TERMS AND CONDITIONS

1. DESCRIPTION OF AGREEMENT: This is an agreement to establish an unpriced Blanket Purchase Agreements (BPAs). Lamb prices will be within the range reported by the Kalona Iowa Sale Barn Weekly Report or another index that is mutually acceptable to the Government and the Contractor. The contractor shall provide lambs in accordance with the below specifications and when requested by the Contracting Officer or the authorized representative of the Contracting Officer.

a. The specified period for this BPA begins at the date established in shown in Block 3 of the SF Form 1449, and ends 5 calendar years later.

b. Supplies after the specified period or exceeding the aggregate total dollar limitation shall not be authorized, nor considered an obligation.

1. The aggregate dollar limitation is one million dollars ($1,000,000.00)

c. Review for compliance to new statute or directive shall be completed, at least annually, before the anniversary of the BPA’s effective date. Any revisions to the BPA, as a result of this review, shall be accomplished by a bi-lateral modification.

d. This agreement may be unilaterally terminated at any time by either party with a thirty (30) day notification and may be rewritten or revised at the option of the Contracting Officer.

e. The point at which the order becomes a binding contract is after the written acceptance by the Government to an oral or written solicitation for supplies.

2. EXTENT OF OBLIGATION: The Government is obligated only to the extent of authorized calls actually placed against this BPA.

3. PRICING:

a. The prices to the Government for all supplies under this BPA shall be as low as, or lower than, those charged the supplier’s most favored customer for comparable supplies under similar terms and conditions.

b. Calls may only be placed when quoted prices are within the range of prices for lambs listed in the Kalona Iowa Sale Barn Weekly Report. If prices are outside of this range another index mutually acceptable to the Government and Contractor MAY be used with written approval by the Contracting Officer. The Government shall not be obligated for placement, negotiation, or solicitation of lambs not with the price range.

4. PURCHASE LIMITATION: Calls placed by individuals authorized under this BPA shall not exceed the dollar limitation listed on the Individuals Authorized to Place Calls letter but under no circumstances shall calls exceed $100,000.00 (see 5c below)

5. LIMITATIONS OF INDIVIDUALS AUTHORIZED TO PLACE CALLS AND DOLLAR AMOUNT

A list of individuals authorized to place calls under this agreement, identified either by position title or by individual’s name, organizational component, and the dollar limitation per purchase for each position title or individual shall be furnished to the contractor by the Contracting Officer. This list shall be kept current by the contract administrator.

a. Calls under BPAs are generally placed orally; however, the Contracting Officer or their designated representative may use written correspondence.

b. Under no circumstances shall calls exceed $150,000.00.

c. Calls over $25,000 will be advertised on the government point of entry fbo.gov

1. Between 2008 and 2013 no call exceeded $7,500.00

d. List of Individuals and their dollar limitation

1. Contracting Officer and Purchasing Agent, APHIS, MRPDS, ASD, Minneapolis, MN with a not to exceed $150,000.00.

2. USDA, APHIS, National Veterinary Services Laboratory (NVSL) Ames, IA and other personnel authorized by the Contracting Officer and Contracting Officer’s Representative.

a. Warranted personnel with a NTE of $150,000.00 for each individual BPA call

b. Warranted personnel with a NTE of $25,000.00 for each individual BPA call

6. RECEIPT AND ACCEPTANCE OF SUPPLIES:

a. Receipt of supplies shall be indicated by signature and date on the appropriate form by the authorized Government representative. This shall be subject to acceptance by the assigned inspector or customer when compared to the documentation of the original call. A sales slip, delivery ticket, and/or SF Form 1449 may be used for receipt and acceptance.

7. INVOICES: The Contractor shall submit an original invoice for each call (or electronic invoice, if authorized) to the address designated in the contract to receive invoices. An invoice must include--

(1) Name and address of the Contractor;

(2) Invoice date;

(3) BPA number, contract line item number and, if applicable, the order number;

(4) Description, quantity, unit of measure, unit price and extended price of the items delivered;

(5) Terms of any prompt payment discount offered;

(6) Name and address of official to whom payment is to be sent; and

(7) Name, title, and phone number of person to be notified in event of defective invoice.

Invoices will be handled in accordance with the Prompt Payment Act (31 U.S.C. 3903) and Office of Management and Budget (OMB) Circular A-125, Prompt Payment. Contractors are encouraged to assign an identification number to each invoice. The invoice will be verified by the customer and the customer will make payment using the government purchase card.

