Contractor--The individual or legal entity contracting with the Government for performance of prescribed work. In a timber sale contract, the contractor is the

―purchaser‖.

Culvert--No definition.

Right-of-Way--A general term denoting (1) the privilege to pass over land in some particular line (including easement, lease, permit, or license to occupy, use, or traverse public or private lands), or (2) Real property necessary for the project, including roadway, buffer areas, access, and drainage areas.

Adjustment in Contract Price--―Equitable adjustment,‖ as used in the Federal

Acquisition Regulations, or ―construction cost adjustment,‖ as used in the Timber Sale

Contract, as applicable.

Pioneer Road--Temporary construction access built along the route of the project.

Purchaser--The individual, partnership, joint venture, or corporation contracting with the

Government under the terms of a Timber Sale Contract and acting independently or through agents, employees, or subcontractors.

Protected Streamcourse--A drainage shown on the plans or timber sale area map that requires designated mitigation measures.

Road Order--An order affecting and controlling traffic on roads under Forest Service jurisdiction. Road Orders are issued by a designated Forest Officer under the authorities of 36 CFR, part 260.

Schedule of Items--A schedule in the contract that contains a listing and description of construction items, quantities, units of measure, unit price, and amount.

Utilization Standards--The minimum size and percent soundness of trees described in the specifications to determine merchantable timber.

Delete all but subsection 103.01 Intent of Contract and add the following.

103.01 Intent of Contract.

The intent of the contract is to rehabilitate an existing steel pony truss bridge over the Coeur D’Alene River near Jordan Creek on the Idaho Panhandle National

Forests.

This project includes removing unsound concrete, placing cast-in-place concrete, replacing treated timber bearing sills, replacing timber bridge rail and curb, replacing treated timber floor beam nailers, replacing existing nail laminated deck with a glued laminated deck, furnishing and installing treated timber running plank, gabion basket shoulder stabilization, hauling and placing aggregate surfacing, erosion and pollution control, partial stream diversion, contractor construction quality control and all other incidental items necessary to complete the project in accordance with the plans and specifications. The precise details of performing the work are not stipulated except as considered essential for the successful completion of the work. Furnish all labor, material, equipment, tools, transportation, and supplies necessary to complete the work according to the contract.

104.03 Specifications and Drawings.

Add the following:

(c) As-Built-Plans. Furnish one set of as built plans. The Government will provide one set of contract plans to be used exclusively for recording the as-built details of the project.

Use red pencil or red ink to record the information on the as-built plans.

Note all additions or revisions to the location, character, and dimensions of the prescribed work shown on the contract plans. Line out all details shown that are not applicable to the completed work. Check off details shown that were incorporated into the completed work without change.

Retain the plans at the project site and, as work progresses, continually update them to reflect the as-built details. Upon request, make the plans available to the CO to review for compliance with these specifications.

Show the following types of changes on the as-built plans:

104.06 Use of Roads by Contractor

The Contractor is authorized to use roads and trails under the jurisdiction of the Forest

Service for all activities necessary to complete this contract, subject to the limitations and authorizations designated in the Road Order(s) or described in the contract, when such use will not damage the roads or national forest resources, and when traffic can be accommodated safely.

Commensurate with use, the Contractor will be responsible for any damage to roads under the jurisdiction of the Forest Service used by the Contractor as haul routes for delivery of materials to the project site. Commensurate use road damage repairs will be the responsibility of the Contractor.

105 - Control of Material

105.02 Material Sources.

Add the following before the first paragraph.

Sources have been designated for this project as follows:

Crushed Aggregate Source – Commercial (Contractor Furnished) – There is no available Government source for Crushed Aggregate Surfacing specified for the

Jordan Creek Bridge Rehabilitation Project.

Waste Area – Government Furnished – A waste area for unsuitable and excess material associated with structural excavation will be designated by the CO within one(1) mile of the Jordan Creek Bridge.

Materials Stockpile Site – Government Furnished – The Contractor will be allowed to stockpile materials at approved locations within the project area.

Materials must be stockpiled in such a manner as to allow for safe passage of the general public if approved stockpile site is not within the project road closure area. Provide the Contracting Officer 72 hours advance notification prior to stockpiling any materials at the construction sites outside of the project road closure area.

