SECTION C--DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

Scope of Contract

This solicitation and resulting contract is for the demolition and disposal of an existing wood deck structure and staircase, and the design and construction of a new steel deck structure, staircase, and steel railing to meet ADA/ABA Accessibility Guidelines. The purpose of the deck structure and stairway is to serve as a fire exit from the second floor of the Placerville Nursery’s Seed Extractory Building. One accessible door and one sliding door lead out onto the deck. The deck to be replaced measures 6’-7” by 41’-4”. The deck sits 11 feet above grade. The hand and stair rails shall wrap around the deck, new stairs and existing concrete landing and stairs. The work will also include replacing five missing or damaged gutter downspouts.

Project Location

The project is located at the U.S. Forest Service Nursery at 2375 Fruitridge Rd., Camino, CA 95709. Take Highway 50 East from Sacramento to Placerville. In Placerville exit Schnell School Road and head North. At stop sign turn right on Carson Road. In about 2 miles turn left on Union Ridge Road. Turn right onto Hassler Road. Take first right on Fruitridge Road. The Placerville Nursery will be on your left.

NOTE: Any prospective bidder desiring an explanation or interpretation of the solicitation, drawings, specifications, etc., must request it in writing soon enough to allow a reply to reach all prospective bidders before submission of their bids. Oral explanations or instructions given before the award of a contract will not be binding. In no event shall failure to inspect the site constitute grounds for a claim after contract award. (See Section L, 52.236-27, SITE VISIT.)

Price Range The Government's estimate is:

$25,000 to $100,000.

Estimated Start Date May 7, 2012 Contractor must begin work within 10 days of the effective date of the Notice to Proceed. See Section F for additional information.

Restrictions on Work

Work shall be performed Monday thru Fridays 6:30am to 4:30p.m. The driveway in front of the seed extractory building shall not be blocked for extended periods of time.

2. When the Contracting Officer (or designated representative) determines that adverse weather has made access too dangerous or that continued vehicular travel would cause unacceptable road damage.

Worker's Compensation Insurance

The Contractor shall provide evidence of Worker's Compensation Insurance or a written explanation as to why the Contractor is exempt from the requirement. NOTE: The Contractor working alone is not required to carry the insurance.

Camping and Housing (see also Section H, Camping Permit Compliance)

Camping is not permitted in US Forest Service campgrounds. Contractor [ ] will [ x ] will not be permitted to camp elsewhere on US Forest Service land. Camping on Forest Service land is not a right; permission may be revoked for failure to comply with the terms of the permit.

Specifications:

PART 1 GENERAL

1.01 SUMMARY: The contractor will coordinate with a designer to provide a new deck and stair design that will be stamped by a Professional Engineer upon completion. Upon CO approval of the 100% design the contractor will demolish the existing structure and begin work on constructing the new deck, stair and handrail system. Contractor shall replace 5 gutter downspouts. Work also includes widening the existing concrete stairs associated with the concrete landing and demolishing and reconstructing approximately 12 linear feet of sidewalk that connects to the parking lot. The contractor will provide all materials and labor needed to complete the structure and work specified below.

1.02 CODES AND STANDARDS:

The design and construction shall meet applicable codes and industry standards. Applicable codes and standards referred to herein consists of all relevant adopted local, State and Federal Regulations and accepted industry standards including, but not limited to those listed below:

· ADA and ABA Accessibility Guidelines for Buildings and Facilities 2004.

· U.S. Department of Labor’s OSHA Guidelines: OSHA 3124-12R 2003 Publication

· International Building Code (IBC) 2009

· American Institute of Steel Construction (AISC), 9th edition

· American Iron and Steel Institute (AISI), latest edition

· American Society for Testing and Materials (ASTM), latest edition

· American Concrete Institute: Building Code Requirements for Structural Concrete (ACI-318-08) and Commentary

1.03 MEASUREMENT AND PAYMENT:

Measurement of Payment is based on the pay items in the Schedule of Items. All other work and materials described within this section are considered incidental.

1.04 CONTRACTOR AND SUBCONTRACTOR QUALIFICATIONS

The Contractor/Subcontractors for this work shall be regularly involved in the construction and installation of stair and deck systems and shall be licensed by the state contractor’s license board. The Professional Engineer completing and stamping the design must regularly design deck and stair systems and be licensed by the state of California.

