SECTION C – STATEMENT OF WORK
Performance-Based Statement of Work
2017 San Jacinto Ranger District, San Bernardino National Forest Habitat Assessments for Quino checkerspot Butterfly
1.0 SCOPE OF THE CONTRACT
1.1 Purpose
The US Forest Service has need for the following critical field work to be completed in the 2017, 2018, and 2019 flight season for the Quino checkerspot butterfly (Quino), by a qualified technical expert. Work on this project will require previous experience and ability to utilize the Natural Resources Manager (NRM) Wildlife database. This information will be used by the SBNF for project planning and for contributing the long-term dataset of occupancy and reproduction of this species on the SBNF.
1.2 Contract Scope
The contractor will perform habitat assessments for, and document opportunistic detection of Quino, in compliance with the contract terms, specifications, and provisions. This includes furnishing labor, equipment, supervision, transportation, operating supplies, and incidentals not otherwise provided by the government. If funding is available, an option to conduct surveys in 2018 and 2019 may be used.
2.0 PROJECT AREA AND LOCATION
All contract areas are located on the San Bernardino National Forest. The survey locations occur in the San Jacinto Mountains of the San Jacinto Ranger District, San Bernardino National Forest.
3.0 ACCESS
All work areas may be reached by driving on standard Forest Service roads, by driving on four-wheel drive roads, and/or by walking. Walking distances will vary by survey location. The Government will not provide special maintenance or snowplowing to keep roads open. The Government will provide gate keys to the contractor, if needed, to be returned upon completion of work.
4.0 REQUIREMENTS AND LIMITATIONS
4.1 Equipment and Certifications
Contractor will supply all equipment necessary for protocol surveys as listed described in Exhibit 8.2. Equipment includes but is not limited to: vehicles, cell phone, USGS topo maps, flagging, binoculars, field guides, GPS units, survey forms, field notebooks, clipboard and permanent waterproof ink pen and other appropriate writing utensils for recording data, aerial photographs, and all required survey permits from the US Fish and Wildlife Service (ESA section 10 permit to survey for Quino checkerspot butterfly) and/or the California Department of Fish and Wildlife.
4.2 Surveyor Qualifications
Proposed surveyors must provide at least three references with phone numbers or email of previous clients who can verify the surveying biologist’s knowledge of Quino field biology and expertise in surveying for this species. If expertise cannot be verified, bids will not be considered.
4.3 Pre-Work Meeting and Coordination
A pre-work meeting with the SBNF wildlife biologists, and Contracting Officer’s Representative (COR) at the San Jacinto Ranger District, Idyllwild, CA, will be mandatory.
Unless otherwise stated, the Contractor’s project leader shall communicate with the COR first. The COR will relay requests/information to Forest Service personnel and will inform the Contractor as to when they can contact Forest Service specialists without going through the COR.
5.0 QUINO CHECKERSPOT BUTTERFLY HABITAT ASSESSMENT STANDARDS
5.1 Methods
All data will be collected in a professional standard, and in accordance with the USFWS 2014 Quino Checkerspot Survey Protocol and additional criteria in Section 5.2. Contractor shall coordinate with the USFWS Recovery Permit Coordinator 15 days prior to starting surveys and throughout the duration of surveys, in accordance with Section 10 permit requirements and with the USFWS 2014 Quino Checkerspot Survey Protocol.
Work is to proceed from mid-May to mid-September. Exact dates may vary depending on:
Access due to weather conditions; and Annual flowering periods for plants that are to be surveyed for in the survey units, which can vary locally depending of timing of rainfall.
5.2 Survey Documentation
Document surveys in the following manner:
a. A daily journal entry shall be completed for each site visit.
b. Visit pre-determined areas to determine if host plants are present.
c. Document host plant occurrences and any opportunistic sightings of Quino with GPS, camera and notes.
d. Determine whether area warrants Quino protocol occupancy surveys.
e. Document all occurrence information with GPS, camera, notes etc.
f. Completed NRM Wildlife Data Form – Wildlife Observation Tab (Exhibit 8.5). This tab must include the list of animals observed during each survey that meet one or more of the following: 1) target species – Quino; 2) Forest Service Sensitive Species; 3) any other federally- or state-listed wildlife species, and 4) wildlife sited of interest observed including raptor nests, animal dens, breeding sites, etc.; 5) non-native plants or animals.