Under (b) Contractor-located sources add the following:

Prior to any pit development or use of materials, the pit site shall be approved by the

Contracting Officer that the pit site is free of noxious weed as listed on the "All States

Noxious Weeds List”.

105.05 Use of Material Found in the Work.

Delete 105.05 (a) and (b) and the last sentence of the second paragraph and substitute the following:

Materials produced or processed from Government lands in excess of the quantities required for performance of this contract are the property of the Government. The

Government is not obligated to make reimbursement for the cost of producing these materials.

106 - Acceptance of Work

106.01_nat_us_07_31_2007

106.01 Conformity with Contract Requirements.

Delete Subsection 106.01 and substitute the following:

Follow the requirements of FAR Clause 52.246-12 Inspection of Construction.

References to standard test methods of AASHTO, ASTM, GSA, and other recognized standard authorities refer to the methods in effect on the date of solicitation for bids.

Perform all work to the lines, grades, cross-sections, dimensions, and processes or material requirements shown on the plans or specified in the contract.

Incorporate manufactured materials into the work according to the manufacturer’s recommendations or to these specifications, whichever is more strict.

Plan dimensions and contract specification values are the values to be strived for and complied with as the design values from which any deviations are allowed. Perform work and provide material that is uniform in character and reasonably close to the prescribed value or within the specified tolerance range. The purpose of a tolerance range is to accommodate occasional minor variations from the median zone that are unavoidable for practical reasons.

When standard manufactured items are specified (such as fence, wire, plates, rolled shapes, pipe conduits, etc., that are identified by gauge, unit mass, section dimensions, etc.), the identification will be considered to be nominal masses or dimensions. Unless specific contract tolerances are noted, established manufacturing tolerances will be accepted.

The Government may inspect, sample, or test all work at any time before final acceptance of the project. When the Government tests work, copies of test reports are furnished to the

Contractor upon request. Government tests may or may not be performed at the work site.

If Contractor testing and inspection is verified by the Government, the Contractor’s results may be used by the Government to evaluate work for acceptance. Do not rely on the availability of Government test results for process control.

Acceptable work conforming to the contract will be paid for at the contract unit bid price.

Four methods of determining conformity and accepting work are described in Subsections

- 16 -

106.02 to 106.05 inclusive. The primary method of acceptance is specified in each Section of work. However, work may be rejected at any time it is found by any of the methods not to comply with the contract.

Remove and replace work that does not conform to the contract, or to prevailing industry standards where no specific contract requirements are noted, at no additional cost to the

Government.

(a) Disputing Government test results. If the accuracy of Government test results is disputed, promptly inform the Contracting Officer. If the dispute is unresolved after reasonable steps are taken to resolve the dispute, further evaluation may be obtained by written request. Include a narrative describing the dispute and a proposed resolution protocol that addresses the following:

(1) Sampling method;

(2) Number of samples;

(3) Sample transport;

(4) Test procedures;

(5) Testing laboratories;

(6) Reporting;

(7) Estimated time and costs; and

(8) Validation process.

If the evaluation requires additional sampling or testing be performed, mutually agree with the Government on witnessing procedures and on sampling and testing by a third party laboratory. Use a third party laboratory accredited by the AASHTO accreditation program. Provide proof of the laboratory’s accreditation for the test procedures to be used. Do not use the same laboratory that produced the disputed

Government test results or that produced the test results used as a basis for the dispute.

The Contracting Officer will review the proposed resolution protocol and may modify it before final approval and execution.

The Government will use the approved resolution protocol test results to determine the validity of the disputed testing. If the Government test results are validated, the

Contractor will be responsible for all costs associated with developing and performing the resolution protocol. If the Government test results are not validated,

- 17 -the Government will be responsible for all costs associated with developing and performing the resolution protocol. If the validity of the Government test results cannot be determined, the Contractor and Government will equally share all costs associated with developing and carrying out the resolution protocol.

(b) Alternatives to removing and replacing non-conforming work. As an alternative to removal and replacement, the Contractor may submit a written request to:

(1) Have the work accepted at a reduced price; or

(2) Be given permission to perform corrective measures to bring the work into conformity.