1.05 VISITING THE SITE:

The contractor shall verify prior to beginning work the existing conditions and dimensions associated with the contract solicitation. Contractor shall notify CO of any discrepancies before commencing work. No adjustments to the contract price will be made to account for conditions that are apparent at the site.

1.06 SAFETY PLAN:

Prior to the construction phase of the work the contractor must submit a safety plan that will detail worker’s safety requirements. In addition they must propose how to sign and block access to second storey exit doors during construction. The safety plan must be approved by the Forest Service before work begins.

1.07 SUBMITTALS:

· Conceptual, 45% and 100% design drawings

· Product information for materials specified in design

CO will have two weeks to respond with feedback at each of the three design phases.

1.08 AS-BUILTS:

Contractor shall supply the CO with a digital and paper copy of the As-builts before contract closeout.

PART 2 PRODUCTS

2.01 Gutters: Material used to replace five gutter downspouts shall closely match existing gutter material and color.

PART 3 EXECUTION

3.01 Design Phase

A. Submittals: The contractor shall submit a copy of the proposed deck/stair design at the conceptual, 45% and 100% design stage. The conceptual design will be submitted as part of the solicitation response required for technical review (refer to Evaluation Criteria Section M). The conceptual design is meant to be a rough sketch of the proposed deck, stair and railing design along with a brief written description of proposed materials.

B. Design Requirements: The proposed deck and stair design shall serve as an emergency egress for one accessible doorway and one sliding door. The completed stairway shall tie into an existing platform and concrete stairs. The designed deck and stair structure shall be constructed of steel. Any steel column supports shall not be placed directly in front of the first floor entrance. The designer has flexibility in design dimensions.

The final design shall include the following:

· Deck and stair structure including dimensions

· Slope of finished deck surface

· Required footing details

· Railing details including connections to steel structure and existing concrete platform/stairs.

· Building connection details

· Non-skid deck and stair surface

· Material selection and specifications

· Flashing or siding replacement to provide for leak tightness where the deck fastens to the building

· Paint selection (color shall closely match existing color of the I-beams)

· Redesign of the gutter downspouts that run through the existing deck structure.

· Replacing and widening existing concrete stairs and walkway.

3.02 Construction Phase

After the design has been finalized and approved by the Forest Service the Contractor can proceed with the construction phase. Contractor will be required to demolish existing structure and properly dispose of it off Forest Service land. The construction of the newly designed deck must begin immediately after demolition; no delay between the demolition and construction phase will be permitted.

Contractor shall provide Forest Service Engineer access to inspect the wall structure from the exterior side of the building. The purpose of the inspection is to determine the extent of water damage, as observed from the interior of the building. The inspection shall take place upon completion of demolition including the removal of the existing ledger board, prior to anchoring a new structure to the building.

During construction the contractor will remove and replace five gutter downspouts that closely match the material, size and paint color of the existing downspouts. Downspouts should be rerouted to eliminate the need for ninety degree turns.

Contractor shall remove existing caulk and re-caulk around two existing doors and a window leading onto the deck area.

Contractor shall construct the deck, stairs, and handrail system according to the 100% design drawings and specifications. Contractor shall construct a form to widen existing concrete stairs associated with the concrete landing. The Contractor shall demolish existing sidewalk, and form the new sidewalk. The Forest Service must approve forms prior to the concrete pour. After F.S. approval Contractor can poor and finish concrete. Contractor is responsible for cutting expansion joints in the new sidewalk.

The requirements contained in these specifications are hereby made a part of this solicitation and any resultant contract.

SECTION E--INSPECTION AND ACCEPTANCE

FEDERAL ACQUISITION REGULATION (48 CFR CHAPTER 1) CLAUSES

52.246-12 Inspection of Construction (AUG 1996) Inspections Government inspections are for the purpose of satisfying the Government that the supplies and/or services are acceptable and do not relieve the Contractor of the responsibility for maintaining quality control. The Contracting Officer's Representative or designated inspector will conduct all inspections. The Contractor (or designated representative) is encouraged to be present to observe inspections

SECTION F--DELIVERIES OR PERFORMANCE

52.242-14 Suspension of Work (APR 1984)

FAR 52.211-10 Commencement, Prosecution, and Completion of Work (APR 1984) The Contractor shall be required to (a) commence work under this contract within _10___ calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than _113__after the effective date of the notice to proceed. The time stated for completion shall include final cleanup of the premises.

