(5) A demonstration that the proposed contractor's unique qualifications or the nature of the acquisition requires use of the authority cited.
(6) A description of efforts made to ensure that offers are solicited from as many potential sources as is practicable, including whether a notice was or will be publicized as required by Subpart 5.2 and, if not, which exception under 5.202 applies. The authority under Subpart 5.2 under exception 5.202(a)(10) The proposed contract action is made under conditions described in 6.302-5(a)(i) A statute expressly authorizes or requires that the acquisition be made from a specified source;
(7) Determination of fair and reasonable price.
(8) A description of the market research conducted (see Part 10) and the results or a statement of the reason market research was not conducted. GIPSA's Technical Services Division fosters the development and improvement of inspection equipment. TSD identifies inspection equipment needs and research projects. (Policy GIPSA Equipment Handbook chapter 1 - http://archive.gipsa.usda.gov/reference-Iibrary/handbooks/equipment/eq l-gen.pdD TSD provides a list of approved equipment in'GIPSA Equipment Handbook (http://www.gipsa.usda.gov/Publications/fgis/handbooks/equipment/apprlist-a.pdf).
(9) Any other facts supporting the use of other than full and open competition, such as:
Approved equipment is thoroughly tested to ensure they meet the requirements of GIPSA in terms of accuracy, precision, and repeatability. Only items on the approved equipment list will satisfy the agency's needs for additional units/replacement items due to the standardization program (6.302-1 FAR).
(10) A listing of sources, if any, that expressed, in writing an interest in the acquisition.
(11) A statement of the actions, if any, the agency may take to remove or overcome any barriers to competition before any subsequent acquisition for the supplies or services required.
Official inspection customers expect the best practically achievable consistency among official inspection results (as well as high accuracy). In general, a system comprised of instruments that use different measurement technologies does not give the same consistency of results that can be achieved by a system of instruments that use exactly the same technology.
To achieve the highest level of consistency and accuracy that our customers require, GIPSA selects and approves single "types" of secondary instruments for many official inspection needs. GIPSA approves multiple instrument models or methods for official inspection needs that are served best by having several different approved types http://www.gipsa.usda.gov/Publications/fgis/handbooks/equipment/apprlist-a.pdf. GIPSA also ensures inspection equipment is properly calibrated, and maintained and repaired.
(12) Certification of technical or requirements personnel. The Program Director, Robert Lijewski, has certified that this product is available from only one responsible manufacture and no other type of product will satisfy the needs of the agency, and that all supporting data (e.g., verifying the Government's minimum needs or schedule requirements or other rationale for other than full and open competition) and which form a basis for the justification have been certified as complete and accurate. Patrick J, McCluskey, Date /s/ 7/26/2012.
(12) Contracting officer certification: As the Contracting Officer, I certify that the justification is accurate and complete to the best of the contracting officer's knowledge and belief.