The request must contain supporting rationale and documentation. Include references or data justifying the proposal based on an evaluation of test results, effect on service life, value of material or work, quality, aesthetics, and other tangible engineering basis. The Contracting Officer will determine disposition of the nonconforming work.

107 - Legal Relations and Responsibility To the Public

107.02 Protection and Restoration of Property and Landscape.

Do not work within the wetted perimeter of streams before July 15 th or after October 30 th unless approved by the Contracting Officer. Perform all in-stream work within the project area in accordance with the approved Erosion Control Plan. During in-stream work, the Contractor will not be allowed to cross the stream with equipment unless approved in writing by the Contracting Officer.

Landscape Preservation

(a) Do not remove, deface, injure, or destroy trees, shrubs, lawn, or natural features not designated for treatment. Confine operations to within the clearing limits or other areas designated in the contract documents, and prevent the depositing of rocks, excavated materials, stumps, or other debris outside of these limits. Retrieve material which falls outside of these limits and dispose of, or incorporate in the work as directed by the Contracting Officer.

(b) Prevention of Oil Spills. If the Contractor maintains storage facilities for oil or oil products on site, take appropriate preventive measures to insure that any spill of such oil or oil products does not enter any stream or other waters of the United States or any of the individual states. If a spill of petroleum product should occur in water, immediately notify the Contracting Officer.

Service all equipment only in the areas approved by the Contracting Officer. If the total oil or oil products storage exceeds 1320 gallons or if any single container exceeds a capacity of 660 gallons, prepare a Spill Prevention Control and Countermeasures (SPCC)

Plan. Meet all applicable EPA requirements (40 CFR 112) including certification by a registered professional engineer.

Preserve the scenic and natural environment along this construction project.

(c) Do not allow objectionable material to enter any stream, river, lake, or other body of water. Retrieve material which falls in these areas and dispose of, or incorporate in the work as directed by the Contracting Officer, and repair damage to vegetation or structures outside the project limits as directed by the Contracting Officer.

(d) Do not operate equipment or otherwise disturb the natural vegetation and soil beyond the areas flagged on the ground or beyond two feet from edge of walkways, top of cuts, or toe of fills.

(e) Prior to the start of construction, submit to the Contracting Officer for approval a schedule and plan for temporary pollution control measures for the following phases of work:

o Structural excavation for concrete repair of bridge bents and piers.

o Stream diversion around work area on pier number 2.

o Site excavation or ground disturbances that can promote surface erosion.

Design and locate equipment repair shops, stationary refueling sites, or other facilities to minimize the potential and impacts of hazardous material spills on Government land.

Before beginning any work, submit a Hazardous Spill Plan. List actions to be taken in the event of a spill. Incorporate preventive measures to be taken, such as the location of mobile refueling facilities, storage and handling of hazardous materials, and similar information. Immediately notify the Contracting Officer of all hazardous material spills.

Provide a written narrative report form no later than 24 hours after the initial report and include the following:

Description of the item spilled (including identity, quantity, manifest number, and other identifying information).

Whether amount spilled is EPA or state reportable, and if so whether it was reported, and to whom.

Exact time and location of spill including a description of the area involved.

Containment procedures.

Summary of any communications the Contractor had with news media, Federal, state and local regulatory agencies and officials, or Forest Service officials.

Description of clean-up procedures employed or to be employed at the site including final disposition and disposal location of spill residue.

When available provide copies of all spill related clean up and closure documentation and correspondence from regulatory agencies.

The Contractor is solely responsible for all spills or leaks that occur during the performance of this contract. Clean up spills or leaks to the satisfaction of the Contracting

Officer and in a manner that complies with Federal, state, and local laws and regulations.

109 - Measurement and Payment

109.02 Measurement Terms and Definitions

Add the following to this subsection:

One of the following methods of measurement for determining final payment is

DESIGNATED IN THE PAY SCHEDULE for each PAY ITEM:

Methods of Measurement:

(a) Designed Quantities (DQ). These quantities denote the final number of units to be paid for under the terms of the contract. They are based upon the original design data available prior to advertising the project. Original design data include the preliminary survey information, design assumptions, calculations, drawings, and the presentation in the contract. Changes in the number of units DESIGNATED IN THE

SCHEDULE OF ITEMS may be authorized under any of the following conditions:

(1) Changes in the work authorized by the CO.

