Contract time is 90 days from the Notice to Proceed. Work is expected to begin in September.
Mobilization is considered an indirect cost of this contract and will not be compensated as a separate work item. Mobilization consists of moving personnel, equipment, material, and incidentals to the project and performing all work necessary before beginning work at the project site. Mobilization includes the obtaining of permits, insurance, and bonds
SECTION 015950 -SAFETY AND HEALTH
PART 1 -GENERAL
1.1 SUMMARY
A. References: In addition to publications referenced in the Contract and FAR 52.236-13, the following Code of Federal Regulations (CFR) publications designate and define hazardous materials and conditions, and establish procedures for handling these materials and conditions.
1. 29 CFR, Part 1910: Occupational Safety and Health Administration (OSHA) General Industry and Health Standards.
2. 29 CFR, Part 1926: OSHA Construction Industry Standards.
3. 40 CFR, Part 61: National Emission Standards for Hazardous Air Pollutants.
4. 40 CFR, Part 261: Environmental Protection Agency (EPA) Characteristics of Hazardous Waste.
5. 40 CFR, Part 761, EPA Polychlorinated Biphenyls (PCBs), Manufacturing, Processing, Distribution in Commerce and Use Prohibitions.
B. Acquisition of Publications: Referenced CFR publications may be purchased from the Superintendent of Documents, U.S. Government Printing Office, Washington, D.C. 20402.
1.2 SAFETY MEETING
A. Prior to commencing construction, representatives of the Contractor, including the Superintendent, shall meet with the Government to review the Contract's safety and health requirements.
B. The Contractor's safety and health program shall be reviewed, and implementation of safety and health provisions pertinent to the Work shall be discussed.
1.3 COMPLIANCE WITH REGULATIONS
A. Contractor Responsibility: The Contractor shall assume full responsibility and liability for compliance with all applicable codes, standards and regulations pertaining to the health and safety of personnel during execution of the Work. The Contractor shall have written safety and health programs in compliance with 29 CFR Parts 1910 and 1926.
1.4 SUBMITTALS
A. Safety and Health Programs: The Contractor shall submit, for approval, copies of the project safety and health programs, as applicable to the work scope, or required as a result of the safety meeting, including but not necessarily limited to the following:
1. Occupational Noise Exposure.
2. Fall Protection.
3. Personnel Protective Equipment.
4. Control of Hazardous Energy.
5. Electrical Safety Related Work Practices.
6. Lead.
7. Respirator Protection.
8. Confined spaces.
PART 2. –PRODUCTS
2.1 PERSONNEL PROTECTIVE EQUIPMENT
A. Special facilities, devices, equipment and similar items used by the Contractor in execution of the Work shall comply with 29 CFR Part 1910, Subpart I and other applicable regulations.
PART 3. -EXECUTION
3.1 EMERGENCY SUSPENSION OF WORK
A. In accordance with FAR 52.236-13, when the Contractor is notified by the Government, of non-compliance with safety or health provisions of the Contract, the Contractor shall immediately, correct the unsafe or unhealthy condition. In accordance with FAR 52.236-14 if the Contractor fails to comply promptly, all or part of the Work will be stopped by Government notice. The Contractor shall not be allowed any extension of time or compensation for damages in connection with a work stoppage for unsafe or unhealthy conditions.
3.2 PROTECTION OF PERSONNEL
A. The Contract shall take all necessary precautions to prevent injury to the public, occupants, or damage to property of others.
3.3 ENVIRONMENTAL PROTECTION
A. Dispose of solid, liquid and gaseous contaminants in accordance with local codes, laws, ordinances and regulations.
B. Comply with applicable federal, state and local noise control laws, ordinances and regulations, including but not limited to 29 CFR 1910.95 and 29 CFR 1926.52.
