3. The provision 52.212‐2 has been revised to read as follows (changes underlined):

“52.212‐2 EVALUATION ‐‐ COMMERCIAL ITEMS (OCT 2014)

(a) Award will be made to the responsible offeror representing the Lowest‐Priced Technically Acceptable (LPTA) proposal. Proposals will be evaluated in accordance with FAR Part 13, Simplified Acquisition Procedures.

Each technical evaluation factor must be found to be “acceptable” in order for the proposal to be found technically acceptable. Proposals will not be ranked. Missing, incomplete, or ambiguous information may result in a rating of “unacceptable” for that factor. Evaluation factors are listed below:

(i) Price.

(ii) Product Conformance to the Specifications.

The product sample will receive a rating of “acceptable” or “unacceptable”. The sample product must conform to all specification requirements to receive an “acceptable” rating.

(iii) Execution and Management Plan.

The Execution and Management Plan will receive a rating of “acceptable” or “unacceptable” based on its entirety. In order to receive an “acceptable” rating, the Plan must contain sufficient detail to convince the evaluators that the offeror has considered the essential elements of the project, and that there is an adequate contingency plan to address performance risks.

(iv) Past Performance.

The past performance factor will receive a rating of “acceptable” or “unacceptable” based on its entirety. Evaluation of past performance may be based on one or more of the following:

The Contracting Officer’s knowledge and previous experience with the supply or service being acquired; customer surveys and past performance questionnaire replies; and the

Governmentwide Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov. The

Government may contact any and all past performance references provided in response to this solicitation.

Past performance will be rated “unacceptable” if the contractor receives an unsatisfactory assessment from a past performance source unless the offeror can demonstrate that adequate corrective actions were taken. In the case of an Offeror with no relevant performance history, or for whom information on past performance is not available, the Offeror will be evaluated as

"acceptable" provided the Offeror certifies that additional past performance information is not available and provides an acceptable explanation as to why past performance information is not available.

6395‐S‐17‐0104

(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is AG‐ unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).

(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer’s specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.”