Refer to Exhibit 7.3 for Forest Service Special Status Wildlife species.
g. Completed NRM Wildlife Data Form – Visit Tab (Exhibit 8.5). Record all survey data for every survey, including surveys for which no Quino were detected.
h. Completed NRM Wildlife Data Form – Sites Tab (Exhibit 8.5). Record all site data.
i. Completed CNDDB forms for each California special animal
(http://www.dfg.ca.gov/biogeodata/cnddb/pdfs/SPAnimals.pdf) and its location with dates each was observed (Exhibit 8.1).
j. A written report on findings that minimally includes:
i. Summary of each survey conducted (date, surveyor, ambient weather, etc.);
ii. Embed representative photos of occupied/unoccupied habitat into the written report.
iii. Summary of findings (survey efforts, habitat quality, and opportunistic Quino sightings).
iv. Incidental species list and locations for all other wildlife species noted in the area
(including common species).
v. If non-native plants or animals are observed during surveys, the report will contain an appendix table with the names, locations and dates. Embedded photographs should be included if possible.
vi. Coordinates of target species/habitat observation locations, if any, and behavior.
vii. Copies of raw field notes taken during surveys.
viii. A discussion of assessment results and comparison to past condition and/or occupancy at the same sites.
ix. All habitat assessment findings, to the specifications required by the USFWS 2014 Quino Checkerspot Survey Protocol.
x. Electronic copies of final maps and GIS layers of information collected that document all findings with the Final Report, which shall be due within 45 days of the final survey.
6.0 DELIVERABLES
6.1 Weekly Coordination
Phone calls shall be held at least weekly during the field season between the Contractor and the COR (or COR designee) to discuss work completed to date. During each weekly phone call the Contractor shall address the following:
1. Quino observations, if any, habitat and conditions found, areas surveyed, and any new Quino habitat locations encountered.
2. Any problems encountered during survey.
3. Suggestions.
4. Results and status of surveys and if on schedule.
6.2 Report of Findings
A draft report will be provided by November 1. A final report based on Forest Service review and comments on the Draft will be completed by December 31.
6.3 Deliver To
All deliverables will be delivered to Ann Bowers, District Wildlife Biologist, San Jacinto Ranger District, 54270 Pine Crest Rd P.O. Box 518, Idyllwild, CA 92333 by mail or in person.
6.4 Deliverables
6.4.1 Three spiral-bound reports with the following chapters:
a) All findings made in accordance with the required Survey Documentation in Section 5.2, above, to the specifications required by the USFWS 2014 Quino Checkerspot Survey Protocol;
b) Copies of all raw field notes and journal entries;
c) Completed Forest Service NRM Wildlife Electronic Data forms in table format as described in 5.2 (b, c, and d)
d) All Completed CNDDB forms for California wildlife species of interest observed;
e) A written final report summarizing all findings;
6.4.2 Two copies of CDs or two flash-drives with items a-e as listed in 6.4.1. The CD/flash drive should additionally include:
a) A folder with all photographs (in jpg format) that are embedded in the Final Report.
b) Electronic copies of final maps and GIS layers of information collected that document all findings with the Final Report
c) The final report, as described in 6.4.1e, in a pdf format and a Microsoft Word document format.
d) Forest Service NRM Wildlife Electronic Data Form spreadsheet with each tab fully completed.
6.5 Format
Format of deliverables will all be printed in 12 point Times New Roman font type and digital on disk or thumb drive (3 disks/thumb drives to be included).

SECTION D – Packaging and Marking
Payment of Postage and Fees All postage and fees related to submitting information including submittals, forms, reports, etc., to the Contracting Officer or the Contracting Specialist shall be paid by the Contractor.
Correspondence/Submittals Contractor initiated correspondence and submittals shall identify the contract number. All information shall be forwarded to the addresses found in Section G. Correspondence shall be provided in duplicate and mailed to the Contracting Officer (CO). Submittals shall be submitted to the Contracting Officer Representative (COR) with a duplicate copy of the cover letter forwarded to the CO.
SECTION E – INSPECTION AND ACCEPTANCE
E.1.0 INSPECTION
E.1.1 Completed copies of Survey Area Detailed Maps, and GPS data shall be submitted to the COR by the Contractor within 14 days of completion.