SECTION 018110 – USDA GREEN PRODUCT
– GENERAL
STATEMENT OF WORK
The contractor must comply with Section 9002 of the Farm Security and Rural Investtment Act of 2002 (FSRIA), Executive Order (EO) 13423, “Strengthening Federal Enviromental, Energy, and Transportation Management”, and the Federal Acquisition Regulations to provide green products. All supplies and materials shall be of a type and quantity that conform to applicable Federal specifications and standards, and to the extent feasible and reasonable; include the exclusive use of biobased, recycled content, energy star, and environmentally preferable products.

SECTION 020000 – GARDEN OF THE GODS REPAIRS
Part 1 - GENERAL
1.1 STATEMENT OF WORK
A. This project is to provide all labor, materials and equipment necessary to make repairs to the two vault toilet buildings at the Garden of the Gods Recreation Area Observation Trailhead. This work include removal and replacement of interior and exterior siding and trim; scraping and painting the exterior of the buildings and floors; replacement of entry doors and door closures; removal and replacement of the wall vents, removal and replacement of the toilet risers, seats and lids; removal of existing gutters and installation of new gutters, downspouts and splashguards; removal and replacement of the vault lids; removal of the male and female restroom signs and replacement with unisex signs; and relocation of the toilet paper holders to the bottom of the accessible grab bars in the restrooms.
1.2 GENERAL
A. All work shall be in accordance with the International Code Council Building Code and meet the requirements of ADA.
1.3 SITE ACCESS
A. Site shall remain open to the public at all times during work.
B. Restrooms may be closed during work, as long as a minimum of 1 stall remains open to the public at all times.
1.4 CLEANING AND TRASH REMOVAL
A. Contractor shall clean the work site at the end of every work day.
1. Contractor shall remove all accumulated construction and personal debris.
2. This includes all paper, plastic bottles and other food containers.
Part 2 - PRODUCTS
2.1 CARPENTRY
A. All lumber and plywood shall conform to the American Softwood Lumber Standard PS 20 and Construction and Industrial Plywood Standard PS 1-74 respectively.
1. All lumber shall be seasoned and S4S unless otherwise specified
2. Equal or better grades in species other than specified are acceptable subject to the prior approval of the CO.
3. All lumber and plywood shall have grade, trade, and specified marks or stamps.
4. All materials shall be protected from moisture.
a. Store all materials under a weatherproof cover.
b. Prevent buildup of moisture under the weatherproof cover.
c. Store six inches above ground.
5. Use galvanized spiral siding nails for wood siding and exterior trim.
B. Framing Lumber
1. Species: Douglas Fir, Hem-Fir, Pine (Northern or Southern), Hemlock (Eastern, Mountain, or Western), or Spruce-Pine-Fir.
2. Grading rules shall meet those of the WWPA, WCLIB, SPIB, NELMA OR NHPMA, whichever is applicable to the species used.
C. Siding and Finish Lumber (Trim, Fascia, Frames, Casings, Sashes)
1. Species: Western Red Cedar, Fir, or Pine (Northern or Southern).
2. Grade: Western Red Cedar; “B-Finish, Paneling and Ceiling”, Other Species; “D” Select or Finish.
3. Siding: Textured exterior plywood with grooves 6” on center. (T1-11)
2.2 DOORS AND DOOR HARDWARE: Install all hardware items in accordance with manufacturer’s recommendations.
A. Doors: Curries 747 Series Door, 16 gage, factory primed, sized to replace existing door.
B. Door Closures: LCN4040 (or equal) Heavy Duty Adjustable Hydraulic Door closer with Parallel arm mounting and Hold-Open control. Door shall be adjusted so that opening force required to open door is 4-5 LBS.
C. Latch – Remove existing and retain for re-installation in new door.
D. Dead Bolt – Remove existing and retain for re-installation in new door.
E. Coat Hooks – Remove existing and retain for re-installation in new door.
F. Hinges – Remove existing and retain for re-installation in new door.
2.3 GRILLES
A. Anemostat Non-Vision Door Louver Model FDLS (or equal), size 10” X 14”, 18 gage steel, hot dipped galvanized and primed.
