Nina Barrow (Contract Specialist Trainee) opened meeting by introducing Forest Service Personnel, stating that she will be the primary contact for this solicitation. Marcia OConnor will be the official Contracting Officer.
Nina reviewed the procedural processes noting that contractors should submit an original plus 1 copy of their proposal by 2PM (EDST) on April 30, 2009. Proposals should include page 1 with blocks 12- 18 filled out, and pages 2-3 with prices filled in on the spaces provided on the Schedule of Items. This contract will be for a Base year plus four(4) option years. Pricing will only be required for the base year, the option years pricing will be adjusted 2.75% cumulatively. Contract time will be from the date of award for 12 months. This is set aside for HUB Zone Small Business. Award will only be made to a Certified HUBZone Small Business. For subcontracting purposes, at least 50 percent of the cost of personnel for contract performance will be spent for employees of the concern or employees of other HUBZone small business concerns. Nina noted that the contractor must comply with and hold a Migrant And Seasonal Agricultural Worker Protection Act certificate, comply with Labor Standards for Contracts Involving Migrant and Seasonal Agricultural Workers, Migrant and Seasonal Agricultural Worker Protection Act Registration, And Personal Protective Equipment clauses. She reviewed Amendment 1 and the requirments for a non-working onsite supervisor to hold a state license for pesticide/herbicide application, the license can be from any state. The Inspections of Services clause was reviewed. The contract effective period will be from date of award for 12 months, with option years to follow. Inspection of services clause was reviewed.
Ed McDonald discussed the Ordering Clause, Delivery Orders will be for no less that $17,500.00, if we have work less than that we can offer it to the contractor but they are not obligated to accept it.
There was a previous question raised about the number of stems/acre; contractors should bid on an average. There will be areas that are heavier and harder than normal and there will be areas that are easier than normal. Contractor will get good areas, bad areas and everything in between.
The following questions were discussed:
United States
Department of
Agriculture
Forest
Service
Cherokee National Forest 2800 Ocoee Street N.
Cleveland, TN 37312-5374
1. Does the contractor have to be HUB Zone certified at time of award opening.
A. No, however the award will only be made to certified HUBZone contractor. HUBZone certification has been taking a long time (3 months or longer), so if vendor is not in the process already, chances are slim to none of them being certified in time.
2. Under Section H, the Clause for Camping provisions allows camping on the National Forest, How does this provision relate to the Department of Labor’s requirement for a commercial establishment that has been certified by a health authority or other agency?
A. That will be up to the contractor to work with the Department of Labor to determine if camping will be acceptable.
3. Is potential slope being taken into consideration when acreage is measured?
A. No, acreage is measured on the horizontal. For tree planting, plots taken to determine spacing and trees per acre is also measured horizontally.
4. At the end of an option year, if very little work is planned for the next option year, will the
Forest Service still extend the option?
A. Yes, we plan this contract to last for 5 years and do not plan to have to re-solicit until the 5 years is up.
5. Will planting sites be burned?
A. Yes, we plan to burn them. If they are not, there will be an opporturnity to negotiate a different rate.
6. How long after harvest to you expect planting to occur?
A. We expect to plant 1 year after harvest, some instances it may be 2 years.
7. Can we supply contract history data beyond 3 years if the work history is relevant to the Scope of Work and is work history performed for the U. S. Forest Service or other related Federal agencies?
A. Yes. Also please specify your experience type, for example, if you have experience working in eastern mountainous terrain, or even in the Appalachian Mountains, you will want to indicate that.
8. How much work has been ordered in past years?
A. The dollar figures for the previous 3 years were: FY 08 -- $176,500; FY 07 -- $ 281,500 and FY 06 -- $369,000. We anticipate the work to continue on the same level as FY 08.
But there is no annual guarantee.
9. Does this contract require bonding?
A. No, Contractor does not need bonding.