Work Timing

Delays due to normal adverse weather, weekends, and holidays have been included in the calculation of contract time.

Winter Shutdown

When winter weather sets in and the continuation of work is impractical, the Contracting Officer may authorize a total suspension until such time as work can proceed. During the period of total suspension, the calendar days elapsed will not be charged against the contract time specified.

SECTION G--CONTRACT ADMINISTRATION DATA

GOVERNMENT-FURNISHED PROPERTY

The Government will provide the following item(s) of Government property to the Contractor for use in the performance of this contract. This property shall be used and maintained by the Contractor in accordance with the provisions of the "Government Property" FAR clause contained elsewhere in the contract.

None

Invoices

Payment will be processed using Form FS-6300-30, Contract Pay Estimate and Invoice, prepared by the C.O.R. The Contractor need not submit any other invoice.

Payment for Materials Off Site

In accordance with Clause 52.232-5, progress payments may include payment for materials stored off site. Contractor shall provide a copy of the paid invoice; provide evidence that the material will be included in the finished project; and identify the location where the materials are stored, so that the government may make visual inspection if the Contracting Officer deems it necessary. The Contractor shall be liable for loss, damage, or destruction of the materials until such time as the materials are physically in the possession and control of the government. The Contractor will not be held liable to the extent that the Contracting Officer determines that the loss, damage, or destruction occurred through the fault or negligence of the government or its agents.

Incidental Items

The intent of the contract is to provide for the completion of the project described in the contract. Unless otherwise provided, the Contractor shall furnish all labor, materials, equipment, tools, transportation, and supplies and perform all work required to complete the project in accordance with drawings, specifications, and provisions of the contract. Payment for contract work will be made only for and under those pay items included in the Schedule of Items. All other work and materials will be considered as incidental to and included in the payment of items shown.

Preconstruction Conference

This required conference will be scheduled by the COR. (See also Section I, Clause 52.236-26.)

SECTION H--SPECIAL CONTRACT REQUIREMENTS

Emergencies

Area of Responsibility for Fire. Unless otherwise noted elsewhere in the contract, the following define the limits of a contractor's area of responsibility for fire under the terms of the Fire Plan (Section J):

Utility Services

Electricity and water will be available to the Contractor at no cost.

Superintendence by Contractor

In addition to Clause 52.236-6, the following applies: The name and the specific authorities of the foreman or superintendent must be designated in writing to the Contracting Officer. The Contractor may use his/her own prepared letterhead stationery or a "Designation of Contractor's Representative" form available from the Contracting Officer. If the Contractor or the designee is not present when work is being performed on the contract, a Suspend Work Order may be issued with contract time continuing to run. The Contractor shall have a person on-site that is fully conversant in the English language.

Loss, Damage or Destruction

Equipment Furnished with Operator. The Government shall not be liable for loss, damage, or destruction of equipment furnished under this contract except for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) while acting within the scope of their employment.

Other. Even though this contract may provide for performing services at the direction of Government personnel, the contract is not for personal services, and neither the Contractor nor his or her personnel are Government employees. The Government assumes no liability for injury occurring to Contractor personnel or to third parties, or for loss, damage, or destruction involving third parties' property as a result of the Contractor's operation. Except that the Government is liable for such loss, damage, or destruction resulting from the negligent or wrongful act(s) of Government employee(s) acting within the scope of their employment.

Camping Permit Compliance

Contractor shall comply with all terms and conditions of any camping permit issued to allow use of premises. Any non-compliance will result in suspension of work until compliance is achieved.

Archaeological and Historic Sites

Location of known archaeological, historic, or pre-historic materials--such as Amerind artifacts and/or historic mining, logging, or fur trapping remains protected by the American Antiquities Act (l6 USC 433)--will be identified for the contractor before work commences.

Spill Plan

If the total oil or oil products storage exceeds 1,320 gallons or if any single container exceeds a capacity of 660 gallons, the Contractor shall prepare and implement a Spill Prevention and Countermeasures (SPCC) Plan. Such plan shall meet applicable EPA requirements (40 CFR 112), including certification by a registered professional engineer. The Contractor under the direction of the Contracting Officer, or in the absence of said officer, acting independently, shall immediately take action to contain and clean up, without expense to the Government, all petroleum products spills on or in the vicinity of the project which are caused by the Contractor's employees directly or indirectly as a result of contract operations. The Contractor may be held liable for all damages and costs of additional labor, subsistence, equipment, supplies, and transportation deemed necessary by the Government for the containment and clean up of petroleum products spills caused by Contractor's employees or resulting from contract operations. The Contractor shall immediately report all petroleum products spills to the Contracting Officer.