2.4 TOILET AND ACCESSORIES
A. Toilet Risers: Romtec Model No. OD 2050 W (Off-White) Handicap Cross-Linked Polyethylene Toilet Riser, (or equal).
B. Grab Bars: Remove existing and retain for re-installation.
C. Toilet paper holders: Remove existing and retain for re-installation.
2.5 FACTORY LAMINATED PLASTIC PANELS
A. Gelcoat-finished, glass-fiber reinforced plastic panels complying with ASTM D 5319, laminated to exterior grade plywood.
B. Glass-Fiber Reinforced Plastic Panel Nominal Thickness: Not less than 0.03 inch (0.76mm).
C. Surface Finish: Molded pebble texture.
D. Color: As selected by Contracting Officer from manufacturers full range E. Plywood: DOC PS 1, Exterior B-C, 3/8 inch (9.5 mm) thick.
F. Surface-Burning Characteristics: As determined by testing identical products according to ASTM E 84 by a qualified testing agency. Identify products with appropriate markings of applicable testing agency.
1. Flame-Spread Index: 200 or less.
2. Smoke-Developed Index 450 or less.
G. Accessories:
1. Trim Accessories: Manufacturer’s standard one-piece aluminum extrusions designed to retain and cover edges of panels. Provide division bars, inside corners, outside corners and caps as needed to conceal edges.
2. Concealed Mounting splines: continuous, H-shaped aluminum extrusions designed to fit into grooves routed in edges of factory-laminated panels and to be fastened to substrate.
3. Adhesive: As recommended by plastic paneling manufacturer.
4. Sealant: Single-component, mildew-resistant, neutral-curing silicone sealant recommended by plastic paneling manufacturer and complying with requirements in Division 07 Section “Joint Sealants.”
2.6 VAULT COVER: Provide a standard cast iron 24” manhole cover.
A. Designed to seal tightly when closed B. Capable of being padlocked shut C. Shall be solid with no vent holes.
2.7 GUTTERS AND DOWNSPOUTS
A. Gutters: Continuous guttering, 0.032 inch thick aluminum, five inches ogee gutters with 0.027 inch thick aluminum roof apron, aluminum strap hangers, aluminum-EPDM expansion joints, and .032 inch thick aluminum end caps, color: Brown.
B. Downspouts: Three inches by four inches, .027 inch thick aluminum, color: Brown.
2.8 RESTROOM SIGNS: Provide Acrylic unisex restrooms signs with braille. Size shall be 9” X 6”. Color to be Black with White lettering.
2.9 PAINT AND EPOXY
A. Epoxy Coating for Floor Surface and All Exposed Concrete Surfaces inside the building: Shall be chemical resistant and have a non-slip surface, color to be light grey, submit color sample for approval before application.
B. Exterior Primer and Paint: Paint shall be a acrylic latex flat paint formulated for application on exterior wood and metal surfaces. Primer shall be compatible with the paint. Submit color samples for approval prior to application, color to match existing paint.
2.10 FILL MATERIAL: Shall be clean fill dirt and Illinois CA-06 aggregate.
2.11 SEED AND MULCH:
A. Use commercially available lawn mix, and weed-free and seed-free straw.
Part 3 - EXECUTION
3.1 EXCAVATION
A. The ground around the 2 hole toilet building shall be leveled to the bottom of the concrete apron.
B. Undermined areas shall have debris and other materials removed.
1. Remove only the material that is not a part of the original fill.
2. Place new fill material in the hole and compact by hand to the fullest extent possible.
3. Bring fill up to the bottom of the concrete apron and top with topsoil.
4. Rake the surface to provide positive drainage.
C. Seeding and Mulching
1. Disturbed area shall be seeded and mulched.
2. Seed and mulch as soon as possible after completion of work.
3. Seeding materials shall not be applied during windy weather or when the ground is excessively wet or frozen.
3.2 DEMOLITION AND DISPOSAL
A. Items Removed and Reinstalled:
1. Care shall be taken to remove the items without damaging the part or the finish.
2. These items shall be stored in a secure location until they can be placed back in service.
3. All items to be reinstalled shall be cleaned and serviced prior to reinstallation.
B. Remove and dispose of the following:
1. Exterior siding and trim; this does not include the privacy screens
2. Metal doors only, care shall be taken to not damage the frame and hinges during the removal.
3. Door closers.
4. Wall vents,
5. Interior siding.
6. Toilet risers
7. 1 vault cover on the 2 hole unit and 2 vault covers on the 3 hole unit.
