Section C - Descriptions/Specifications/Statement of Work

C. Statement of Work JUL 2019

1. Short Title: Furniture and Signage Acquisition Services

2. Location: John A. Campbell Courthouse

3. Date: July 18, 2019

4. PROJECT BACKGROUND:

4.A. The Federal District Court, Bankruptcy Court and Probation Office of the Southern District of Alabama (ALS) of the Eleventh Circuit is currently engaged with the General Services Adminis-tration (GSA) in the renovation and alteration of the John Campbell U.S. Courthouse project in Mobile, Alabama. The GSA currently schedules the new courthouse for substantial completion in May 2020, with estimated occupancy of June 2020. In anticipation of the completion and subsequent move into the new facility, the Court plans to enter into a firm fixed price contract with a design builder to provide furniture and interior signage acquisition services.

The services of the furniture and signage acquisition include the preparation of a Furniture Acquis-

ALSBCLERK19-0006 - Page 5 of 22 ition Plan (FAP), a Signage Acquisition Plan (SAP), professional architectural / interior design ser-vices, and project administration services regarding the furniture, furnishings and signage.

4.B. The design builder, also known as “the Contractor” herein, will provide the furniture and signage acquisition services, for relocation for the Courts in the completed project. This will in-clude working with the court to determine what existing furniture in current Court facilities may be reused in the new facility and selecting new furniture to complement the existing furniture. The fur-niture and signage determination, selection process, and assignment of related costs that are re-quired to occupy the new facility, will form the basis of the entire FAP and SAP. In new courthouse construction, the signage is part of the GSA project requirements. The signage in this scope of work (SOW) includes court signage needs outside of the GSA responsibility (e.g., inside the main suites or individual offices, refer to the GUIDE). Note: The FAP and SAP have separate deliverables (refer to Section 5, Specific Tasks).

4.C. All services must comply with the requirements and criteria outlined in the 2007 U.S. Courts Design Guide (USCDG), and in the Guide to Judiciary Policies and Procedures (GUIDE), Volume 16, Chapter 4, Furniture, Appliances and Related Services. Specific exhibits included in Volume 16, Chapter 4 of the GUIDE that are applicable to this Scope of Work (SOW) include the follow-ing (but do not exclude other relevant paragraphs):

4. C.1 Paragraph 420, Furniture Levels and Cost Ceilings

4. C.2 Paragraph 420.20.60, Window Coverings and Flags

4. C.3 Paragraph 430.50, Furniture Acquisitions Exceeding $200,000

4. C.4 Paragraph 440, Chambers Furniture

4. C.3 Paragraph 450, Courtroom Furniture

4. C.4 Paragraph 455 Courthouse Signage

4. C.5 Paragraph 460 Other Equipment

The USCDG is available on the internet and the GUIDE to Judiciary Policies is readily available for review at the office of the Court Clerk. An additional copy of the GUIDE may also be made available for in-house use by the Contractor upon request of the Court POC.

4.D. The court will provide a current inventory of existing furniture that will be provided by the court under a separate cover. As part of the scope, the contractor will inventory and document the existing furniture for reuse or disposition. The contractor shall reference the existing inventory in preparing the furniture selections. The inventory may be included in the furniture acquisition plan document in whole or in part as an appendix to the FAP submission request for funding.

4.E. The FAP will serve as a planning document for establishing furniture needs; as a justification for requesting funds to acquire furniture and fixtures; as a planning tool for furniture move-in and installation; and as a basis for ongoing furniture inventory and management.

4.F. The Contractor will begin the production of the actual FAP (Sections 5.B, 5.C, 5.D, and 5E) in conjunction with the completed inventory. The design services (Section 5.F) overlap this FAP production, as this directly deals with the overall planning, design, and selections for the entire facility. There will be a DRAFT FAP submission - of approximately fifty percent (50%) comple-tion - made to the Court POC for review and comment. Following receipt of Court comments, the Contractor will submit the FINAL FAP.

The development of the SOW for furniture bidding purposes (Section 5.G), bid assistance (Section

5. H), and project administrative services (Section 5. I) follow the FAP production. The SOW and bid assistance tasks will be limited in duration, but the administrative assistance services will con-tinue until furniture is received, placed, and punch list items of damages that may occur, are ad-dressed. The administrative assistance services may extend for a period beyond the occupancy of the building by the court.

ALSBCLERK19-0006 - Page 6 of 22

4.G. The SAP will serve as a planning document for establishing signage needs; as a justification for requesting funds to acquire signage; as a planning tool for signage fabrication and installation;

and as a basis for ongoing signage inventory and management. The Court spaces to receive evalu-ation, planning, and design services include specifications.

