The Government will evaluate equally, as regards time of delivery, offers that propose delivery of each quantity within the applicable delivery period specified above. Offers that propose delivery that will not clearly fall within the applicable required delivery period specified above, will be considered nonresponsive and rejected. The Government reserves the right to award under either the required delivery schedule or the proposed delivery schedule, when an offeror offers an earlier delivery schedule than required above. If the offeror proposes no other delivery schedule, the required delivery schedule above will apply.

52.212-4 -- CONTRACT TERMS AND CONDITIONS -- COMMERCIAL ITEMS (FEB 2007)
(a) Inspection/Acceptance. The Contractor shall only tender for acceptance those items that conform to the requirements of this contract. The Government reserves the right to inspect or test any supplies or services that have been tendered for acceptance. The Government may require repair or replacement of nonconforming supplies or reperformance of nonconforming services at no increase in contract price. If repair/replacement or reperformance will not correct the defects or is not possible, the government may seek an equitable price reduction or adequate consideration for acceptance of nonconforming supplies or services. The Government must exercise its post-acceptance rights --
(1) Within a reasonable time after the defect was discovered or should have been discovered; and

10. ITEMS OF WORK AND CONSTRUCTION DETAILS
The Contractor shall exercise diligence in the event of encountering submerged cultural resources, if encountered. All activities in the immediate area will be suspended, and the Contractor shall notfiy the Contracting Officer immediately.
The contractor shall provide a job coordinator for each work crew to be available at all times while work is in progress. The job coordinator shall have a cellular telephone to communicate with the NRCS personnel and others.
The job coordinator shall not be an equipment operator or laborer.
The work limit width will extend outward a maximum of 200 feet in either direction from the tops of the stream banks. The “top of stream bank” is a feature of definite transition or “break in slope” between the defined channel and adjacent field, cropland or other land use area. In areas without such a definite transition feature, the maximum work limits shall be 250 feet outward from the centerline of the channel. Where the ground elevation is 10 feet or higher than the elevation of the low bank, no debris shall be removed. Actual work limit widths will be defined on attached maps and sketches. The work limit length for each area is described within its respective bid item and shown on the site maps.

Items of work to be performed in conformance with this specification and the details are:

Bid Item 2, Debris Removal – Site 07-327-63 (approx. 1,600 Linear Feet) Bid Item 3, Debris Removal – Site 07-327-65 (approx. 1,550 Linear Feet) Bid Item 4, Debris Removal – Site 07-327-73 (approx. 1,600 Linear Feet)
(1) The work shall consist of the cleanup, removal, and stockpiling of all debris as defined within this specification and as shown on the attached maps and sketches and the transportation of all removed vegetative debris to approved disposal areas. The work limits shall also include any debris under or around bridges immediately downstream of the designated areas. Once the contractor begins work on an area, work must be continuous as weather permits until all work is completed in this area.
(2) Temporary on-site stockpiles of vegetative debris shall conform to the requirements of Section 5 of this specification. All non-vegetative debris must be removed and stockpiled in accordance with Section 6 of this specification.
(3) Measurement and payment shall be made at the contract lump sum price.
Payment of the contract price will constitute full compensation for completion of the work. Each area will be formally accepted by the Government when complete. The contractor shall notify the Government Representative at least 24 hours prior to the work being completed in each area so that inspection of the site can be arranged. Final inspections shall be scheduled on Monday though Friday only. The removal of additional debris resulting from reasonable weather events prior to acceptance of the site will be at the contractor’s expense.
(4) To be considered complete, all non-vegetative debris and vegetative materials longer than 18 inches or having a diameter greater than 2 inches must be removed from the work area.
b. Bid Item 5, Seeding
(1) Annual Ryegrass Rye seed will be uniformly broadcast on the designated areas as determined by the Contracting Officer.

(2) This item shall consist of furnishing all seed, labor, equipment, and material, and all others items necessary and incidental to the completion of vegetation on designated areas.
(3) “Designated areas” shall be those areas within the work limits that have been disturbed by the work to such a degree that they are highly susceptible to erosion and/or areas where natural revegetation is unlikely during the early part of the next growing season. The Contractor shall obtain the concurrence of the Contracting Officer prior to vegetating any area.
(4) Species or mixture shall consist of Annual Ryegrass (based on 100 ac):

(5) Seed quality and purity shall comply with all county, state and federal seed laws and regulations for the site of planting. A current seed test will be provided.
(6) Measurement and payment shall be made at the contract unit price per acre. Payment of the contract price will constitute full compensation for completion of the work.
(7) Compliance with this requirement will be based on periodic and final inspections and verification of seed quality and quantity from tickets provided by the contractor.
c. Bid Item 6, Fertilizing
(1) This item shall consist of furnishing labor, equipment, and materials for applying fertilizer to all areas vegetated in the above work item or disturbed areas that retain vegetative but need assistance to recover in a timely manner, as determined by the Contracting Officer.
(2) Fertilizer shall be commercial grade and uniformly broadcast at a rate of
40 lbs/ac N, 40 lbs/ac P2O5 and 40 lbs/ac K2O.
(3) The Contractor shall furnish a supplier’s certification of analysis and weight.

(4) Measurement and payment shall be made at the contract unit price per acre. Payment of the contract price will constitute full compensation for completion of the work.
(5) Compliance with this requirement will be based on periodic and final inspections and verification of fertilizer content and quantity from tickets provided by the contractor.
d. Bid Item 7, Contractor Quality Control
(1) This item consists of performing inspection services to document that the finished work meets contract requirements.
(2) Each work crew shall have a person designated as Quality Control
Manager for that crew. The Quality Control Manager shall not be an equipment operator or laborer.
(3) The Quality Control Manager may be the Job Coordinator for that work crew.
(4) The Quality Control Manager for each work crew shall be responsible for the following operations: (a) documenting any pre-work conditions that might affect the work or acceptance of the work (i.e. existing property conditions and existing structures or utilities), (b) verifying work limits with NRCS Government Representative prior to beginning work, (c) obtaining concurrence from the Contracting Officer for approved disposal sites and recording an estimated volume of debris transported to those sites, (d) ensuring that all work is completed in accordance with this specification,
(e) ensuring that all damages to fences, roads, structures and fields are repaired to pre-existing, or better, conditions, (f) ensuring that the contractor is in full compliance with his/her safety program, (g) notifying the Contracting Officer to schedule the inspection of completed areas.
(5) The Quality Control Manager shall submit to the Contracting Officer, a weekly report for each work crew documenting the following information:
(a) work period for each workday, (b) weather conditions for each workday, (c) workforce each workday, (d) completed work for the week,
(e) contacts/conversations with landowners, sponsors, utility companies or others, (f) problems encountered and actions taken and (g) anticipate completion date for the current work area.
(6) Failure to ensure that work is complete prior to calling for NRCS inspection may result in the contractor being charged for re-inspection of the work.

(7) Measurement and payment will be by lump sum. Partial payments will be prorated and paid in equal amounts on monthly estimates. The number of months used for prorating shall be the number used to complete the work.
(8) Compliance with this requirement will be based on periodic inspection of the contractor’s quality control program.
