52.216-21 – Requirements (Oct 1995)

(b) Delivery or performance shall be made only as authorized by orders issued in accordance with the Ordering clause. Subject to any limitations in the Order Limitations clause or elsewhere in this contract, the Contractor shall furnish to the Government all supplies or services specified in the Schedule and called for by orders issued in accordance with the Ordering clause. (f) Any order issued during the effective period of this contract and not completed within that period shall be completed by the Contractor within the time specified in the order. The contract shall govern the Contractor’s and Government’s rights and obligations with respect to that order to the same extent as if the order were completed during the contract’s effective period;

(b) If the Government exercises this option, the extended contract shall be considered to include this option clause.

(c) The total duration of this contract, including the exercise of any options under this clause, shall not exceed 66 months.

These chaps must be approved by an Underwriters Laboratory or meet Forest Service specification 6170-47. The chaps must cover the full length of the thigh and must extend to the top of the boot on each leg.

The contractor shall assure that each employee wears foot protection that provides adequate traction and ankle support. Employees operating chain saws shall wear foot protection that is constructed with cut-resistant material which will protect the employee against contact with a running chain saw.

In any area where the worker is exposed to the potential for flying or falling objects, the contractor shall provide a hard hat, at no cost to the employee, and the contractor shall assure that the employee wears the hard hat. The hard hat must meet the minimum requirements of American National Standards Institute (ANSI) standard Z89.1-1997.

The contractor shall provide, at no cost to the employee, eye protection where there is potential for eye injury due to flying objects. This eye protection must meet the minimum requirements of ANSI standard Z87.1-2003. 52.212-2 Evaluation – Commercial Items (OCT 2014)

(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. Evaluation will be conducted on best-value principles, specifically the Lowest Priced Technically Acceptable approach.

Evaluation Method

1. Technical Evaluators will review all offeror’s technical proposals. Each will receive a rating of either acceptable or unacceptable.

Acceptable Technical Proposal clearly meets the minimum requirements of the solicitation.

Unacceptable Technical Proposal does not clearly meet the minimum requirements of the solicitation.

2. The Contracting Officer will than rank the technically acceptable offers by price.

3. If the lowest priced offer was rated acceptable, the Contracting Officer will make a responsibility determination IAW FAR 9.104.

4. If the lowest priced technically acceptable offer is determined responsible AND their price is determined fair and reasonable, award will be made to that offeror.

5. If the lowest priced offeror is rated technically unacceptable (or is not awardable for another reason), the Contracting Officer will begin again at Step 2 with the next lowest priced offer.

4. Award will only be made to the lowest priced offer who is determined to be technically acceptable, responsible and whose price is determined fair and reasonable price.

There are 7 Technical Evaluation Factors:

1. Capability to Perform (Staffing) – Offeror must demonstrate an adequate level of skilled and readily available personnel to work on simultaneous task orders (employees and/or sub-contractors).

2. Capability to Perform (Equipment) – Offeror must demonstrate possession or access to the appropriate equipment, in suitable quantity, to ensure successful accomplishment of simultaneous task orders.

3. Past Performance – Offeror must demonstrate experience with project(s) similar in scope to the requirements detailed in the Statement of Work. Offeror may submit projects in which they performed as either a prime or sub-contractor; work performed by the offeror must have exceeded $10,000. Offerors are requested to submit AT LEAST 3 past projects – no more than 10 projects will be considered. If more than 10 are submitted, only the first 10 will be evaluated. For all projects submitted, offeror must provide the following information:

a) Contract number

b) Contract/award amount

c) Brief description of the work performed

d) Date begun/completed

e) Name/address/telephone number of person to contact for further information This factor will be evaluated on whether the projects were completed with minimal instances of poor or late performance – and with only moderate customer oversight. Note – Technical Evaluators may use their personal knowledge of the offeror’s past performance and/or consider information not contained in the proposal as long as it can be validated (i.e. additional information obtained from discussing a project with the POC).

4. Project Management & Control – Offeror must demonstrate capability to proactively use management and control practices (and/or tools) to aid in ensuring that the contract work meets the Performance Requirements Summary standard. Offeror cannot simply rely on Government inspection – offeror must be proactive in performing Quality Control.
