AG-67T0-S-13-0002 Prairie Dog Dusting - Additional Question and Answers
Question: How much liability insurance will we have to carry?
Answer: The Government is not requiring any additional insurance coverage. Determination of adequate insurance coverage is the responsibility of the contractor.
Question: Do I need to have work comp?
Answer: Please contact Department of Labor - http://www.dol.gov/owcp/ http://www.dol.gov/dol/topic/workcomp/ and SD Department of workers compensation http://dlr.sd.gov/workerscomp/default.aspx or the state in which your company is located.
Question: On page 15 I read about vender’s enrollment. Is that something that needs done now or after the contract has been awarded?
Answer: All contractors must be registered in the System for Award Management (SAM.gov) to be eligible for a government contract award. It can take up to one week to process your request. You will not be considered for award if you are not registered in SAM. If you are awarded a contract, you will need to enroll in the Treasury’s Internet Payment Platform (IPP) to be able to invoice for work under the contract to receive payments.
Question: My bank was also wondering about a financial assignment if it was a possibility and what paperwork needed done.
Answer: Yes, under Federal Acquisition Regulation (FAR) clause 52.212-4 (b) Assignment allows for assignment of payments. Will work with the successful contractor awarded the contract to set up the assignment.
Question: Does this contract apply under seasonal workers mentioned on page 27, and do we have to obtain a Certificate of Registration from the Department of Labor?
Answer: If you will be utilizing employees meeting the definition of the Migrant Seasonal Workers Act, this will apply. You will need to provide certification in Section K.4 with your proposal.
Question: Page 19 and 52 refer to the Register of Wage Determination No 1979-1157 Rev 38. Please clarify, do seasonal employees hired for the dusting contract fall under this Determination? If so will the contractor then be required to offer the benefits listed on page 52?
Answer: Yes, all employees working under a contract including the Service Contract Act wage rates are to be paid according to the wage rate. I will refer you to the Department of Labor, Wage and Hour Division to assist with the determination if you have to pay fringe benefits, vacation, and any other requirements – this varies on what you are doing and how you have your business set up. http://www.dol.gov/compliance/laws/comp-sca.htm
Question: On page 31, 1.5 VALUE OF GOVERNMENT-FURNISHED PROPERTY, am I understanding it correctly, the contractor will have to pay SD tax on the DeltaDust used during the course of the contract?
Answer: Please contact SD Department of Revenue http://dor.sd.gov/taxes/ to determine how to report this.