8. Exterior restroom signs.
C. All items removed other than those designated to be reinstalled shall become the property of the contractor and disposed of off National Forest lands in an approved location.
3.3 CARPENTRY
A. Replace all blocking where necessary for mounting hardware, etc.
B. Set work straight, plumb, level, true to line and closely fitted.
C. Install siding in continuous full length pieces.
3.4 HARDWARE AND ACCESSORIES
A. All doors, hardware and accessories shall be installed to meet ADA requirements.
B. Doors and Door Hardware: Install doors and all hardware items in accordance with manufacturer’s recommendations.
C. All grilles, toilet risers and accessories shall be installed in accordance with manufacturer’s recommendations.
3.5 FACTORY LAMINATED PLASTIC PANELS
A. Preparation
1. Prepare substrate by sanding high spots and filling low spots as needed to provide flat, even surface for panel installation.
2. Clean substrates of substances that could impair bond of adhesive, including oil, grease, dirt, and dust.
3. Condition panels by unpacking and placing in installation space before installation according to manufacturer's written recommendations.
4. Lay out paneling before installing. Locate panel joints to provide equal panels at ends of walls not less than half the width of full panels.
a. Mark plumb lines on substrate at locations for accurate installation.
b. Locate to allow clearance at panel edges according to manufacturer's written instructions.
B. Installation
1. Install plastic paneling according to manufacturer's written instructions.
2. Install factory-laminated panels using concealed mounting splines in panel joints.
3. Install trim accessories. Do not fasten through panels.
4. Fill grooves in trim accessories with sealant before installing panels and bed inside corner trim in a bead of sealant.
5. Maintain uniform space between panels and wall fixtures. Fill space with sealant.
6. Remove excess sealant and smears as paneling is installed. Clean with solvent recommended by sealant manufacturer and then wipe with clean dry cloths until no residue remains.
3.6 VAULT COVERS: Install in accordance with manufacture’s recommendations.
3.7 RESTROOM SIGNS: Install in accordance with manufacturer’s recommendations and to meet ADA requirements.
3.8 GUTTERS AND DOWNSPOUTS
A. Hanging Gutters: Gutters shall be installed without seams. Attach gutters at eave or fascia to firmly anchored gutter brackets or straps spaced not more than 36 inches (900 mm) apart. Provide end closures and seal watertight with sealant. Slope to downspouts.
1. Fasten gutter spacers to front and back of gutter.
2. Loosely lock straps to front gutter bead and anchor to roof deck.
3. Anchor and loosely lock back edge of gutter to continuous eave or apron flashing.
4. Anchor back of gutter that extends onto roof deck with cleats spaced not more than 24 inches (600 mm) apart.
5. Install expansion-joint caps.
6. Install continuous gutter screens on gutters with noncorrosive fasteners, removable for cleaning gutters.
B. Downspouts:
1. Shall be attached at the rear of the building.
2. Join sections with 1-1/2-inch (38-mm) telescoping joints.
3. Provide hangers with fasteners designed to hold downspouts securely to walls. Locate hangers at top and bottom and at approximately 60 inches (1500 mm) o.c. in between.
4. Provide elbows at base of downspout to direct water away from building where indicated.
5. Connect downspouts to underground drainage system indicated where indicated.
3.9 PAINT AND EPOXY
A. Clean all surfaces prior to applying all finishes.
1. Scrape all previously finished surfaces to be painted to remove all loose and scaling paint or other old finish.
B. Application: Prepare and apply materials in accordance with manufacturer’s instruction.
C. Do not paint outside in cold, frosty, foggy or damp weather. Do not paint unless temperature is 50 degrees F or over and surfaces are dry and hard. When there is danger of dew or frost or a drop of more than 20 degrees F in temperature at night, application of paint shall cease several hours before sunset to permit paint to set.
