SECTION C – DESCRIPTION/SPECIFICATIONS/STATEMENT OF WORK

Statement of Work For a

Non-time Critical Removal Action at Four Oaks Mine, Kern River RD, Sequoia National Forest

Description/ Statement of Work/ Specifications

Project Description:

The Forest Service is conducting a response action at the Four Oaks Mine Site pursuant to its lead agency authority under the Comprehensive Environmental Response, Compensation, and Liability Act of 1980, as amended (CERCLA) and Executive Order 12580. The Four Oaks Mine Site consists of the main mine adit and a caved upper adit, the mill building, two explosives bunkers, and miscellaneous equipment and debris. Waste rock and tailings are on the steep slope around and below the mill building and equipment. This covers about a 1-acre area.

The Four Oaks claims were located in the 1930s and 40s in an effort to reach historically productive veins in this area. The mill building on the Four Oaks was constructed after 1960.The remainder of the site consists of a nearby flatter area adjacent to the access road where borrow material can be excavated and the access road between the site and Franceschi Road (Forest Road 9S29).

The work will generally involve removal of all structures, including the mill building, and debris in the area and closure of the open adit. This work would be done to facilitate capping the tailings, make the confined work area safer and leave the Site less attractive to a curious public. Tailings will be consolidated and capped with soil from an on-site source. Concrete and stone retaining walls would be left in place for stabilizing the slope below the capped tailings.

Site Description: The Four Oaks Mine site covers approximately one acre of land in the Piute Mountains of Kern County, California (Fig. 1). The site is entirely on National Forest System lands administered by the Kern River Ranger District of the Sequoia National Forest.

Removal Action Scope and Objectives: The scope of this removal action is site stabilization of the Four Oaks Mine tailings. This is expected to be the only action at this site. It is unlikely the site would qualify for the National Priority List (NPL) and require remedial action. While there is a clear need to address arsenic contamination present in the tailings, it is too distant from population centers and similar factors that would qualify the Four Oaks Mine Site for remedial action. The tailings are the only currently identified operational unit needing to be addressed under CERCLA at this Site.

The goal for the removal action at the Four Oaks Mine site is to address the threat posed by "...high level of hazardous.... contaminants in soils largely at or near the surface which may migrate", as defined under section 300.415(b)(2)(iv) of the National Contingency Plan (NCP). This goal would adequately address the actual and/or potential threats to humans and the environment due to the level of arsenic present in the tailings.

The scope and goal for this removal action lead to the following objectives:

1. Eliminate soil contact and air exposure pathways of arsenic from the Four Oaks tailings to either humans or animals.

2. Prevent off-site migration of the contaminated tailings into the stream channel or the air for release into the environment.

Goal #1 requires identification of a cleanup standard or level for each of the chemicals of concern. A review of the 2004 Preliminary Remediation Goals (PRGs) finds that the value for non-residential soils for arsenic is 1.6 mg/kg. At the Four Oaks Mine site, a cleanup standard of 1.6 mg/kg would require cleanup greater than natural background found from sampling (5.5 mg/kg – 8.4 mg/kg). Therefore the highest arsenic concentration that would be acceptable would be 100 mg/kg which is the value for the BLM Surveyor scenario (Ford, 1993).

To minimize adverse environmental effects, removal actions will conform to Best Management Practices (BMPs) established by the USDA for Water Quality Management for Forest System Lands in California.

