SPECIAL NOTICE

USDA, Farm Service Agency, Commodity Operations

Notice Announcing the Requirement to Identify Physical Plant Locations When Offering to Provide Commodities for International Food Aid Procurements

In order to enhance food security and provide greater transparency in the international food aid procurement process, effective April 1, 2011, the Government will require that offerors identify in their offers the plant location from which commodities will be delivered Intermodal Plant, Intermodal Bridge, and f.a.s. vessel in performance of any resulting contract. The Government will no longer accept offers stipulating delivery from an offeror’s bid point of “Shipper’s Option,” nor will it accept offers that do not accurately identify the plant locations from which products are to be shipped, e.g., corporate headquarters locations.

With respect to procurements of packaged and bulk commodities, the offeror shall accurately represent the offeror’s plant location and shall meet the definition of “plant” (included at the bottom of this notice) which will be incorporated into the terms of the solicitation and contract.

This location shall constitute the plant location from which the supplies are delivered on an Intermodal Plant, Intermodal Bridge, f.a.s. vessel, or f.o.b. vessel basis. Upon the Government’s acceptance of an offer, the plant location specified in the offer becomes a contract term and the contractor is required to perform out of that plant location. Failure to perform out of the offered plant location will constitute a default under the terms of the contract.

Potential offerors are cautioned to ensure the specific plant location from which the offeror will deliver the commodity is selected in the bidding process. If an offeror intends to utilize a plant location not already established in the USDA electronic bidding system, promptly contact one of the following Contract Specialists to coordinate the creation of an entity code for the particular plant location:

The Government will not be responsible for the failure of an offeror to allow sufficient time to establish an entity code for a plant location prior to a solicitation’s deadline for submission of bids.

Plant location and the Place of Performance in Online Representations and Certifications Application (ORCA) provisions shall match. ORCA is available online at http://www.bpn.gov/.

The following definition of “plant” will be included in all commodity solicitations issued after April 1, 2011.

“Plant” is defined as the prime contractor’s or subcontractor’s facility where an agricultural commodity is made or processed from raw materials into the finished product, or assembled from components, or packaged as provided in the contract specifications, or warehoused after processing/assembling/packaging; and from which the supply is delivered Intermodal Plant, Intermodal Bridge, f.a.s. vessel, and/or f.o.b. vessel in performance of the contract. It is understood that an offeror’s plant location in an offer represents the offeror’s plant as defined in this section.

Questions regarding this notice should be directed to the Contract Specialist noted above.
