C – Statement of Work Single Blanket Purchase Agreements (BPA) will be established to provide pumping service for vault toilets and septic tanks at USDA Forest Service managed recreation sites located in the BRUSH CREEK HAYDEN Ranger District, located near Walden, Colorado as identified in the following Schedule of Items. This project includes the removal of all solid waste from 56 vault toilets and 18 Septic Systems on the BRUSH CREEK HAYDEN Ranger District with all waste being removed from the toilet site and deposited in a State approved sewage system. The contractor shall provide all personnel, equipment, tools, materials, vehicles, supervision, and other incidentals necessary to perform toilet pumping services.
C.1 WORK SPECIFICATIONS
1. There is not an established schedule for work, as the need for the vault pumping is dependent upon variations in use at the recreation areas and cannot be ascertained in advance. Requests for pumping services will be made verbally by the designated Contracting Officer Representative (COR) and confirmed in the COR’s records. The contractor will meet the Forest Service representative and travel to the site where the pumping will occur. The Forest Service representative will insure that the contractor only pumps the vaults that were requested. The access hatches on the toilets are locked and will require a Forest Service key to access the vaults. The contractor shall notify the COR within twenty-four (24) hours of the time the work is completed. The contractor will not be paid for pumps that were not requested by the COR or COR representative.
2. All solid waste material or refuse capable of being pumped shall be removed from each vault for which pumping services are ordered. Any other material not pumped out shall be removed, bagged, and disposed of on non-National Forest land. Before the final volume of waste material is removed the sides of the vault will be sprayed down rinsing the material down into the area being pumped. A vault will be considered completely pumped when the waste material is at less than a depth of 4 inches on the bottom or lowest area in the vault.
3. After the vault is pumped, the vault will be re-charged with water to a depth of 10 inches from the bottom of the vault. The contractor should not add any deodorants or disinfectants to the vault. Any human waste spilled on the ground amounting to more than ½ gallon will be removed by the contractor. If a spill of human waste of more than 5 gallons occurs the contractor will be required to contact the COR that day to address the situation. The contractor will be required to make a reasonable attempt to notify the Forest Service including campground hosts if a larger spill occurs so that the public can be protected from hazardous waste. The contractor shall remove and replace any barriers required for access to pump the vault toilets.
4. Any sewage spilled by the contractor where it may come into contact at the toilet facility including on the toilet seat, the external riser, the bathroom walls and floor including external sidewalks, shall be cleaned and removed with disinfectant.
5. Waste products extracted from the vaults will be disposed of at the contractor’s expense at municipal or county sewage disposal facilities. It shall be the contractor’s responsibility to locate and to make proper arrangements to dispose of sewage at disposal and treatment facilities, which meet state and local requirements. All cans, bottles and other foreign objects are to be placed in plastic garbage bags furnished by the Contractor and disposed of properly in accordance with current Local, State and Federal sanitary regulations.

To remain registered in the SAM database after the initial registration, the Contractor is required to review and update on an annual basis from the date of initial registration or subsequent updates its information in the SAM database to ensure it is current, accurate and complete. Updating information in the SAM does not alter the terms and conditions of this contract and is not a substitute for a properly executed contractual document.
(2)(i) If a Contractor has legally changed its business name, "doing business as" name, or division name (whichever is shown on the contract), or has transferred the assets used in performing the contract, but has not completed the necessary requirements regarding novation and change-of-name agreements in FAR subpart 42.12, the Contractor shall provide the responsible Contracting Officer a minimum of one business day's written notification of its intention to (A) change the name in the SAM database; (B) comply with the requirements of subpart 42.12; and (C) agree in writing to the timeline and procedures specified by the responsible Contracting Officer. 1341), the following shall govern:
(i) Any such clause is unenforceable against the Government.
(ii) Neither the Government nor any Government authorized end user shall be deemed to have agreed to such clause by virtue of it appearing in the EULA, TOS, or similar legal instrument or agreement. If the EULA, TOS, or similar legal instrument or agreement is invoked through an "I agree" click box or other comparable mechanism (e.g., "click-wrap" or "browse-wrap" agreements), execution does not bind the Government or any Government authorized end user to such clause.
(iii) Any such clause is deemed to be stricken from the EULA, TOS, or similar legal instrument or agreement.
(2) Paragraph (u)(1) of this clause does not apply to indemnification by the Government that is expressly authorized by statute and specifically authorized under applicable agency regulations and procedures.