D. Epoxy Coating: Apply two coats, 1st coat of epoxy shall be thinned with 10 to 15% Epoxy thinner in accordance with manufacturer recommendations. Allow mixed epoxy material to digest for 30 to 60 minutes; stir again and apply by brush, roller, or spray. Apply liberal coats. Strive for a uniform film thickness. For roller application keep roller wet; otherwise fiber pulling may result. When applying give particular attention to joints to avoid runs.
E. Doors and Grilles shall be spray painted with two coats of paint.
F. After priming, fill nail holes, cracks and other crevices and smooth work with putty or wood paste filler matching finish.
G. All other surfaces to receive paint shall receive a minimum of 2 coats, and primer as needed.
3.10 FINAL CLEANING
A. Wipe clean all surfaces and sweep floors to remove all dust and construction debris prior to final inspection.
B. Remove and dispose of all trash and debris from the work site.
SECTION 033000 – CAST IN PLACE CONCRETE
PART 1 – GENERAL
1.1 STATEMENT OF WORK: Furnish and place all equipment, materials, supplies and labor to; perform final grading, seeding and mulching areas around the proposed precast concrete vault toilet building, that will be furnished and installed by others, and construct the concrete walkway to the building. The work also includes furnishing aggregate backfill material. The Contractor shall coordinate work schedule with COR.
1.2 OTHER CONTRACTORS WORK: Other contractors will be working at Garden of the Gods Recreation Area including:
A. Garden of the Gods Recreation Area Vault Toilet
1.3 SCHEDULING: The Contractor shall coordinate work schedule with COR.
A. Site work shall not commence until after November 9, 2015 contingent on delivery of Vault Toilet.
B. Backfill, grading, seeding and mulching and path of the new toilet building shall occur when the new vault toilet building is installed. The COR shall provide tentative delivery date of the new vault toilet.
PART 2 – PRODUCTS
2.1 MATERIALS
A. Bedding material for the new vault toilets and concrete sidewalk shall be IL-CA-06 aggregate.
B. Clean fill may be sand, gravel, concrete debris or soil that is dry, free of organic debris and not frozen.
C. Select backfill shall be IL-CA-06 aggregate.
D. Topsoil shall be free of material over 2” in any dimension.
E. Seeding shall be a commercially available lawn mix approved in writing by the Contracting Officer.
F. When available mulch shall be certified weed free and seed free straw.
G. Cast in Place Concrete shall be commercially available, minimum 3500 psi concrete.
H. Concrete reinforcement shall by 6X6 W2.9 welded wire fabric.
PART 3 - EXECUTION
3.1 CLEARING AND GRUBBING
A. Clearing and grubbing shall be confined to designated areas and only marked trees may be removed. Maximum clearing and grubbing shall be confined to an area 20 feet beyond the back and sides of the building and 30 feet in front of the building. Construction work shall disturb a minimum of the existing terrain and plant life adjacent to the cleared and grubbed area. The Contractor shall exercise care to not damage unmarked trees and shrubbery. Skinned or barked trees shall be repaired with an application of black asphalt emulsion especially formulated for such use.
B. Trees shall be felled within the clearing limits, usually towards the center, so as to prevent damage to the trees that are to be left standing. When necessary to prevent damage to structures, adjacent trees, property, or to minimize danger to traffic, trees shall be cut in sections from the top downward.
C. All trimming of trees shall be done in accordance with approved horticultural practices. Branches shall be sawed cut flush with the trunk. Stumps within the clearing limit but out of the excavation area shall be cut not more than 6 inches above the ground.
D. Trees and limbs larger than 4 inches in diameter shall be cut in 8-foot lengths and stockpiled as directed by the Contracting Officer.
3.2 TOPSOIL
A. Topsoil shall be removed from the area to be excavated and from the area where excavated material shall be piled prior to excavating. Topsoil shall be kept separate from excavated material. Topsoil shall be reused on those areas from which it came after backfilling is complete.
