2. Revise “Notes To Quoters”, Note 1 (pg. 3 of the solicitation), to read as follows:

“See 52.212‐1 Addendum for quotation submission instructions.”

3. Revise Provision 52.212‐1 Addendum to read as follows:

"52.212‐1 ADDENDUM

FAR 52.212‐1 is replaced in its entirety by this addendum.

INSTRUCTIONS TO QUOTERS – COMMERCIAL ITEMS

(a) Submission of quotes.

A COMPLETE QUOTE SHALL INCLUDE THE FOLLOWING INFORMATION:

(1) Cover Page. Quotations may be submitted on the SF 1449 or cover page. Reference the solicitation number, company name, address, DUNS number, and point of contact information.

If the quote is not submitted on the SF 1449, include a statement that the Quoter assents to all terms of this solicitation. Quotes that fail to furnish required information, or reject the terms and conditions of the solicitation may be excluded from consideration.

(2) Pricing. Provide a unit price for each line item as specified in the Pricing Schedule. Prices shall include all costs associated with furnishing and delivering all materials and for performing all work required under the contract in a complete and acceptable manner.

Alternate pricing schedules will not be considered.

(3) Technical Capability Information. A description of the product or services quoted in sufficient detail to evaluate compliance with the requirements in the solicitation. This may include product literature or other documents.

(4) Acknowledgement of any amendments to this solicitation;

(5) Terms of any express warranty (optional);

(b) Email Submission. Submit quotes by email to Lisa Draves at lisa.a.draves@aphis.usda.gov. Firms may submit more than one quote. Each quote will be evaluated separately.

(c) Submission deadline. Quotes must be received by the date and time specified in this solicitation.

A late quote will not be considered unless it is received before award is made and the

Contracting Officer determines that accepting the late quote would not unduly delay the acquisition. In the case of an emergency or unanticipated event that delays Government operations so that quotes cannot be received, the deadline will be extended by one working day.

(d) Terms of and content. Quotes must be based on the terms of this solicitation. The Government may reject any quote that is not based on these terms in every respect. Quotes must contain all of the information described below.

(e) Small Business Status. The North American Industry Classification System (NAICS) code and small business size standard for this acquisition appear in Block 10 of the solicitation cover sheet

(SF 1449). However, the small business size standard for a concern which submits a quote in its own name, but which proposes to furnish an item which it did not itself manufacture, is 500 employees.

(f) Issuance of Purchase Order. Quotes shall contain the quoter’s best technical and price terms.

The Contracting Officer may reject any or all quotes. The Contracting Officer may issue a purchase order to other than the quoter with the lowest priced quote. After the evaluation of quotes, the Contracting Officer may negotiate final terms with one or more quoters of the

Government’s choice before issuing any purchase order. The Contracting Officer will not negotiate with any quoters other than those of the Government’s choice and will not use the formal source selection procedures described in FAR Part 15.

(g) Multiple purchase orders. The Government may issue a purchase order for any item or group of items of a quote, unless the quoter qualifies the quote by specific limitations. Unless otherwise provided in the Schedule, quotes may not be submitted for quantities less than those specified.

The Government reserves the right to issue a purchase order for a quantity less than the quantity quoted, at the unit prices quoted, unless the quoter specifies otherwise in the quote.

(h) Unique entity identifier. (Applies to all quotes exceeding $3,500, and quotes of $3,500 or less if the solicitation requires the Contractor to be registered in the System for Award Management

(SAM) database.) The Quoter shall annotate its Data Universal Numbering System Number

(DUNS Number) in the block with its name and address on the cover page of its quote. Contact

Dun and Bradstreet to obtain a DUNS number (1‐866‐705‐5711 or http://fed.gov.dnb.com/webform)

(i) Availability of requirements documents cited in the solicitation. If the descriptions in this solicitation for supplies or services refer to any Government specification, standard, or commercial item description, vendors may obtain a copy of any such documents from the places listed in FAR provision 52.212‐1(i);

(j) System for Award Management. Unless exempted by an addendum to this solicitation, by submission of an offer, the quoter acknowledges the requirement that a prospective awardee shall be registered in the SAM database prior to award, during performance and through final payment of any contract resulting from this solicitation. If the quoter does not become registered in the SAM database in the time prescribed by the Contracting Officer, the

Contracting Officer will proceed to award to the next otherwise successful registered quoter.

Quoters may obtain information on registration and annual confirmation requirements via the

SAM database accessed through https://www.acquisition.gov.

(k) Requests for information. The contracting officer will not notify unsuccessful quoters that responded to this solicitation. Quoters may request information on award(s) resulting from this solicitation from the contracting officer."
