12/20/2016
631 Coyote Street, Nevada City, CA 95959
NAICS 337214
It is the intent of this agency to award a sole source contract under the statutory authority
10 USC 2304(c)(1), set forth in Federal Acquisition Regulation 6.302-1, only one responsible source and no other services will satisfy agency requirements. This agency intends to award to CAL PIA, Folsom, CA
“JUSTIFICATION FOR OTHER THAN FULL AND OPEN COMPETITION”
The statutory permitting other than full and open competition is contained in Subpart 6.3 of the Federal Acquisition Regulations.
(1) Identification of the agency and the contracting activity
USFS, Tahoe National Forest, Grass Valley Interagency Command Center
13120 Loma Rica Dr., Grass Valley CA 95945
(2) Nature-Description of the Action
The Tahoe National Forest in partnership with CAL FIRE Nevada Yuba Placer Unit intends to purchase ergonomic sit-stand office furniture with Electrostatic Discharge
(ESD) desktops and accessories through the Department of Corrections Prison Industry
Authority (PIA). CAL FIRE, a California State agency and our interagency partner at the
Grass Valley Interagency Command Center, is required to purchase their Emergency
Command Center furniture of this kind through PIA.
The ergonomic sit-stand furniture with Electrostatic Discharge desktop surfaces is being purchased as part of the Grass Valley Interagency Command Center furniture upgrade project. The entire project must be completed by spring 2017, prior to fire season. This project has been planned for two years and has already begun with the purchase and install of an upgraded radio system and equipment in the spring of 2016.
CAL FIRE paid to upgrade 2 Forest Service radio systems, and the Forest Service purchase 2 additional radio systems to assist with improving services to Forest employees and resources. The Grass Valley Command Center is a Forest Service facility and in 1989
CAL FIRE moved to this facility and became the Grass Valley Interagency Command
Center. This facility services the Tahoe National Forest Nevada Yuba Placer CAL FIRE
Unit, a majority of local government fire and EMS entities with in the NEU
Administrative Unite, and also serves as the OES Region 4 dispatch center.
CAL FIRE has already purchases and taken ownership of 6 ergonomic sit/stand furniture stations with Electrostatic Discharge desktop surfaces. Forest Service is wanting to purchase 4 ergonomic sit-stand furniture stations with Electrostatic Discharge desktop surfaces. CAL FIRE will provide all technical engineering services for the project including infrastructure labor costs. Forest Service has agreed to purchase static resistant carpet.
(3) Description of supplies or services required to meet the agencies need, including the estimated value:
Ergonomic sit-stand furniture with Electrostatic Discharge (ESD) desktops and accessories need to be purchased and installed as a part of the interagency radio replacement/remodel project. Due to the extended hours that the dispatchers are required to remain at their work stations, sit-stand furniture is incorporated as part of the design concept of all new dispatch facilities as well as the remodel/retrofit of existing Command
Centers. Electrostatic Discharge products such as desktop surfaces and flooring are key components in high volume emergency communications centers to protect the investment of radios, computers, monitors, and other electronics.
Estimated cost to Forest Service of PIA furniture is $60,090.93
(4) An identification of the statutory authority permitting other than full and open competition.
(The appropriate portion of FAR 6.302, including any additional information that is required by the authority cited):
FAR 6.302-1 – Only one responsible source and no other supplies or service will satisfy requirements for ergonomic sit-stand furniture with Electrostatic Discharge (ESD) desktop surfaces; Department of Corrections Prison Industry Authority (PIA) CAL FIRE has the technical expertise and has done the research to develop standards and specifications for high volume emergency communication centers. It is advantageous to the Forest Service to embrace these standards and specifications to protect the equipment and property investment in radios, consoles, monitors, computers, etc.
The furniture specified is unique in nature to Department of Corrections Prison Industry
Authority and the intricacy of this project.
(5) A demonstration that the proposed contractor’s unique qualification or the nature of the acquisition requires use of the authority cited:
Project Description:
This furniture is being purchased as part of the Grass Valley furniture upgrade project. The projected in-service date is fall 2016 and is time sensitive in order to be completed by Spring fire season of 2017.