Access: The site is reached by taking California State Highway 58 east from its junction with State. Highway 99 in Bakersfield, CA. At a point about 25 miles east, take the exit north to Caliente, CA. In Caliente, continue onto the Bodfish-Caliente road. Nearly 3 miles from Caliente, take the right hand fork and continue on the Caliente Creek Road for about 17 miles. Turn right onto Fracheschi Road and continue for 6.5 to 7 miles to its junction with the Four Oaks Mine road (Fig. 2). Gate posts are present at the entrance to the mine road. The mine road dead ends after almost 0.5 mile at the Site Location: Site elevation is approximately 6200 feet above sea level. The Four Oaks Mine Site on a steep slope that drains into a tributary of Weaver Creek. This tributary is less than a quarter of a mile from the site. Weaver Creek is one of the main drainages within the Walker Basin area. The Site is represented on the Claraville 7.5 minute topographic Quadrangle. It is found in the north ½ of Section 28, Township 29 South, Ranges 34 East MDBM. This location is wholly within Kern County. The Four Oaks Mine site is at approximately 35 degrees 23.5 minutes North latitude and 118 degrees 19.98 minutes West longitude.

Proposed Work:

The work will be to implement the capping alternative at the Four Oaks Mine under the Regional Environmental Response Action contract. This is Task 3 (Removal Action Remedy Implementation) under Activity III Removal Action Implementation.

Initial work will be site preparation. This will involve the demolition of the small mill building and the concrete storage buildings. It will also require collecting all the metal, wood and other debris strewn on the slope adjacent to the mill and below it. The concrete mill foundation and concrete pad down slope from the mill building should be left undisturbed by this work. The collected debris and demolition debris is solid waste that will need to be transported to the nearest suitable disposal facility.

The other site preparation will be installation of a culvert-gate closure at the adit near the mill. The installation will address both short-term and long-term physical safety of individuals at this Site. See Appendix A for specifications and drawings for this work.

After thel site preparation, implementation work to address the arsenic-contaminated tailings will begin. The tailings would be excavated from around the mill building foundation and the open slope below. It is expected that contamination is limited to the upper 12-iches of soil due to the relatively small volume of tailings produced by this mill. Flagging will be placed to delineate the area of contamination determined by earlier soil sampling. Table 1 provides information on the concentrations of arsenic that will likely be present in the excavated soil. Slope steepness may necessitate a specialized piece of equipment or conveying system to accomplish this excavation.

The tailings would then be placed on the access road. This placement should be made in controlled lifts with water added to get the maximum benefit from wheel-rolled compaction. Then topsoil from a nearby borrow area (700 ft south of mine Site) would be placed over the tailings to a depth of two feet. Wheel-rolled compaction of the capping material is required during placement. A final grade consistent with the general topography of the area should be achieved. The face of the capped tailings should be at a stable angle. Erosion control including matting and wattles will be installed on the top and face of the capped tailing to promote re-vegetation. Final grading of the excavated area will need to have several courses of wattles placed on the contour to prevent runoff erosion from destabilizing the natural slope below the capped tailings. Similar erosion control measures will need to be placed at the borrow area. Final grade on the borrow area shall ensure the borrow area floor drains freely to the nearest natural drainage. Upon demobilization, a rock and soil barrier will be placed at a point near the access road junction at the steep switchback to limit access to the Site.

For technical questions, contact the On-Scene Coordinator for the Four Oaks Mine Site, Jerome DeGraff, Sierra National Forest, 1600 Tollhouse Road, Clovis CA, 93611, Telephone (559) 297-0706, ext. 4932.

52.204-7 Central Contractor Registration (APR 2008)

(a) Definitions. As used in this clause—

“Central Contractor Registration (CCR) database” means the primary Government repository for Contractor information required for the conduct of business with the Government.

“Data Universal Numbering System (DUNS) number” means the 9-digit number assigned by Dun and Bradstreet, Inc. (D&B) to identify unique business entities.

“Data Universal Numbering System+4 (DUNS+4) number” means the DUNS number means the number assigned by D&B plus a 4-character suffix that may be assigned by a business concern. (D&B has no affiliation with this 4-character suffix.) This 4-character suffix may be assigned at the discretion of the business concern to establish additional CCR records for identifying alternative Electronic Funds Transfer (EFT) accounts (see the FAR at Subpart 32.11) for the same concern.