8. DELIVERY: All animals will be picked up by USDA-Ames staff at the producers’ premises or agreed upon location by both parties using USDA transport vehicles.

9. SPECIFICATIONS

Lambs shall be Dorset or Dorset sired crossbreds, or other medium size breeds which are associated with “out-of-season” breeding characteristics that are acceptable to USDA-APHIS in Ames, Iowa.

Animals will be purchased as needed in groups with 20 lambs minimum per group.

All animals will be picked up by USDA-Ames staff at the producers’ premises or agreed upon location by both parties using USDA transport vehicles.

Lambs must be between 3 and 12 months of age when delivered.

Lambs may encompass a weight range of 50 – 130 pounds with no more than 20 pounds difference between the lightest and heaviest lamb in each group.

Animals must be weaned prior to transport and accustomed to eating hay and concentrate. Animals shall not be over-conditioned from Creep feeding.

Must come from the same source (i.e. source-verified or limited to only one farm source (proof will be required) with no animals purchased through a sale barn or other type of auction.

Must have been raised in similar management environments (similar backgrounds as far as location, rearing, handling, nutritional/feeding management and health care).

All animals must be castrated males, castrated between birth and one month of age and healed; or non-pregnant females.

Tails need to be docked and healed prior to pickup.

All animals must be free of bluetongue virus (BTV) antibodies. The presence of seropositive animals indicated that BTV and competent vectors are present at the farm source. If one or more animals are positive for BTV antibodies as measured by the competitive enzyme-linked immunosorbent assay (CELISA) upon receipt, NVSL/NCAH reserves the right to terminate the contract with this vendor.

Must have the following vaccinations prior to weaning: Clostridial (Clostridium perfringens types C and D (overeating disease) and Clostridium tetani (tetanus). Vaccinations/injections must be given in the neck of the animal in accordance with current industry guidelines/practices. Verification of vaccinations will be done through farm medical records.

Lambs must be out of a flock with an active external and internal parasite control plan in effect and dewormed within 2 weeks prior to pickup. Medical records or certification by Veterinarian Required.

Upon delivery, must be health with no overt signs of disease, and free of injury, active lameness, respiratory disease, pinkeye, ringworm, and contagious echthyma (soremouth, orf).

Animals need not be shorn prior to purchase.

The State of Iowa Department of Agriculture and Land Stewardship requires official identification of sheep before the leave a farm. All sheep sold to USDA must comply with the current State of Iowa requirements for the transportation and movement of sheep within the state.

Scrapie Program ID Requirements

Animals that must be officially identified before leaving your farm:

Sheep – All sexually intact sheep departing from the farm, whether for change of ownership, marketing/slaughter*, or any other sale or lease** to another person, or to attend an exhibition. This includes adult breeding animals and ewe lambs and ram lambs. Wethers under 18 months of age do not need ID.

Goats – All sexually intact goats that are registered, are used for exhibition, or that have resided with sheep. (Goats may be identified with either the official plastic ear tags, or an approved tattoo (call the ear tag order number below for approval of your tattoo).

* Animals under 18 months of age moving directly to a slaughter facility (not through an auction market or dealer) do not require official ID.

** Rams which are leased out should be identified to the owners’ flock, and the owner must keep records as to the ram’s movements.

You are required to maintain records for five years on all animals requiring official ID that enter or depart from your flock. Records must include the name and address, or official ID number of the other party, the flock of origin of the animal (flock where it last resided in which it was either born, or used for breeding purposes), and the date of the transaction.

When buying animals: Make sure that the animal has official identification, (unless it is a wether lamb, or some goats as listed above). Record the information listed above.

When selling animals that require official ID: If the animal does not already have an official ID ear tag, then place the official flock ID ear tag in the animal before leaving the farm, and it is recommended that you link the individual ID number listed on that tag to your other production records on the animal. If the animal was not born in your flock, and still has the original official ID ear tag from the previous flock, then you do not need to apply your ear tag. If the original tag has fallen out, then make a record when you apply your ear tag as to where you acquired that animal. Never remove official ID. Create a record of all sales showing the number of animals sold, the date, and the market or buyer. It is recommended that you also record the ID of the animals sold, if possible.

Remember that all sheep and goats sold privately other than to slaughter require a Certificate of Veterinary Inspection (CVI) in order to move. (You do not need a CVI to sell through a licensed livestock market or dealer).

10. INSPECTION AND ACCEPTANCE

The lambs will be inspected at pickup location and accepted upon completion of medical examination at Ames, Iowa.
