achievable throughout contract performance.
Subfactor 3- Relevant Experience:
The Government will evaluate the Offeror's demonstrated experience performing requirements similar in scope to those identified in Sections 2.1 through 2.7 of the Performance Work Statement (PWS).
The ratings used for Subfactors1-3 are defined as follows:
Table 1. Technical/Risk Rating Definitions
Color Rating Description
Blue Outsta nding

Purple Good Proposal indicates a thorough approach and understanding of the requirements and contains at least one strength, and risk of unsuccessful performance is low to moderate.
Green Accept able
Proposal indicates an adequate approach and understanding of the requirements and risk of unsuccessful performance is no worse than moderate.
Yellow Margin al

Red Unacc eptabl e
Proposal does not meet requirements of the solicitation, and thus, contains one or more deficiencies, and/or risk of unsuccessful performance is unacceptable. Proposal is unawardable.
The Government will comparatively evaluate proposals under Subfactors 1 through 3 and may assign strengths, weaknesses, and deficiencies.
Factor 2 - Past Performance
Past performance will be evaluated as a measure of the Government's confidence in the Offeror's ability to successfully perform based on prior and current contracts.
The past performance evaluation considers each offeror's recent and relevant record in providing services that meet the contract's requirements.
1. The government will assess past performance both in aggregate and on an individual contract basis when assigning a confidence rating. Information will be obtained from the Offeror's submission and may also include sources such as Contract Performance Assessment Reporting System (CPARS) and Federal Award Performance and Integrity Information System (FAPIIS).
2. Greater consideration may be given to contracts deemed most relevant to the work described in this solicitation. Offerors with no relevant past performance or insufficient information will receive a "Neutral Confidence" rating.
3. Adverse past performance includes any record supporting a less than satisfactory rating or unfavorable comments from any source, including those without a formal rating system.
An assessment of the past performance information will be made to determine if it is recent. To be recent, the effort must be on-going or must have been Recency.
completed within the last three (3) years from the closing date/time of this solicitation. Past performance information outside this period will not be evaluated.
Relevancy. The Government will determine how closely the Offeror's prior work matches the scope of this solicitation. The Government is not bound by the Offeror's assessment of relevancy. Relevancy will be rated for individual contracts, task/delivery orders, or BPA calls submitted for evaluation.
For purposes of determining relevancy, the Government will consider contracts, task orders, delivery orders, or BPA calls that are similar in scope to the requirements of this solicitation.
The ratings used for Factor 2 are defined as follows:
Relevancy Assessment
Adjectival Rating Description
Very Relevant Present/past performance effort involved essentially the same scope of effort this solicitation requires.
Relevant Present/past performance effort involved similar scope of effort this solicitation requires.
Somewhat Relevant Present/past performance effort involved some of the scope of effort this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope of effort this solicitation requires.

Factor 3- Price
The Government will evaluate the proposed IDIQ contract labor rates and Task Order 1 pricing to determine whether pricing is complete, consistent, realistic for the proposed staffing and technical approach, fair, reasonable, and suitable for incorporation into the resulting contract.
For purposes of price comparison among offerors, the Government will evaluate the total evaluated price of Task Order 1.
Evaluation of Options: The Government will evaluate the proposed IDIQ base and option period pricing, including FAR 52.217-8, for completeness, balance, and reasonableness and for incorporation into the resulting contract. The Government's comparative price evaluation for source selection purposes will be based on the total evaluated price of Task Order 1.
The price for the FAR 52.217-8 Option to Extend Services will be evaluated using the final year's proposed pricing for a maximum of six months and will be added to the total evaluated price.