Equipment Cleaning

All off-road equipment used on this project shall be washed before moving into the project area so that the equipment is free of soil, seeds, vegetative material, or other debris that could contain or hold seeds of noxious weeds. “Off-road equipment” includes all logging and construction equipment and such brushing equipment as brush hogs, masticators, and chippers; it does not include log trucks, chip vans, service vehicles, water trucks, pickup trucks, and similar vehicles not intended for off-road use.

Equipment will be considered clean when visual inspection does not reveal soil, seeds, plant material, or other such debris. Disassembly of equipment components or specialized inspection equipment is not required. Contractor shall notify the Contracting Officer at least five days in advance of moving equipment in so that arrangements can be made for inspection.

If the project area is known to contain noxious weeds, the equipment shall be cleaned before moving to other Forest Service system lands which do not contain noxious weeds.

FAR 52.225-9 Buy American Act—Construction Materials (JAN 2005)

(a) Definitions. As used in this clause- "Component" means an article, material, or supply incorporated directly into a construction material.

"Construction material" means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.

"Cost of components" means-

(1) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or

(2) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction materials.

"Domestic construction material" means-

(1) An unmanufactured construction material mined or produced in the United States; or

(2) A construction material manufactured in the United States, if the cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic.

"Foreign construction material" means a construction material other than a domestic construction material.

"United States" means the 50 States, the District of Columbia, and outlying areas.

(b) Domestic preference.

(1) This clause implements the Buy American Act (41 U.S.C. 10a - 10d) by providing a preference for domestic construction material. The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.

(2) This requirement does not apply to the construction material or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that-

(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American Act is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;

(ii) The application of the restriction of the Buy American Act to a particular construction material would be impracticable or inconsistent with the public interest; or

(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.

(c) Request for determination of inapplicability of the Buy American Act.

(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including-

(A) A description of the foreign and domestic construction materials;

(B) Unit of measure;

(C) Quantity;

(D) Price;

(E) Time of delivery or availability;

(F) Location of the construction project;

(G) Name and address of the proposed supplier; and

(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.

(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.

(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).

(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.

(2) If the Government determines after contract award that an exception to the Buy American Act applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.

(3) Unless the Government determines that an exception to the Buy American Act applies, use of foreign construction material is noncompliant with the Buy American Act.

(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

FAR 52.228-13 Alternative Payment Protections (JUL 2000) (Applicable to Contracts >$30,000 but < $150,000)

(a) The Contractor shall submit one of the following payment protections

(1) Irrevocable letter of credit

(2) Payment bond

(3) Certificates of deposit

(4) Certified or cashier’s checks, bank drafts, money orders, or currency

(b) The amount of the payment protection shall be 100 percent of the contract price.

(c) The submission of the payment protection is required within 10 days of contract award.

(d) The payment protection shall provide protection for the full contract performance period plus a one-year period.

(e) Except for escrow agreements and payment bonds, which provide their own protection procedures, the Contracting Officer is authorized to access funds under the payment protection when it has been alleged in writing by a supplier of labor or material that a nonpayment has occurred, and to withhold such funds pending resolution by administrative or judicial proceedings or mutual agreement of the parties.

(f) When a tripartite escrow agreement is used, the Contractor shall utilize only suppliers of labor and material that signed the escrow agreement.

FAR 52.232-35 Designation of Office for Government Receipt of Electronic Funds Transfer Information (MAY 1999)

(a) As provided in paragraph (b) of the clause at 52.232-34, Payment by Electronic Funds Transfer--Other than Central Contractor Registration, the Government has designated the office cited in paragraph (c) of this clause as the office to receive the Contractor's electronic funds transfer (EFT) information, in lieu of the payment office of this contract.

(b) The Contractor shall send all EFT information, and any changes to EFT information to the office designated in paragraph (c) of this clause. The Contractor shall not send EFT information to the payment office, or any other office than that designated in paragraph (c). The Government need not use any EFT information sent to any office other than that designated in paragraph (c).