3.3 FINISH GRADING
A. Contractor shall furnish IL-CA-06 aggregate select backfill material in the excavations. (Approximately 36 tons total.)
B. Grade backfill around the vault toilet building. Excess excavated material from the building may be used. Grade backfill to match the floor elevation and slope away from the building. Grade area under new concrete walkway to slope away from the door openings and to meet the elevation of the edge of the asphalt road.
C. Final grade shall be flush with top of front slab to provide accessibility.
D. Surface drainage shall be diverted so that it will not enter into the area.
E. Stockpiled topsoil shall be smoothly distributed over disturbed areas and hand raked to blend with ground line.
3.4 CONCRETE WALKWAY
A. Construct 6 inch thick, reinforced concrete walkway to the apron of the new toilet building in the location as directed by the COR. Base material shall be IL-CA-06 aggregate, compacted to a 4 inch depth. The paths shall be 5 feet wide with a rough broom finish. Anticipated length is 25 feet.
3.5 SEEDING AND MULCHING
A. Seed and mulch around new toilet building and new concrete walkway.
B. Seed and mulch shall be spread at a rate recommended by manufacturer.
3.6 CLEANUP
A. After backfilling and grading has been completed, the disturbed area shall be finished to present as near a natural appearance as possible and cleaned up by removing all debris and materials not utilized.
B. Clean building walls, floors, and roof using soapy water.
C. All trash and debris shall be removed from the jobsite at the end of the day.
52.223-2 Affirmative Procurement of Biobased Products Under Service and Construction Contracts (SEP 2013)
(a) In the performance of this contract, the contractor shall make maximum use of biobased products that are United States Department of Agriculture (USDA)-designated items unless—
(1) The product cannot be acquired—
(i) Competitively within a time frame providing for compliance with the contract performance schedule;
(ii) Meeting contract performance requirements; or
(iii) At a reasonable price.
(2) The product is to be used in an application covered by a USDA categorical exemption (see 7 CFR 3201.3(e)). For example, all USDA-designated items are exempt from the preferred procurement requirement for the following:
(i) Spacecraft system and launch support equipment.
(ii) Military equipment, i.e., a product or system designed or procured for combat or combat-related missions.

(c) In the performance of this contract, the Contractor shall—
(1) Report to http://www.sam.gov, with a copy to the Contracting Officer, on the product types and dollar value of any USDA-designated biobased products purchased by the Contractor during the previous Government fiscal year, between October 1 and September 30; and
(2) Submit this report no later than—
(i) October 31 of each year during contract performance; and
(ii) At the end of contract performance.
52.223-9 Estimate of Percentage of Recovered Material Content for EPA-Designated Items (May 2008)
(a) Definitions. As used in this clause— “Postconsumer material” means a material or finished product that has served its intended use and has been discarded for disposal or recovery, having completed its life as a consumer item. Postconsumer material is a part of the broader category of “recovered material.”
“Recovered material” means waste materials and by-products recovered or diverted from solid waste, but the term does not include those materials and by-products generated from, and commonly reused within, an original manufacturing process.
(b) The Contractor, on completion of this contract, shall—
(1) Estimate the percentage of the total recovered material content for EPA-designated item(s) delivered and/or used in contract performance, including, if applicable, the percentage of post-consumer material content; and
(2) Submit this estimate to James Klug.

A post award conference with the successful offeror is required. It will be scheduled and held within ___5___ days after the date of contract award.
DESIGNATION OF CONTRACTING OFFICER'S REPRESENTATIVE
The contracting Officer will designate a Contracting Officer's Representative(COR) at the time of award.
The COR is responsible for administering the performance of work under this contract. In no event, however, will any understanding, agreement, modification, change order, or other matter deviating from the terms of this contract be effective or binding upon the Government unless formalized by proper contractual documents executed by the Contracting Officer prior to completion of the contract.