E.1.2 On-the-ground field inspections: The COR will conduct on-the-ground field inspections of each Survey Area to evaluate the work quality and insure compliance with all contract specifications. On-the-ground inspections will focus on, but are not limited to, compliance with flagging protocols, and adherence to environmental thresholds and survey quality.
E.1.3 Inspection of Documentation: Survey schedules, and changes to the schedules, may be used to verify survey timing meets requirements for Quino host species. Survey Forms must be legible, accurate, and complete. In addition, Survey Area Detail Maps must accurately and legibly, reflect detection data recorded on visit forms.
Submitted GPS information will be used to verify station visit dates.
E.2.0 WORK QUALITY
E.2.1 All work must be completed to the protocol standards as described in the most current version that are released during the life of the contract, and to the standards described above.
E.2.2 All required documentation must be properly completed before acceptance.
E.2.3 Unsatisfactory Work Quality
E.2.3.1 Incomplete, illegible, contradictory, or otherwise unsatisfactory documentation will be returned to the Contractor for rework.
E.2.3.2 If the survey coverage is found not to be in accordance with the Performance Work Statement (PWS), the Contractor will be required to perform additional surveys in the units (Exhibit 7.1), following inspection, in order to bring the overall survey effort in compliance with PWS. If surveys do not meet the requirements of the PWS due to contractor error, corrective surveys shall be conducted at the cost to the Contractor.
E.2.3.3 Inspection will occur within one week after completion. The COR shall notify the Contractor within 2 business days if inspection reveals the need for rework.
E.3.0 PAYMENT
E.3.1 Payment will be made for the surveys required to complete the PWS at the unit price as stated in the contract.
Each invoice shall be billed to the appropriate task order.
E.3.2 Final payment under the contract will not be made until all required products are submitted and accepted and any Government-supplied items have been returned to the COR.
E.3.1 A request for partial payments may be submitted at the end of each month for the duration of the contract.
Partial payment will be based on the completion of field work and the completion of all paperwork for the completed field work that is submitted and accepted as satisfactory by the COR.
E.3.2 Final payment will be made once the final report (see Section C 5.2) is received and accepted. The final report can only be submitted after all surveys are completed and all paperwork for completed surveys is submitted and accepted.

SECTION F – DELIVERIES OR PERFORMANCE
F.1.0 PERIOD OF PERFORMANCE
The contract shall commence from date of award for a period up to three (3) years if options are exercised.
F.2.0 PROGRESS PLAN
At the pre-work conference, the Contractor shall provide to the COR a written ‘work progress plan’ that details the Contractor’s proposed plan of work and schedule to provide for orderly completion of the work within the contract performance time. This work schedule must be acceptable to the Government. At a minimum, the schedule must reflect a work progress rate equal to the available amount of contract performance time.
F.3.0 REPORTING REQUIREMENTS
The Contractor shall submit all the required deliverables or outputs to the COR as specified in Section G.

SECTION G -- CONTRACT ADMINISTRATION DATA
G.1.0 TECHNICAL DIRECTIONS
(a) Technical Directions is defined to include:
(1) Written directions to the contractor which fill in details, suggest possible lines of inquiry, or otherwise facilitate completion of work;
(2) Provision of written information to the contractor which assists in the interpretation of maps or drawings, specifications, or technical portions of the work statement;
(3) Review and, where required, provide written approval of technical reports, maps or drawings, specifications, or technical information to be delivered. Technical directions must be in writing, and must be within the scope of the work as detailed in Section C.
(b) The COR is authorized by designation to take any or all action with respect to the following which could lawfully be taken by the Contracting Officer, except any action specifically prohibited by the terms of this Contract:
(1) Assure that the contractor performs the technical requirements of the contract in accordance with the contract terms, conditions, and specifications.
(2) Perform or cause to be performed, inspections necessary in connection with a) above and require the contractor to correct all deficiencies; perform acceptance for the Government.
(3) Maintain all liaison and direct communications with the contractor. Written communications with the contractor and documents shall be signed as "COR" with a copy furnished to the Contracting Officer.
(4) Issue written interpretations of technical requirements of Government drawings, designs, and specifications.