(2) A determination by the CO that errors exist in the original design that cause a PAY ITEM quantity to change by 15 percent or more.

(3) A written request submitted to the CO showing evidence of errors in the original design that cause the quantity of a PAY ITEM to change by 15 percent or more. The evidence must be verifiable and consist of calculations, drawings, or other data that show how the designed quantity is in error.

(b) Stake Quantities (SQ). These quantities are determined from staked measurements prior to construction.

(c) Actual Quantities (AQ). These quantities are determined from measurements of completed work.

(d) Vehicle Quantities (VQ). These quantities are measured or weighed in hauling vehicles.

(e) Lump Sum Quantities (LSQ). These quantities denote one complete unit of work as required by or described in the contract, including necessary materials, equipment, and labor to complete the job.

109.02 Measurement Terms and Definitions.

(p) Thousand Board Feet (MBF). 1,000 board feet based on nominal widths, thickness, and extreme usable length of each piece of lumber or timber actually incorporated in the job. For glued laminated timber, 1,000 board feet based on actual width, thickness, and length of each piece actually incorporated in the job.

Delete Section 151 in its entirety and replace with the following.

Description

151.01 This work consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site;

obtaining of permits, insurance, and bonds. This work also includes washing and treating construction equipment and vehicles necessary for equipment transport to remove seeds, plants, and plant fragments before the equipment is used on Forest Service lands, according to the requirements within.

Construction Requirements

Wash the sides, tops, and undercarriages of all construction equipment. Remove all seeds, plants, plant fragments, dirt, and debris from the construction equipment. Only equipment inspected by the Forest Service will be allowed to operate within the project area. All subsequent move-ins of equipment to the project area will be treated in the same manner as the initial move-in. This requirement does not apply to cars, pickup trucks, and other vehicles that regularly travel between the construction site and areas off the National Forest.

Equipment will be considered free of soil, seed, and other such debris when a visual inspection does not disclose such material. Disassembly of equipment, components or the need for specialized inspection tools is not required.

Notify the Contracting Officer in writing at least 72 hours before moving any construction equipment onto the National Forest. Notification will include an agreed upon location where the equipment will be available for inspection by the Forest Service.

Inspection will be required after every cleaning.

Use methods of cleaning and locations for cleaning approved by the Contracting Officer.

For work at a commercial washing facility, use an approved facility.

New infestations of noxious weeds of concern to Forest Service and identified by either

Contractor or Forest Service, in the Project Area or on the haul route, will be promptly reported to the other party. Contractor and Forest Service will agree on treatment methods to reduce or stop the spread of noxious weeds when new infestations are found.

A current list of noxious weeds of concern to Forest Service is available at each Forest

Service office.

Measurement

151.02 Clean equipment prior to moving onto this project. The initial cleaning will not be included in the measurement for payment. Payment for cleaning will only be made if subsequent cleanings are ordered by the Contracting Officer. Measurement shall be on an ―each‖ basis, meaning one complete cleaning of all equipment required for this contract. Subsequent cleanings necessitated by the Contractor’s actions but not directed by the Contracting Officer will not be included in the measurement for payment.

Measure mobilization according to Subsection 109.02.

Payment

151.03 The accepted quantity, measured as provided in Subsection 109.02, will be paid at the contract price per unit of measurement for the Section 151 pay item shown in the bid schedule. Payment will be full compensation for the work prescribed in this Section.

See Subsection 109.05.

Progress payments for mobilization lump sum will be paid as follows:

(a) If applicable, bond premiums will be reimbursed according to FAR Clause

52.232-5 Payments Under Fixed-Price Construction Contracts, after receipt of the evidence of payment.

(b) When 5 percent of the original contract amount is earned from other bid items, 50 percent of the mobilization item, or 5 percent of the original contract amount, whichever is less, will be paid.

(c) When 10 percent of the original contract amount is earned from other bid items, 100 percent of the mobilization item, or 10 percent of the original contract amount, whichever is less, will be paid.

(d) Any portion of the mobilization item in excess of 10 percent of the original contract amount will be paid after final acceptance.