On all matters that pertain to the contract terms the contractor must communicate with the Contracting Officer. Whenever, in the opinion of the Contractor, the COR requests effort outside the scope of the contract, the Contractor should so advise the COR. If the COR persists and there still exists a disagreement as to proper contractual coverage, the contracting officer should be notified immediately, preferably in writing if time permits. Proceeding with work without proper contractual coverage could result in nonpayment or necessitate submittal for a contract claim.
SECTION H--SPECIAL CONTRACT REQUIREMENTS
EQUIPMENT CLEANING
All soil moving equipment shall be thoroughly cleaned to make it free of soil, noxious weed seeds, vegetative matter or other debris that could contain or hold seeds prior to being delivered to the project site. Equipment shall be considered free of soil, noxious weed seeds and other such debris when a visual inspection by the C.O.R., prior to the equipment being delivered to the site, does not disclose such material present. Disassembly of equipment components is not required. The Contractor shall notify the Forest Service at least five (5) working days prior to moving each piece of soil moving equipment onto the project site, unless otherwise agreed.
The Contractor shall thoroughly clean all soil moving equipment prior to moving them off a project site or between work areas on a project site that are known to be infested with noxious weed species of concern and other work areas, if any, that are free of noxious weed species of concern. Areas known to be infested with specific noxious weed species of concern to the Forest Service shall be noted in the Schedule of Work. The Contractor and the Forest Service shall agree on the methods of cleaning, location for the cleaning and control of off-site impacts, if any.
When new areas of infestation of noxious weeds of concern to the Forest Service are identified on the project site by either the Forest Service or Contractor they shall be promptly reported to the other party.

52.225-9 Buy American—Construction Materials. Buy American—Construction Materials (May 2014)
(a) Definitions. As used in this clause— “Commercially available off-the-shelf (COTS) item”—
(1) Means any item of supply (including construction material) that is—
(i) A commercial item (as defined in paragraph (1) of the definition at FAR 2.101);
(ii) Sold in substantial quantities in the commercial marketplace; and
(iii) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(2) Does not include bulk cargo, as defined in 46 U.S.C. 40102(4), such as agricultural products and petroleum products.
“Component” means an article, material, or supply incorporated directly into a construction material.
“Construction material” means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site. Materials purchased directly by the Government are supplies, not construction material.
“Cost of components” means—
(3) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the construction material (whether or not such costs are paid to a domestic firm), and any applicable duty (whether or not a duty-free entry certificate is issued); or
(4) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
“Domestic construction material” means—
(1) An unmanufactured construction material mined or produced in the United States;
(2) A construction material manufactured in the United States, if—
(i) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(ii) The construction material is a COTS item.
“Foreign construction material” means a construction material other than a domestic construction material.
“United States” means the 50 States, the District of Columbia, and outlying areas.
(b) Domestic preference.
(1) This clause implements 41 U.S.C. chapter 83, Buy American, by providing a preference for domestic construction material. In accordance with 41 U.S.C. 1907, the component test of the Buy American statute is waived for construction material that is a COTS item. (See FAR 12.505(a)(2)). The Contractor shall use only domestic construction material in performing this contract, except as provided in paragraphs (b)(2) and (b)(3) of this clause.
(2) This requirement does not apply to information technology that is a commercial item or to the construction materials or components listed by the Government as follows:

(3) The Contracting Officer may add other foreign construction material to the list in paragraph (b)(2) of this clause if the Government determines that—
(i) The cost of domestic construction material would be unreasonable. The cost of a particular domestic construction material subject to the requirements of the Buy American statute is unreasonable when the cost of such material exceeds the cost of foreign material by more than 6 percent;
(ii) The application of the restriction of the Buy American statute to a particular construction material would be impracticable or inconsistent with the public interest; or
(iii) The construction material is not mined, produced, or manufactured in the United States in sufficient and reasonably available commercial quantities of a satisfactory quality.
(c) Request for determination of inapplicability of the Buy American statute.