(5) Monitor the contractor's production or performance progress and notify the contractor in writing of deficiencies observed during surveillance, and direct appropriate action to effect correction. Record and report to the Contracting Officer incidents of faulty or nonconforming work, delays or problems.
(6) Obtain necessary security clearance and appropriate identification if access to Government facilities is required. If to be provided, ensure that Government furnished property is available when required.
Limitations: The COR is not empowered to award, agree to, or sign any contract (including delivery or purchase orders) or modifications thereto, or in any way to obligate the payment of money by the Government. The COR may not take any action which may impact on the contract schedule, funds, or scope of the contract. All contractual agreements, commitments, or modifications which involve prices, quantities, quality, and schedules shall be made only by the Contracting Officer.
(c) The COR is required to meet as needed with the contractor and the Contracting Officer concerning performance of items delivered under this contract and any other administration or technical issues. Telephonic reports may be made if no problems are being experienced. Problem areas shall be brought to the immediate attention of the Contracting Officer.
(d) In the absence of the designated COR, the separate letter will determine who has authority to act as COR in the absence of the COR. The Contracting Officer has the authority to designate a temporary or new COR through a separate letter.
(e) Contractual Problems - Contractual problems, of any nature, that may arise during the life of the contract must be handled in conformance with specific public laws and regulations (i.e. Federal Acquisition). The contractor and the COR shall bring all contracting problems to the immediate attention of the Contracting Officer. Only the Contracting Officer is authorized to formally resolve such problems. The Contracting Officer will be responsible for resolving legal issues, determining contract scope and interpreting contract terms and conditions. The Contracting Officer is solely authorized to approve changes in any of the requirements under this contract. These changes include, but will not be limited to the following areas: scope of work, price, quantity, technical specifications, delivery schedules, and contract terms and conditions. In the event the contractor effects any changes at the direction of any person other than the Contracting Officer, the change will be considered to have been made without authority and at the contractor's sole risk.
(f) Failure by the contractor to report to the Contracting Officer any action by the Government considered to be a change, waives the contractor's right to any claims for equitable adjustments.
Nothing herein shall give the Government the right to direct the work in any way that would interfere with the scientific independence or integrity of the Contractor.

G.3.0 CONTRACTOR PERFORMANCE ASSESSMENT REPORTING SYSTEM (JULY 2010)

(a) FAR 42.1502 directs all Federal agencies to collect past performance information on contracts. The Department of Agriculture (USDA) has implemented the Contractor Performance Assessment Reporting System (CPARS) to comply with this regulation. One or more past performance evaluations will be conducted in order to record your contract performance as required by FAR42.15.
(b) The past performance evaluation process is a totally paperless process using CPARS. CPARS is a web-based system that allows for electronic processing of the performance evaluation report. Once the report is processed, it is available in the Past Performance Information Retrieval System (PPIRS) for Government use in evaluating past performance as part of a source selection action.
(c) We request that you furnish the Contracting Officer with the name, position title, phone number, and email address for each person designated to have access to your firm's past performance evaluation(s) for the contract no later than 30 days after award. Each person granted access will have the ability to provide comments in the Contractor portion of the report and state whether or not the Contractor agrees with the evaluation, before returning the report to the Assessing Official. The report information must be protected as source selection sensitive information not releasable to the public.
(d) When your Contractor Representative(s) (Past Performance Points of Contact) are registered in CPARS, they will receive an automatically-generated email with detailed login instructions. Further details, systems requirements, and training information for CPARS is available at http://www.cpars.csd.disa.milJ. The CPARS User Manual, registration for On Line Training for Contractor Representatives, and a practice application may be found at this site.
(e) Within 60 days after the end of a performance period, the Contracting Officer will complete an interim or final past performance evaluation, and the report will be accessible at http://www.cpars.csd.disa.mil/. Contractor Representatives may then provide comments in response to the evaluation, or return the evaluation without comment. Comments are limited to the space provided in Block 22. Your comments should focus on objective facts in the Assessing Official's narrative and should provide your views on the causes and ramifications of the assessed performance. In addition to the ratings and supporting narratives, blocks 1 - 17 should be reviewed for accuracy, as these include key fields that will be used by the Government to identify your firm in future source selection actions.