4.H. The Contractor will begin the production of the actual SAP (Sections 5. B, 5. C, 5. D, and 5.

E) in conjunction with the completed inventory. The design services (Section 5.F) overlap this SAP production, as this directly deals with the overall planning, design, and selections for Court areas that are outside of the GSA signage responsibilities. There will be a DRAFT SAP submission - of approximately fifty percent (50%) completion - made to the Court POC for review and comment.

Following receipt of Court comments, the Contractor will submit the FINAL SAP. The develop-ment of the SOW for signage bidding purposes (Section 5. G), bid assistance (Section 5. H), and project administrative services (Section 5. I) follow the SAP production. The SOW and bid assist-ance tasks will be limited in duration, but the administrative assistance services will continue until signage is received, placed and punch list items of damages that may occur are addressed. The ad-ministrative assistance services may extend for a period beyond the occupancy of the building by the court.

Section K - Representations, Certifications and Other Statements of Offerors or Respondents

3-20 Certification Regarding Debarment, Suspension, Proposed Debarment, and Other Responsibility Matters

APR 2011

(a) (1) The offeror certifies, to the best of its knowledge and belief, that:

(i) the offeror and/or any of its principals:

(A) are __ are not __ presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any federal agency;

(B) have __ have not __, within the three-year period preceding this offer, been convicted of or had a civil judg-ment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, at-tempting to obtain, or performing a public (federal, state, or local) contract or subcontract; violation of federal or state antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating federal criminal tax laws, or receiving stolen property;

(C) are __ are not __ presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision;

(D) have __ have not __, within a three-year period preceding this offer, been notified of any delinquent federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.

(1) Federal taxes are considered delinquent if both of the following criteria apply:

(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liablity is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial chal-lenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.

(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.

(2) Examples.

(i) The taxpayer has received a statutory notice of deficiency, under I.R.C. § 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should be taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.

(ii) The IRS has filed a notice of federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C.. § 6320 entitling the taxpayer to request a hearing with the IRS Office of Ap-peals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a fi-nal tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the tax-payer has exercised all judicial appeal rights.

(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. § 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.

(iv) The taxpayer has filed for bankrupty protection. The taxpayer is not delinquent because enforced collec-tion action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).

ii. The offeror __ has __ has not, within a three-year period preceding this offer, had one or more contracts ter-minated for default by any federal agency.

(2) "Principal," for the purposes of this certification, means an officer; director; owner; partner; or a person hav-ing primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager; head of a division, or business segment, and similar positions).

ALSBCLERK19-0006 - Page 17 of 22

This certification concerns a matter within the jurisdiction of an agency of the United States and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under 18 U.S.C. § 1001.

(b) The offeror shall provide immediate written notice to the contracting officer if, at any time prior to contract award, the offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.

(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the offeror's responsibility. Failure of the offeror to furnish a certification or provide such ad-ditional information as requested by the contracting officer may render the offeror nonresponsible.

(d) Nothing contained in the foregoing will be construed to require establishment of a system of records in order to render, in good faith, the certification required by paragraph (a) of this provision. The knowledge and inform-ation of an offeror is not required to exceed that which is normally possessed by a prudent person in the ordin-ary course of business dealings.

(e) The certification in paragraph (a) of this provision is a material representation of fact upon which reliance was placed when making award. If it is later determined that the offeror knowingly rendered an erroneous certi-fication, in addition to other remedies available to the judiciary, the contracting officer may terminate the con-tract resulting from this solicitation for default.

(END)

3-30 Certificate of Independent Price Determination JAN 2003

(a) The offeror certifies that:

(1) the prices in this offer have been arrived at independently, without, for the purpose of restricting competi-tion, any consultation, communication, or agreement, with any other offeror or with any competitor relating to:

(A) those prices;

(B) the intention to submit an offer; or

(C) the methods or factors used to calculate the prices offered.

(2) The prices in this offer have not been and will not be knowingly disclosed by the offeror, directly or indir-ectly, to any other offeror or contract award unless otherwise required by law; and

(3) no attempt has been made or will be made by the offeror to induce any other concern to submit or not to submit an offer for the purpose of restricting competition.

(b) Each signature on the offer is considered to be a certification by the signatory that the signatory:

(1) is the person in the offeror's organization responsible for determining the prices in this offer, and that the signatory has not participated, and will not participate, in any action contrary to paragraphs( (a)(1) through (a)(3) of this provision; or

(2) (i) has been authorized, in writing, to act as agent for the following principals in certifying that those prin-cipals have not participated, and will not participate, in any action contrary to paragraphs (a)(1) through (a)(3) of this provision…
