1. NOTE TO OFFEROR:

In order for an offeror to have a complete quotation package, the following must be submitted to the Contracting Officer to be considered responsive:

1) A completed Price Schedule (see below) for contract line items 0001, 0002, 0003, 0004, and 0005 which includes the costs for the base year and all the option years. All overhead and ancillary costs associated with providing the line items shall be assumed by the Contractor, and should be factored into the quote price. Therefore, this quote shall include all costs associated with the store location data, including shipping costs to the FOB destination.

2) Signature of the offeror on the SF 1149 form (Attachment 1).

3) A detailed narrative of your company’s product which addresses how your company’s product meets the technical specification requirements outlined in the Statement of Work (see below). You should address the technical evaluation criteria listed in 52-212-2. The technical narrative should be of sufficient detail to determine the offeror’s technical capability to produce the store location data to the required specifications. The offers will be evaluated for “best value” based on the technical evaluation criteria listed in 52- 212-2.

4) The time necessary to produce and deliver the initial store location data, and data updates when requested with a delivery order.

5) A 10-20 store sample of store location data that is a mix of regular grocery stores and club stores, and including locations in various states.

6) At least three past performance references with contact information (name, address, telephone, and email) to evaluate past performance as indicated in 52.212-2.

7) A completed copy of the provisions at FAR 52.212-3, Offeror Representations and Certifications-Commercial Items OR confirmation that this has been completed on-line.

8) A copy of the first page of your company's Central Contractor Registration record from www.ccr.gov.

3. STATEMENT OF WORK (Retail Store Location Data):

I. Background The Mandatory Country of Origin Labeling (COOL) law requires retailers, such as full-line grocery stores, supermarkets, and club warehouse stores, to notify their customers with information regarding the source of certain foods. Covered commodities identified in the law include muscle cuts and ground meats (beef, veal, pork, lamb, goat, and chicken); wild and farm-raised fish and shellfish; fresh and frozen fruits and vegetables;

peanuts, pecans, and macadamia nuts; and ginseng. The regulation for fish and shellfish covered commodities (7 CFR Part 60) became effective in 2005. The final rule for all remaining covered commodities (7 CFR Part 60 and Part 65) went into effect on March 16, 2009. Agricultural Marketing Service (AMS), Livestock and Seed Program (LS), is responsible for the development, implementation, and enforcement of COOL.

The LS Program is responsible for formulating and administering policies for marketing services and regulatory activities relating to: commodity grading and certification for meat and livestock products; purchase of meat and meat products and fish and fish products for Federal food and nutrition programs; market news reporting for livestock, meat, wool and grain products; standardization services for wool, mohair, livestock, meat and related products; monitoring and analyzing scientific research and information for its applicability to the programs administered by the LS Program; and, administering the COOL statute.

The 2002 and 2008 Farm Bills amended the Agricultural Marketing Act of 1946 to require retailers to notify their customers of the country of origin and method of production of covered commodities. The COOL Program is authorized to enter into partnerships with states to assist with retail surveillance reviews. COOL staff provides on-going training to state enforcement personnel, and conducts supplier trace-back audits to verify the accuracy of country of origin and method of production declarations.

In order to perform these functions, the COOL program needs to request retail store information for all retail facilities owned by firms that exceed $230,000 in the annual invoice cost of fruits and vegetables sold by the firm. These retail facilities are determined by the population of retail stores that have aggregate annual grocery sales that exceed $2 million per calendar year. In future requests the COOL Program would only need information on retailers (supermarkets and club stores) that have opened or closed within the previous fiscal year. This approach will minimize the re-purchase of retail data that has already been collected in previous years.

II. Scope of Work Vendor shall provide retail store information such that AMS will have a complete and true database of the retail facility population in the United States, and be able to update that database with any store openings and closings on a fiscal year basis. Multiple but minor information requests throughout the fiscal year may be needed when changes in the database occur. Vendor shall maintain historical data of retail store listings for Store Location Data Page 5 of 6 previously provided to AMS so as to minimize repeating information previously transmitted. Vendor is to provide physical locations of qualified retail stores. The following retail information is required:

a) Store location information:

• Store Name

• Store ID Number (if applicable and if available)

• Store Phone Number

• Store Address that includes street name, city, state, zip+4, county, and shopping center location.

• Corporate Name and Address (if applicable and if available)

• Weekly Volume Sales

b) Vendor shall have the ability to collect, manage, and analyze data for qualified retail stores that have aggregate annual grocery sales that exceed $2 million per calendar year.

c) Vendor shall have legal access to the above information.

d) Vendor shall maintain a historical database to avoid future duplications previously requested information.

e) Vendor shall have the ability to maintain and separate the retail store database into supermarkets and club stores.

f) Store list to be delivered via email (preferred) or delivered via FedEx in Excel format on CD to the USDA, AMS, LSP, COOL Program directly, within _10 business__ days of each request.