If you elect not to provide comments, please acknowledge receipt of the evaluation by indicating ''No comment" in Block 22, and then signing and dating Block 23 of the form. Without a statement in Block 22, you will be unable to sign and submit the evaluation back to the Government. If you do not sign and submit the CPAR within 30 days, it will automatically be returned to the Government and will be annotated: "The report was delivered/received by the contractor on (date). The contractor neither signed nor offered comment in response to this assessment." Your response is due within 30 calendar days after receipt of the CPAR.
(f) The following guidelines apply concerning your use of the past performance evaluation:
(1) Protect the evaluation as "source selection information." After review, transmit the evaluation by completing and submitting the form through CPARS. If for some reason you are unable to view and/or submit the form through CPARS, contact the Contracting Officer for instructions.
(2) Strictly control access to the evaluation within your organization. Ensure the evaluation is never released to persons or entities outside of your control.
(3) Prohibit the use of or reference to evaluation data for advertising, promotional material, pre-award surveys, responsibility determinations, production readiness reviews, or other similar purposes.
(g) If you wish to discuss a past performance evaluation, you should request a meeting in writing to the Contracting Officer no later than seven days following your receipt of the evaluation. The meeting will be held in person or via telephone or other means during your 30- day review period.
(h) A copy of the completed past performance evaluation will be available in CPARS for your viewing and for Government use supporting source selection actions after it has been finalized.

G.4.0 ELECTRONIC INVOICING AND PAYMENT REQUIREMENTS – INVOICE PROCESSING PLATFORM
(IPP)
Payment requests must be submitted electronically through the U.S. Department of the Treasury’s Invoice Processing Platform System (IPP). “Payment request” means any request for contract financing payment or invoice payment by the Contractor. To constitute a proper invoice, the payment request must comply with the requirements identified in the applicable Prompt Payment clause included in the contract, or the clause 52.212-4 Contract Terms and Conditions – Commercial Items included in commercial item contracts. The IPP website address is:

Under this contract, the following documents are required to be submitted as an attachment to the IPP invoice
1. Invoice billed according to contract line items and rates.
2. If final payment is billed, the last invoice shall state “FINAL”.
The Contractor must use the IPP website to register access and use IPP for submitting requests for payment. The Contractor Government Business Point of Contract (as listed in SAM) will receive enrollment instructions via email from the Federal Reserve Bank of Boston (FRBB) prior to the contract award date, but no more than 3 – 5 business days of the contract award date. Contractor assistance with enrollment can be obtained by contacting the IPP Production Helpdesk via email ippgroup@bos.frb.org or phone (866) 973-3131.
If the Contractor is unable to comply with the requirement to use IPP for submitting invoices for payment, the Contractor must submit a waiver request in writing to the Contracting Officer with its proposal or quotation.

SECTION H – SPECIAL CONTRACT REQUIREMENTS
H.1.0 WORK HOURS
Contractor may manage the timing of work in accordance with the provisions of the USFWS 2014 Quino Checkerspot Survey Protocol as it relates to target species or habitat surveys, or both, if applicable. Due to weather-dependent requirements for surveys, work may be conducted on Saturday, Sunday, and Federal holidays as needed.
H.1.0 SAFETY REQUIREMENT
a. The Contractor shall have the ultimate responsibility for safety at all times while in the course and scope of completing all tasks required under the PWS until final completion and acceptance of the project.
b. The Contractor shall comply with all Occupational Safety and Health Administration (OSHA) regulations, as found in 29 CFR 1910 and 1926, that are applicable to the PSW, including requirements set forth within solicitation provisions and contract clauses. In addition to OSHA safety standards, the Contractor shall also adhere to all current local, federal, and state safety requirements. In the event where any safety standard referenced herein conflicts with another, the more stringent shall govern.
c. The Contractor shall initiate and maintain an effective safety program that provides adequate systematic policies, procedures, and practices to protect themselves and/or their employees from and allow them to recognize, job-related safety and health hazards. The program shall include provisions for the systematic identification, evaluation, prevention and control of general work site hazards, specific job hazards, and potential hazards that may arise from foreseeable circumstances during performance of the PSW. Any employees of Contractor must be instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the work environment.
d. The Contractor shall immediately notify the CO of any accident, incident, or exposure resulting in a fatality, lost-time injury, or property loss/damage of $2,500 or more arising out of work performed under this contract.
e. In the event of an accident/incident, the Contractor shall be responsible for providing and obtaining appropriate medical and emergency assistance. Except for rescue and emergency measures, the scene of the accident/incident shall not be disturbed or the operation resumed until the on-site aspect of the investigation has been completed.
f. Service safety personnel and representatives from Federal, State, and local government agencies shall have the right to examine and conduct an investigation at sites or areas where work under this contract is being performed.