(1)(i) Any Contractor request to use foreign construction material in accordance with paragraph (b)(3) of this clause shall include adequate information for Government evaluation of the request, including—
(A) A description of the foreign and domestic construction materials;
(B) Unit of measure;
(C) Quantity;
(D) Price;
(E) Time of delivery or availability;
(F) Location of the construction project;
(G) Name and address of the proposed supplier; and
(H) A detailed justification of the reason for use of foreign construction materials cited in accordance with paragraph (b)(3) of this clause.
(ii) A request based on unreasonable cost shall include a reasonable survey of the market and a completed price comparison table in the format in paragraph (d) of this clause.
(iii) The price of construction material shall include all delivery costs to the construction site and any applicable duty (whether or not a duty-free certificate may be issued).
(iv) Any Contractor request for a determination submitted after contract award shall explain why the Contractor could not reasonably foresee the need for such determination and could not have requested the determination before contract award. If the Contractor does not submit a satisfactory explanation, the Contracting Officer need not make a determination.
(2) If the Government determines after contract award that an exception to the Buy American statute applies and the Contracting Officer and the Contractor negotiate adequate consideration, the Contracting Officer will modify the contract to allow use of the foreign construction material. However, when the basis for the exception is the unreasonable price of a domestic construction material, adequate consideration is not less than the differential established in paragraph (b)(3)(i) of this clause.
(3) Unless the Government determines that an exception to the Buy American statute applies, use of foreign construction material is noncompliant with the Buy American statute.
(d) Data. To permit evaluation of requests under paragraph (c) of this clause based on unreasonable cost, the Contractor shall include the following information and any applicable supporting data based on the survey of suppliers:

52.225-10 Notice of Buy American Requirement—Construction Materials. (May 2014)
(a) Definitions. “Commercially available off-the-shelf (COTS) item,” “construction material,” “domestic construction material,” and “foreign construction material,” as used in this provision, are defined in the clause of this solicitation entitled “Buy American—Construction Materials” (Federal Acquisition Regulation (FAR) clause 52.225-9).
(b) Requests for determinations of inapplicability. An offeror requesting a determination regarding the inapplicability of the Buy American statute should submit the request to the Contracting Officer in time to allow a determination before submission of offers. The offeror shall include the information and applicable supporting data required by paragraphs (c) and (d) of the clause at FAR 52.225-9 in the request. If an offeror has not requested a determination regarding the inapplicability of the Buy American statute before submitting its offer, or has not received a response to a previous request, the offeror shall include the information and supporting data in the offer.
(c) Evaluation of offers.
(1) The Government will evaluate an offer requesting exception to the requirements of the Buy American statute, based on claimed unreasonable cost of domestic construction material, by adding to the offered price the appropriate percentage of the cost of such foreign construction material, as specified in paragraph (b)(3)(i) of the clause at FAR 52.225-9.
(2) If evaluation results in a tie between an offeror that requested the substitution of foreign construction material based on unreasonable cost and an offeror that did not request an exception, the Contracting Officer will award to the offeror that did not request an exception based on unreasonable cost.
(d) Alternate offers.
(1) When an offer includes foreign construction material not listed by the Government in this solicitation in paragraph (b)(2) of the clause at FAR 52.225-9, the offeror also may submit an alternate offer based on use of equivalent domestic construction material.
(2) If an alternate offer is submitted, the offeror shall submit a separate Standard Form 1442 for the alternate offer, and a separate price comparison table prepared in accordance with paragraphs (c) and (d) of the clause at FAR 52.225-9 for the offer that is based on the use of any foreign construction material for which the Government has not yet determined an exception applies.
(3) If the Government determines that a particular exception requested in accordance with paragraph (c) of the clause at FAR 52.225-9 does not apply, the Government will evaluate only those offers based on use of the equivalent domestic construction material, and the offeror shall be required to furnish such domestic construction material. An offer based on use of the foreign construction material for which an exception was requested—
(i) Will be rejected as nonresponsive if this acquisition is conducted by sealed bidding; or
(ii) May be accepted if revised during negotiations.
FAR 52.252-6 Authorized Deviations in Clauses