Include all costs associated with the initial cleaning of equipment in the unit bid price for

Mobilization. Cleaning for subsequent move-ins will not be paid for unless after a suspension ordered by the Contracting Officer.

156 – Public Traffic

156.03 Accommodating Traffic During Work.

The Contractor will be allowed to close that segment of Road No. 412 affected by bridge and approach road construction activities to traffic during construction as outlined below.

No temporary detour or work bridge will be allowed during rehabilitation of the Jordan

Creek Bridge under this bridge repair contract.

Forest Development Road (FDR) No. 412 may be closed to public traffic within the project area during bridge construction work under this contract for one(1) closure period consisting of up to a seventy(70) consecutive day closure period.

It is the responsibility of the Contractor to schedule delivery of materials, equipment and all necessary supplies to the site, to ensure that the bridge can be substantially completed within the above specified closure period and reopened to public traffic.

The Contractor will give the Contraction Officer at least twenty one(21) days advanced written notice prior to any road closure. The Contractor will be responsible for providing, installing, maintaining, and removing construction warning signs and type 3 barricades required for the road closure period.

Traffic delays, as outlined below, may be approved should the project work necessitate short traffic delays outside the approved closure period. Traffic delay periods may be authorized upon receipt of a written approval from the Contracting Officer. Prior notification by the contractor is required for public notice of the contractor’s intent to delay traffic. The Contractor shall submit a written request outlining the traffic delays required at least 7 days prior to starting construction operation that necessitates the traffic delays. The contractor must open the bridge and road as rapidly as possible to allow passage of emergency vehicles.

22.3 MILES AHEAD

Traffic delay periods (60 minutes) between 8:00 a.m. and 4:00 p.m. begin when the first traffic vehicle arrives at the closure site. This traffic delay period is the maximum delay traffic should experience within the entire construction area.

The Contractor shall be responsible for the safe passage of vehicle traffic over the bridge and through the construction site when Road No. 412 is open to public traffic during construction and outside work hours.

Develop a construction sign plan that reflects the Contractor’s plan of operation and submit to the Contracting Officer for approval 14 days prior to commencement of on-site project work. Install construction signs prior to and consistent with the site work being performed.

In addition to typical MUTCD construction zone signing and road closure devices (type

III barricades), the contractor shall install public information signs at the following locations to notify the public of bridge construction and road closures ahead as follows:

o Junction of Primary Forest Route No. 9 (Coeur d’Alene River Road) with

157.03 General

Submit “Soil Erosion Control Plan” detailing permanent and temporary erosion control measures to minimize erosion and sedimentation during and after construction. The erosion control plan will be submitted by the Contractor to the Contracting Officer at the pre-work meeting and approved by the Contracting Officer prior to the Contractor starting construction activities. Include methods to minimize disturbance to the stream and prevent runoff from the construction site entering directly into the stream. The “Soil

Erosion Control Plan” must address construction activities that have the potential for stream sedimentation.

Reflect in the “Soil Erosion Control Plan” special concerns and measures necessary to protect resources and government improvements. Include:

(a) The construction activities and sequence of implementation relating to specific erosion control measures.

(b) The location and type of permanent controls to be implemented during construction.

(c) The location and type of temporary controls to be implemented during construction.

(d) For work in stream channels with running water a detailed dewatering plan

(stream diversions) or measures to be implemented to control stream turbidity.

Reference Section C(h) – Restrictions – Date restrictions for in-stream work for the Jordan Creek Bridge repairs.

As part of the Soil Erosion Control Plan, Contractor to provide the following:

(a) Emergency Spill Kit. Keep sufficient quantities of absorbent materials on the project site to absorb accidental fuel, hydraulic oil, or other petroleum product spills. Use absorbent materials that are biodegradable, non-water absorbing and designed specifically for the types of spills associated with the Contractor’s operations.

(b) Straw/Hay Bales. Contractor to stockpile five(5) straw/hay bales on the

Jordan Creek project site for the discretionary use as directed by the Contracting

Officer in addition to any bales or silt fence that the Contractor intends to incorporate into the project as a part of the permanent and temporary erosion control measures as required under this specification. These straw/hay bales are intended for unforeseen emergency use. As the straw bales are used from the stockpile, Contractor will replace the used bales within 48 hours. Upon completion of the project, the straw/hay bales will remain in place or removed as directed by the Contracting Officer. Removed bales and remaining stockpiled bales shall be uniformly spread over seed disturbed areas upon substantial completion of the project.