The absence of such investigations shall not relieve the contractor of their safety program responsibilities.
H.2.0 ENVIRONMENTAL INTERRUPTION OF WORK
H.2.1 Environmental - The Contracting Officer, by issuance of a suspend work order, may direct the Contractor to shut down any work that may be subject to damage due to weather conditions, fire danger, or because it is impracticable to work during the winter season. The Contractor will be given a resume work order which will document the date the work suspension ends. An allowance has been included in the contract time for all environmental delays. The count of contract time will therefore continue during all periods of suspension due to normal weather conditions, including fire danger. The Contractor will not be entitled to additional contract time for any suspensions except to the extent that they are due to unusually severe weather conditions. The Contractor will not be entitled to additional monetary compensation for such suspensions regardless of duration.
H.3.0 PRESERVATION OF HISTORICAL AND ARCHEOLOGICAL DATA
H.3.1 The Contractor agrees that should any contractor employee, in the performance of this contract, discover evidence of possible scientific, prehistorical, historical, or archeological data the contractor will notify the Contracting Officer immediately in writing giving the location and nature of the findings.
H.3.2 Where appropriate by reason of discovery, the Contracting Officer may order delays in the time of performance and/or changes in the work. If such delays and/or changes are ordered, the time of performance and contract price shall be adjusted in accordance with the applicable clauses in the Contract Clauses Section of this contract.
H.3.3 The Contractor agrees to insert this requirement in all subcontracts which involve the performance of work on the terrain of the site.
H.4.0 ENVIRONMENTAL IMPACT
All waste materials generated by any work under the contract performed on Government property shall at all times be handled, transported, stored, and disposed of by the contractor and by his subcontractors in accordance with all applicable Federal, state, and local laws, ordinances, regulations, court orders, and other types of rulings having the effect of the law, including, but not limited to Executive Order 12088, 13 October 1978, Federal Compliance with Pollution Control Standards; the Federal Water Pollution Control Act, as amended (33 U.S.C. 1251 ET SEQ); the Clean Air Act as amended (42 U.S.C. Sec 7401 ET SEQ); the Endangered Species Act, as amended (16 U.S.C. Sec 1531, ET SEQ); the Toxic Substances Control Act, as amended (15 U.S.C. Sec 2601, ET SEQ); the National Historic Preservation Act, as amended (16 U.S.C. Sec 470, ET SEQ); the Solid Waste Disposal Act, as amended (42 U.S.C. 6901 ET SEQ); and the Archaeological and Historic Preservation Act, as amended (16 U.S.C. Sec 469, ET SEQ). Should the United States Government be held liable for any neglect or improper actions by the contractor or any subcontractor regarding removal or disposal of any hazardous waste, the contractor shall reimburse the Government for all such liability.
H.4.0 ANIMAL CARE AND USE
All care and use of animals under this contract shall be in accordance with all applicable laws and regulations of the United States and of the State of California and performed under a valid permit issued for this purpose.
H.5.0 HAZARDOUS MATERIALS
Any material suspected of being hazardous that is encountered during performance of a project shall immediately be brought to the attention of the Contracting Officer, at which time a determination will be made as to whether hazardous material testing shall be performed. Contractor is not responsible for handling, testing, or identification of potentially hazardous materials.

H.7.0 RESTORATION OF RESOURCES
H.7.1 Cleanup - The Contractor is responsible for cleaning up all camp and worksites before leaving the area. Final payment or other alternative deemed feasible may be withheld until the Contractor has complied with this requirement.
H.8.0 UNAUTHORIZED PERSONNEL
The contractor shall inform all personnel working under his jurisdiction (including subcontractors and any other personnel) that access to restricted areas will be limited to official business only. Persons in violation of the above will be apprehended and appropriately disciplined.