“Registered in the CCR database” means that—

(1) The Contractor has entered all mandatory information, including the DUNS number or the DUNS+4 number, into the CCR database; and

(2) The Government has validated all mandatory data fields, to include validation of the Taxpayer Identification Number (TIN) with the Internal Revenue Service (IRS), and has marked the record “Active”. The Contractor will be required to provide consent for TIN validation to the Government as a part of the CCR registration process.

(b)

(1) By submission of an offer, the offeror acknowledges the requirement that a prospective awardee shall be registered in the CCR database prior to award, during performance, and through final payment of any contract, basic agreement, basic ordering agreement, or blanket purchasing agreement resulting from this solicitation.

(2) The offeror shall enter, in the block with its name and address on the cover page of its offer, the annotation “DUNS” or “DUNS+4” followed by the DUNS or DUNS+4 number that identifies the offeror’s name and address exactly as stated in the offer. The DUNS number will be used by the Contracting Officer to verify that the offeror is registered in the CCR database.

(c) If the offeror does not have a DUNS number, it should contact Dun and Bradstreet directly to obtain one.

(1) An offeror may obtain a DUNS number—

(i) Via the internet at http://fedgov.dnb.com/webform or if the offeror does not have internet access, it may call Dun and Bradstreet at 1-866-705-5711 if located within the United States; or

(ii) If located outside the United States, by contacting the local Dun and Bradstreet office. The offeror should indicate that it is an offeror for a U.S. Government contract when contacting the local Dun and Bradstreet office.

(2) The offeror should be prepared to provide the following information:

(i) Company legal business name.

(ii) Tradestyle, doing business, or other name by which your entity is commonly recognized.

(iii) Company physical street address, city, state and Zip Code.

(iv) Company mailing address, city, state and Zip Code (if separate from physical).

(v) Company telephone number.

(vi) Date the company was started.

(vii) Number of employees at your location.

(viii) Chief executive officer/key manager.

(ix) Line of business (industry).

(x) Company Headquarters name and address (reporting relationship within your entity).

(d) If the Offeror does not become registered in the CCR database in the time prescribed by the Contracting Officer, the Contracting Officer will proceed to award to the next otherwise successful registered Offeror.

(e) Processing time, which normally takes 48 hours, should be taken into consideration when registering. Offerors who are not registered should consider applying for registration immediately upon receipt of this solicitation.

(f) The Contractor is responsible for the accuracy and completeness of the data within the CCR database, and for any liability resulting from the Government’s reliance on inaccurate or incomplete data. To remain registered in the CCR database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the CCR database to ensure it is current, accurate and complete. Updating information in the CCR does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.

52.204-11 – American Recovery and Reinvestment Act—Reporting Requirements (Mar 2009)

(a) Definitions. As used in this clause—

“Contract,” as defined in FAR 2.101, means a mutually binding legal relationship obligating the seller to furnish the supplies or services (including construction) and the buyer to pay for them. It includes all types of commitments that obligate the Government to an expenditure of appropriated funds and that, except as otherwise authorized, are in writing. In addition to bilateral instruments, contracts include (but are not limited to) awards and notices of awards; job orders or task letters issued under basic ordering agreements; letter contracts; orders, such as purchase orders, under which the contract becomes effective by written acceptance or performance; and bilateral contract modifications. Contracts do not include grants and cooperative agreements covered by 31 U.S.C. 6301, et seq. For discussion of various types of contracts, see FAR Part 16.

“First-tier subcontract” means a subcontract awarded directly by a Federal Government prime contractor whose contract is funded by the Recovery Act.

“Jobs created” means an estimate of those new positions created and filled, or previously existing unfilled positions that are filled, as a result of funding by the American Recovery and Reinvestment Act of 2009 (Recovery Act). This definition covers only prime contractor positions established in the United States and outlying areas (see definition in FAR 2.101). The number shall be expressed as ‘‘full-time equivalent’’ (FTE), calculated cumulatively as all hours worked divided by the total number of hours in a full-time schedule, as defined by the contractor. For instance, two full-time employees and one part-time employee working half days would be reported as 2.5 FTE in each calendar quarter.