Add the following to the third paragraph:

Upon completion of construction at the site, remove all temporary erosion control devices, dewatering materials and equipment from Government property.

208.11 Compacting.

Each layer shall be compacted with mechanical tampers until surface deformation is no longer visible. Adjust the moisture content of the backfill material to the moisture content suitable for compaction.

Contractor will establish the compactive effort required by the control strip method.

Construct a control strip at the beginning of work on each type of material to be compacted. Ensure that the material used in the construction of the control strip meets the specification requirements and proper moisture content for maximum compaction.

Use compaction equipment in the construction of the control strip designed for this purpose until visual displacement ceases. Replace any compaction equipment that fails to provide adequate compaction. Correct or remove unacceptable control strips and replace them at the Contractor’s expense.

Begin compacting the control strip immediately after the course has been placed to the specified thickness. Ensure that compaction is continuous and uniform over the entire surface. Continue compaction of the control strip with a minimum of three passes or until no discernible increase in density can be obtained by additional compactive effort as determined by the Contracting Officer. Once the compactive effort has been established by the control strip method, apply this compaction process until soil type or other conditions change.

American Lumber Standards Committee (ALSC).

(b) Lot certification of each charge for preservative, penetration in millimeters, and retention in kilograms per cubic meter (assay method) by a qualified independent inspection and testing agency. In addition, have the producer of the treated products provide written certification that Best Management Practices

(BMP's) in accordance with "Best Management Practices for Treated Wood in

Western Aquatic Environments," published by the Western Wood Preservation

Institute (WWPI) and Canadian Institute of Treated wood, were followed, including a description and appropriate documentation of the applicable BMP's used.

(c) Certification from a qualified inspection and testing agency indicating that all glued laminated members are in accordance with the requirements of American

National Standard for Wood Products, "Structural Glued Laminated Timber"

(ANSI/AITC A190.1) modified as SHOWN ON THE DRAWINGS.

(d) Such other certifications as SHOWN ON THE DRAWINGS or called for in the SPECIAL PROJECT SPECIFICATIONS.

Provide shop drawings for all timber 21 days in advance of fabrication. Show all dimensions and fabrication details for all cut, framed, or bored timbers, and material specifications and treatments.

561 – Concrete Surface Treatment

561.01 Work.

This work consists of applying pigmented, water-repellent acrylic penetrating sealer to all exposed concrete surfaces of the rehabilitated piers and intermediate concrete pier walls.

Materials

561.02 Materials.

Conform to the following Subsections:

Color Coating 725.24

CANYON TONE STAIN manufactured by United Coatings meets this specification.

Other products may also meet these requirements and may be considered providing the

Contractor requests its use in writing to the Contracting Officer. Provide sufficient documentation to determine if the proposed product meets this specification and has been successfully applied to five other similar projects that the Contracting Officer can investigate.

Grey color to be approved by the Contracting Officer.

Construction

561.03 Surface Preparation.

New Concrete - Complete the Class 2 – Rubbed Finish on all new concrete. Do not apply the surface treatment until all concrete placement and concrete finish work for the

- 50 -structure is complete. Remove all dust, efflorescence, scale, foreign matter, form oil, grease, and curing compound using methods and materials as recommended by the

Manufacturer of the water-repellent stain.

Existing Concrete – Dense concrete substrates should be brush-blasted or sand-blasted to clean and/or open the surface to achieve adequate penetration as recommended by the

Manufacturer of the pigmented water-repellent stain.

561.04 Weather Limitations.

Apply the surface treatment to a dry concrete surface when the surface temperature is 45 degrees Fahrenheit. or higher and the air temperature in the shade is anticipated to be 45 degrees Fahrenheit or higher during the 24 hours following application or as recommended by the Manufacturer of the water-repellent stain.

561.05 Application.

Apply the stain in two separate applications according to the manufacturer’s recommendations. Provide copies of the printed manufacturer’s application instructions and precautions to the Contracting Officer two weeks prior to scheduled application.