The fore mentioned electrical and cabling plans were developed utilizing the PIA furniture with the drop pole configuration The PIA furniture includes the cabling and electrical components within the ergonomic sit-stand furniture with Electrostatic Discharge (ESD) desktop surfaces. If the furniture configuration and foot print changes, the electrical and cabling plan will become invalid.
CAL FIRE’s research and technical expertise includes the PIA furniture as a design concept for the project. The use of the PIA furniture was part of the oval design concept and specification. To use another manufacturer for the furniture at this point would not only result in a delay of the project; it would require redesign of the entire project. The Forest Service does not have the additional funding or personnel available to accomplish this.
CAL FIRE providing the Project Manager and labor to pull the reinstall all radio, voice, and data cabling for this project. The Forest Service has agreed to assist with the movement of Moducom radios, cable and other accessories. The government benefits from having an experienced project manager that is solely dedicated to this project at no cost to us. This results in a substantial savings of funds and personnel time to the government.
CAL FIRE’s Emergency Communication Center Facilities Project Manager services are being provided by CAL FIRE to this project. Jonathan Wilkes has at least 15 years of project management experience. His experience and technical skills in radio installation, design/remodel/retrofit, and overall project management is invaluable to the success of this project. He has direct experience in emergency communication center facilities, radio/voice/data technologies, data and power requirements, space limitations, and anticipated workload requirements.
PIA offers a warranty period of fifteen years on the PIA furniture, as well, as a five year warranty on the electrical and other components.
PIA’s cost estimate includes taking apart of the old Grass Valley Interagency Command Center furniture and then putting together the new furniture.
(6) A description of the efforts made to ensure that offers are solicited from as many potential sources as is practical, including whether a notice was or will be publicized as required by
Subpart 5.2 and, if not, which exception under 5.202 applies:
A Market Survey was conducted in accordance with FAR Part 10 to determine if there were other sources that offered the product as well as the service that would be provided by PIA.
(7) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted:
(8) Any other factor supporting the use of other than full and open competition:
See Section (5) above. The interagency nature of this project lends toward complying with our CAL FIRE interagency partner’s furniture purchasing requirements for several reasons:
1. The Forest Service does not have the resources in house or via contract to provide Architect and
Engineering (A&E) services. Ordering the furniture from another source would require completing new engineering designs. This would increase the cost and delay the project substantially.
2. If this project is not completed on time funding will be lost by both agencies.
3. The design specifications which includes the furniture is incorporated as a part of all new high volume Emergency Communication Centers and the retrofit/remodel of existing high volume
Emergency Communication Centers. Therefore, it is critical to the success of this multifaceted project that the sit-stand ergonomic furniture with Electrostatic Discharge (ESD) desktop surfaces is purchased from the Department of Corrections, Prison Industry Authority (PIA) and is in the best interest of the government.
4. It is imperative to eliminate delays in the project and complete the project within budget and time constraints. This project has a limited window of November 2016 through March 2017 and must be completed prior to fire season because of public/firefighter safety business of the Grass
Valley Interagency Command Center. Failure to complete this project will limit Grass Valley
Interagency Command Center in our capability to support the initial attack firefighting efforts and emergency medical dispatching for the Tahoe National Forest, Nevada Yuba Placer CAL FIRE
Unit, local government fire and EMS entities, and OES Region 4. The furniture is one phase of a multi-faceted project that replaces outdated radio equipment and furniture that is past its life cycle. This affects the entire operations for Grass Valley Interagency Command Center
(9) A listing of the sources, if any that expressed in writing, an interest in the acquisition.
Prison Industry Authority – State of California
Other companies
(10) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required
A Notice will be publicized through the GPE in accordance with FAR 5.202 and FAR
6.302-1 prior to purchase. Any responses will be reviewed to ensure that the proposed contractor is truly the only source that will meet the requirements of this project