“Jobs retained” means an estimate of those previously existing filled positions that are retained as a result of funding by the American Recovery and Reinvestment Act of 2009 (Recovery Act).

“Total compensation” means the cash and noncash dollar value earned by the executive during the contractor’s past fiscal year of the following (for more information see 17 CFR 229.402(c)(2)):

(1) Salary and bonus.

(2) Awards of stock, stock options, and stock appreciation rights. Use the dollar amount recognized for financial statement reporting purposes with respect to the fiscal year in accordance with the Statement of Financial Accounting Standards No. 123 (Revised 2004) (FAS 123R), Shared Based Payments.

(3) Earnings for services under non-equity incentive plans. Does not include group life, health, hospitalization or medical reimbursement plans that do not discriminate in favor of executives, and are available generally to all salaried employees.

(4) Change in pension value. This is the change in present value of defined benefit and actuarial pension plans.

(5) Above-market earnings on deferred compensation which is not tax-qualified.

(6) Other compensation. For example, severance, termination payments, value of life insurance paid on behalf of the employee, perquisites or property if the value for the executive exceeds $10,000.

(b) This contract requires the contractor to provide products and/or services that are funded under the American Recovery and Reinvestment Act of 2009 (Recovery Act). Section 1512(c) of the Recovery Act requires each contractor to report on its use of Recovery Act funds under this contract. These reports will be made available to the public.

(c) Reports from contractors for all work funded, in whole or in part, by the Recovery Act, and for which an invoice is submitted prior to June 30, 2009, are due no later than July 10, 2009. Thereafter, reports shall be submitted no later than the 10th day after the end of each calendar quarter.

(d) The Contractor shall report the following information, using the online reporting tool available at http://www.FederalReporting.gov .

This covers the contract (or portion thereof) funded by the Recovery Act.

(7) A narrative description of the employment impact of work funded by the Recovery Act. This narrative should be cumulative for each calendar quarter and only address the impact on the contractor’s workforce. At a minimum, the contractor shall provide—

(i) A brief description of the types of jobs created and jobs retained in the United States and outlying areas (see definition in FAR 2.101). This description may rely on job titles, broader labor categories, or the contractor’s existing practice for describing jobs as long as the terms used are widely understood and describe the general nature of the work; and

(ii) An estimate of the number of jobs created and jobs retained by the prime contractor, in the United States and outlying areas. A job cannot be reported as both created and retained.

(8) Names and total compensation of each of the five most highly compensated officers of the Contractor for the calendar year in which the contract is awarded if—

(9) For subcontracts valued at less than $25,000 or any subcontracts awarded to an individual, or subcontracts awarded to a subcontractor that in the previous tax year had gross income under $300,000, the Contractor shall only report the aggregate number of such first tier subcontracts awarded in the quarter and their aggregate total dollar amount.

The contractor shall advise the subcontractor that the information will be made available to the public as required by section 1512 of the Recovery Act. The contractor shall provide detailed information on these first-tier subcontracts as follows:

Service Contract Act of 1965 (Nov 2007)

(a) Definitions. As used in this clause—

“Act” means the Service Contract Act of 1965 (41 U.S.C. 351, et seq.).

“Contractor,” when this clause is used in any subcontract, shall be deemed to refer to the subcontractor, except in the term “Government Prime Contractor.”

“Service employee” means any person engaged in the performance of this contract other than any person employed in a bona fide executive, administrative, or professional capacity, as these terms are defined in Part 541 of Title 29, Code of Federal Regulations, as revised. It includes all such persons regardless of any contractual relationship that may be alleged to exist between a Contractor or subcontractor and such persons.

(b) Applicability. This contract is subject to the following provisions and to all other applicable provisions of the Act and regulations of the Secretary of Labor (29 CFR Part 4).
