Notice to Proceed.
F. Survey Protocol
The Contractor shall conduct surveys for the Mexican spotted owl according to the attached US Fish and Wildlife Service Mexican Spotted Owl Survey Protocol, 2012.

H. Schedule of Services
The Contractor shall begin conducting the formal monitoring during the 2016 Mexican
Spotted Owl field season, March 1 through August 31. The first formal monitoring survey must be initiated within one week of the Notice to Proceed issued by the
Contracting Officer. The Notice to Proceed for the Base Year 2016 season will be issued shortly after contract award, which is intended to be made no later than May 15, 2016.
TASKS:
1. Formal monitoring to establish presence and reproductive status of all contracted PACs shall be conducted according to the requirements listed in the current USFWS Mexican Spotted Owl Survey Protocol between March 1 and
August 31 each year.
2. A mid-season report will be turned in by June 15 each year, or at a date approximately mid-season to be determined, that will be in a table format and include information for each PAC such as which surveys have been completed, Page | 8 the date they were completed and the results for each survey. This report will be emailed to the Santa Catalina District Biologist.
3. At any time during the field season, the District Biologist may request updates on the status of surveys and request UTM coordinates and maps of locations of owls/nests as needed by the USFS. The contractor will provide that information as quickly as possible.
4. At the end of the field season, a final report will be turned in which will include all datasheets and all results of surveys done in each PAC. Due to the large number of datasheets required for this project, electronic submittal (rather than hard copies) of datasheets as an appendix to the final report will be allowed. The main text of the final report (which can be provided in hard copy and electronic copy as needed by the USFS) will summarize all survey work that was accomplished and discuss the results of those surveys. The final report and electronic submittal of datasheets is due no later than November 15 of each survey season.
I. Payment
A progress payment comprising up to 40% of the total line item price will be processed upon submittal to and inspection by the Government of Task 1 and Task 2 in the
Schedule of Services. A progress payment to the Contractor, if the work shall be determined satisfactory, will be commensurate with the actual percentage of work completed.
Final payment will be made upon receipt, review, and acceptance by the Government of all completed items in the schedule of services, culminating in the final report.
The completion of all work within the contract time frames listed above is critical as subsequent work and related projects are contingent upon timely completion of this project in its entirety. Services not completed within contract performance periods, barring Excusable Delays as determined by the Government, are grounds for Default
(FAR 52.249-8, incorporated by reference). The Contractor shall remain responsible for ultimate completion of the items covered by the progress payments until the Government formally inspects and accepts the final report.
J. Quotes for Period of Services for PAC Monitoring
The total firm-fixed price amount for the Base Period and for the four Option Periods shall be inclusive of all costs associated with providing the required services. Offerors must submit a lump sum price quote for the BASE year and all 4 Option Years as indicated on the PILOT PROJECT schedule of items. A single firm fixed price award is contemplated. Only the Base Period is guaranteed with the Option Periods contingent on available funding.
Page | 9
The Base Period, from time of contract award through February 28, 2017, requires the performance of services as specified during the period identified as Mexican spotted owl field season. The Base Period performance period must begin as soon as practicable after contract award which is anticipated to be no later than May 15, 2016.

52.212-2 Evaluation--Commercial Items
As prescribed in 12.301(c), the Contracting Officer may insert a provision substantially as follows: Evaluation -- Commercial Items (Oct 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the
Government, price and other factors considered. The following factors shall be used to evaluate offers:
(1) Professional/Organizational Experience of the Offeror and Offeror’s
Employees or Subcontractors
As a minimum, the Offeror should be adequately experienced in performing MSO surveys in terrain typical of the Santa Catalina Mountains, where the surveys are to take place. If not directly familiar with this mountain range based on prior experience, it is strongly advised that the Offeror visit the mountain range prior to submitting an offer for this solicitation. Familiarity with the survey area(s) or terrain typical of the Santa Catalina
Mountains is a significant sub-factor in the government’s evaluation of prior experience, and the Offeror should discuss the nature and breadth of this familiarity in the technical proposal. The Offeror should also address the experience of its workforce or proposed team as it relates to all the possible surveys listed in the Master IDIQ scope of work.
(2) Personnel Qualifications
The Contractor, employees of the Contractor, or subcontractors are required to have extensive knowledge of Mexican spotted owl habitat. The Contractor shall be an authorized biologist listed under the U.S. Fish and Wildlife Service species permit for the Mexican spotted owl. The biologist(s) conducting the surveys shall have proof of attendance at a U.S. Forest Service certification course for Mexican spotted owl inventory and/or monitoring protocol.
(3) Technical Capability
The Contractor’s a) work force capacity, b) method of operation, and c) work schedule shall be adequate to complete the work within the specified time periods. The Offeror must adequately address and discuss all 3 of the above sub-factors related to technical capability for the specific project area.
Page | 12
(4) Past Performance
Completion of at least three successful survey projects involving the Mexican spotted owl is required. Information regarding these surveys, including dates, location, and contact information for the agency overseeing the work must be included in the Offeror’s technical proposal. Past performance in conducting biological surveys in the Santa
Catalina Mountains as well as other mountain ranges in Arizona or New Mexico is a relevant sub-factor in the government’s evaluation of past performance. In addition to the agency contact information to be supplied above, three to five references from professionals in the field who are familiar with the Offeror’s work on MSO surveys or other wildlife surveys are to be furnished with contact person and telephone number for each reference.
(5) Price
Prior Professional/Organizational Experience, Personnel qualifications, Technical
Capability, and Past Performance, when combined, are more important than Price.
(a) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the base year requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(b) A written notice of award or acceptance of an offer mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
(c) The government will consider only a single award for the PILOT PROJECT based on the evaluation factors above. The Optional Consultation Hourly Fee on the schedule of items will not be evaluated for award purposes for this solicitation and is of an optional and indefinite quantity.
(d) The Successful Offeror for the PILOT PROJECT will automatically receive an award for a
Master IDIQ Biological Survey contract. The PILOT PROJECT will be the first task order awarded under the Master IDIQ contract.
(e) A second Master IDIQ Biological Survey contract will be awarded to the Best Unsuccessful
Offeror for the PILOT PROJECT. Though not evaluated as the best value for the PILOT
PROJECT, the Best Unsuccessful Offeror nonetheless shall have submitted a proposal that is acceptable or better for all the evaluation factors above. The Best Unsuccessful Offeror’s overall pricing must be judged as fair and reasonable by the Contracting Officer, though that overall pricing is likely higher than that of the Successful Offeror.

(i) Taxes are considered delinquent if both of the following criteria apply:
(A) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge.
In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(B) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(ii) Examples.
(A) The taxpayer has received a statutory notice of deficiency, under
I.R.C. §6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appear rights.
(B) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under
I.R.C. §6320 entitling the taxpayer to request a hearing with the IRS
Office of Appeals Contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing.
